Unsafe or Hazardous Working Conditions. Bargaining Unit Members shall not be required to work under unsafe or hazardous conditions or to perform tasks which endanger their health, safety, or well-being. If the Employee becomes aware of a potentially unsafe or hazardous condition, the Employee shall report this situation to his/her immediate appropriate administrator, who shall promptly investigate.
Unsafe or Hazardous Working Conditions. Employees are required to bring to the attention of their supervisor potential unsafe and/or hazardous working conditions, which shall be investigated and corrected as soon as practical.

Main entrances, campus and traffic supervisors and detention room aides shall be provided a communication device while on duty. Campus traffic supervisors assigned to work outside shall be provided by District 99 Board of Education, protective, reflective and appropriate outerwear. The Board acknowledges its current responsibilities under applicable regulations of the Illinois Department of Labor with respect to protecting affected individuals against the spread of blood borne pathogens. The determination of the Board to provide inoculations and /or training pursuant to its blood borne pathogen policy to an Employee shall not be precedential with respect to such Employee, but the determination to provide such shall be dependent upon an analysis of pertinent risk factors.

Unsafe or Hazardous Working Conditions. A. Bargaining unit members shall not be required to work under unsafe or hazardous conditions or to perform tasks, which endanger their health, safety, or well-being. All school buildings and grounds shall be tobacco-free at all times.
B. No Association member, except for certified school nurses and non-certificated registered professional nurses, shall be required to perform medical procedures to any student in the district, if this requirement violates Illinois State Law or the Illinois School Code. This section shall not prohibit any school district employee from providing emergency assistance to students.
Unsafe or Hazardous Working Conditions. Employees shall not be required to perform job related duties in the presence of unsafe or hazardous conditions. Unsafe or hazardous conditions do not include circumstances where an Employee has a health condition caused by, related to, or reactive to the elements of environment, circumstances or materials, if normal job expectations require exposure to such elements, and those elements are not normally considered injurious to human health. The Board may make a reasonable accommodation to persons with disabilities, and such accommodations shall not be deemed in violation of this agreement.

(1) Employees shall report immediately in writing to SEDOL’s central office all cases of assault and/or battery suffered by them in connection with their employment, and all facts concerning the incident. If the employee is physically unable to report in writing, he/she shall report orally as soon as possible and thereafter, when possible, confirm the same in writing.
(2) The Board shall act in appropriate ways as liaison between the employee and civil authorities investigating such assault and/or battery. Where circumstances require, the Board shall seek to facilitate necessary communications between the employee and the parents of any student involved in such assault and/or battery.
(3) Pursuant to the provisions of the Illinois School Code, the Board agrees to indemnify and protect employees against death and bodily injury and property damage claims and suits, including defense thereof, when damages are sought for negligent or wrongful acts allegedly committed during the scope of employment or under the direction of the School Board, and while acting in conformance with Board policy and administrative direction.
(4) During adverse weather conditions which make driving hazardous, the Vocational Facilitators, Occupational Therapists, Physical Therapists, Certified Occupational Therapist Assistants and Physical Therapist Assistants who travel, within their professional duties and in collaboration with the Supervisor/Coordinator of the program, may alter the schedule for the day, so as not to endanger their personal safety. The Vocational Facilitators Occupational Therapists, Physical Therapists, Certified Occupational Therapist Assistants or Physical Therapist Assistants, in coordination with their immediate supervisors, will make all phone calls made necessary by alterations to the schedule.

(3) Pursuant to the provisions of the Illinois School Code, the Board agrees to indemnify and protect employees against death and bodily injury and property damage claims and suits, including defense thereof, when damages are sought for negligent or wrongful acts allegedly committed during the scope of employment or under the direction of the School Board, and while acting in conformance with Board policy and administrative direction. Under such circumstances, the employee’s salary shall not be discontinued during the pendency of any criminal charges before the trial court which may be brought against the employee.
