Updates and Maintenance. Apple may, from time to time, update the software used by the Service. These updates could include bug fixes, feature enhancements or improvements, or entirely new versions of the Software. In some cases, such updates may be required to continue Your use of the Service or to access all features of the Service. Apple is not responsible for performance or security issues resulting from Your failure to support such updates. Apple shall, from time to time, be required to perform maintenance on the Service. While Apple is not obligated to notify You of any maintenance, Apple will use commercially reasonable efforts to notify You in advance of any scheduled maintenance.
Updates and Maintenance. Software upgrades and maintenance to equipment and devices will be carried out as necessary and will only be notified to the Client when the Client’s assistance is necessary.
Updates and Maintenance. The County will be responsible for the perpetual update and maintenance of the County’s LBRS subsystem and spatial data assets. OGRIP will be responsible for the integration of the County’s subsystem data into the state’s Location Based Response System (LBRS). The County agrees to be responsible for the administration, coordination and submission of maintenance and updates associated with the LBRS subsystem and related spatial data including the timely update and maintenance of the Ohio County GIS Profile survey. Both Parties will develop a mutually agreed upon schedule for the frequency of maintenance and update submission (including Metadata) to OGRIP for publishing to GIServOhio in a subsequent MOA.
Updates and Maintenance. During the Term, Google will make available to Customer copies of all current versions, updates, and upgrades of Premium Software, promptly upon general availability, as described in the Documentation. Unless otherwise stated in the Documentation, Google will maintain the current release of Premium Software and the two versions immediately preceding the current release, including by providing reasonable bug fixes and security patches. Maintenance for any Premium Software may be discontinued with one year’s notice from Google, except Google may eliminate maintenance for a version and require upgrading to a maintained version to address a material security risk or when reasonably necessary to avoid an infringement claim or comply with applicable law.
Updates and Maintenance. (a) This License does not include a right of the Customer to receive updates from the Supplier. The Supplier may however offer the Customer updates of the Software, whereby an additional charge shall apply as agreed upon by the Parties by way of a separate agreement. Any such updates so delivered to and accepted by the Customer shall be considered Software under the terms of this License.
(b) Save for the warranty obligations stipulated in Section 5. below, this License does not include a right of the Customer to receive any maintenance services.
Updates and Maintenance. 1. The Supplier will ensure that the User will have the latest version of the software at its disposal at all times.
2. The User accepts in advance that Yesplan may be temporarily unavailable while updates are being made or maintenance is being carried out. The Supplier will carry out this work outside office hours as far as is reasonably possible. The User will be informed of the planned work in advance.
3. The Supplier and the User have concluded a separate maintenance agreement (SLA) with respect to the maintenance. This maintenance agreement forms an appendix to this Agreement.
Updates and Maintenance. 3.1 Upon the completion of any maintenance or enhancements to the Licensed Software made by Licensor for its own benefit during the term of the Management Services Agreement (an "Update"), such Update shall be installed on the Maverick Systems and operated for Licensor and shall be automatically included in the license granted herein to Licensee, at no extra charge, unless such Update was developed or created at Licensee's request, in which event Licensee shall pay to Licensor a fee of Licensor's direct development cost plus 25% markup for the development of such Update. In the event Licensee has paid Licensor for the Update and Licensor subsequently wishes to use the Update for its own benefit, Licensor shall reimburse Licensee for one-half of the development fee. Notwithstanding any request for development or payment of a development fee by Licensor, the resulting Update shall remain the sole and exclusive property of Licensor.
Updates and Maintenance. 4.1 Volvo and/or the Supplier may, without prior notice, make such updates or amendments to CareTrack as they deem appropriate.
4.2 The Supplier will use its reasonable endeavours to inform the Customer of scheduled maintenance work which might interrupt access to CareTrack.
Updates and Maintenance. 5.1. Provider shall communicate through email at least twenty-four (24) hours in advance of any Planned Maintenance. In the event that Emergency Maintenance is necessary, Provider will use its best efforts to communicate prior notice to Company.
5.2. Provider shall use commercially reasonable efforts to limit Planned Maintenance that will affect the availability of the Products to End Users.
5.3. Company will give Provider at least forty-eight (48) hours’ notice by email to the respective account manager or customer relations representative of patches, system upgrades and updates to their own infrastructure, where such works are likely to have an impact on Provider .
Updates and Maintenance. 6.1. Update or Software Release shall for all intents and purposes of this Agreement be defined as any new version of the Software.
6.2. Maintenance Work shall for all intents and purposes of this Agreement be defined as maintaining and changing the functionality and usability of the
6.3. City of Vienna shall, at its own discretion, update the Software and release new versions.
6.4. City of Vienna may, also at its own discretion, maintain any version of the Software.
6.5. City of Vienna will aim to provide updates, new Software releases or maintenance service but is under no obligation to provide these services to Licensee under this Agreement.
6.6. City of Vienna may choose for which version of the Software it will provide further maintenance services, if any, and shall inform Licensee thereof in due time.
6.7. Notwithstanding any of the above, City of Vienna reserves the right to make changes to the Software at any time.
6.8. Licensee acknowledges that City of Vienna can only provide any of the above- mentioned services to Licensee, if Licensee has not made (substantial) changes to the Software.
6.9. Notwithstanding section 6.2. City of Vienna will aim to provide at its own discretion user support for the Software.
6.10. Licensee shall have no claim to any of the above-mentioned services. City of Vienna will provide these voluntarily and on its own accord.
