Unpaid pre-adoption leave. Employees' entitlement to pre-adoption leave is set out at clause 58 (Pre-adoption leave).
Unpaid pre-adoption leave. 5.1 An Employee who has complied with all evidence and notice requirements is entitled to up to five (5) days of Unpaid Pre-Adoption Leave to attend any interviews or examination required in order to obtain approval for the adoption.
5.2 An Employee who has received approval to adopt a child who is overseas is entitled to such unpaid leave as is reasonably required by the Employee to obtain custody of the child.
5.3 The Employee is not entitled to Unpaid Pre-Adoption Leave if the Employee could take some other form of leave and is directed to do so by the Employer.
Unpaid pre-adoption leave. An Employee seeking to adopt a Child is entitled to unpaid leave for the purpose of attending any compulsory interviews or examinations as are necessary as part of the adoption procedure. The Employee and Epworth should agree on the length of the unpaid leave. Where agreement cannot be reached, the Employee is entitled to take up to two (2) days unpaid leave. Where paid leave is available to the Employee, Epworth may require the Employee to take such leave instead.
Unpaid pre-adoption leave. Entitlement to unpaid pre-adoption leave
Unpaid pre-adoption leave a) Unpaid pre-Adoption Leave is not restricted to 2 days (as provided by the NES). Employees may access up to 5 days leave. It is available for the purpose of obtaining custody of a child overseas or for attending interviews or examinations relating to the adoption of the child. Reasonable evidence to support unpaid leave under this sub-clause must be provided.
b) If an employee seeks to take leave before the adoption of a child, they must provide written notice of the intention to take the unpaid pre-Adoption Leave. The written notice must:
i) be given to the employer as soon as practicable; and
ii) advise of the period, or expected period of the leave; and
iii) provide evidence that the leave is taken to attend an interview or examinations required to obtain approval for the employee’s adoption of a child.
Unpaid pre-adoption leave. An Employee is entitled to up to two (2) days of unpaid pre-adoption leave to attend S3.
Unpaid pre-adoption leave. Entitlement to unpaid pre-adoption leave
(a) An employee is entitled to up to 2 days of unpaid pre-adoption leave to attend any interviews or examinations required in order to obtain approval for the employee’s adoption of a child. Note: Entitlement is also affected by subsection 7.6.1(b) (which deals with the age etc. of the adopted child).
(b) However, an employee is not entitled to take a period of unpaid pre-adoption leave if:
(i) the employee could instead take some other form of leave; and
(ii) the employer directs the employee to take that other form of leave.
(c) An employee who is entitled to a period of unpaid pre-adoption leave is entitled to take the leave as:
(i) a single continuous period of up to 2 days; or
(ii) any separate periods to which the employee and the employer agree.
(d) An employee must give his or her employer notice of the taking of unpaid pre-adoption leave by the employee.
(e) The notice:
(i) must be given to the employer as soon as practicable (which may be a time after the leave has started); and
(ii) must advise the employer of the period, or expected period, of the leave.
(f) An employee who has given his or her employer notice of the taking of unpaid pre-adoption leave must, if required by the employer, give the employer evidence that would satisfy a reasonable person that the leave is taken to attend an interview or examination as referred to in subsection (a).
(g) An employee is not entitled to take unpaid pre-adoption leave unless the employee complies with subsections (d) to (f). Note: Personal information given to an employer under this section may be regulated under the
