Use of Project Site. Contractor must confine operations at the Project Site to areas permitted by law, ordinances, permits and the authorized Service Work Order, and must not unreasonably encumber the Project Site with any materials, equipment, temporary structures, or temporary measures. Contractor’s employees, or others subject to Contractor’s control, are not permitted to reside on the Project Site in temporary living facilities.
Use of Project Site. Borrower shall not (nor shall Borrower allow any Project Company to) use, or permit to be used, the Project Site for any purpose other than for the construction, operation and maintenance of the Projects as contemplated by the Operative Documents, without the prior written consent of Administrative Agent (with the consent of the Majority Lenders, acting reasonably), or locate any portion of any Project on a site other than as permitted by the Operative Documents, except, in each case, to the extent such use does not conflict with the business of Borrower (or the Project Companies) or Borrower’s (or the Project Companies’) compliance with the Material Project Documents in effect from time to time.
Use of Project Site. Pursuant to a final, non-appealable determination by a Governmental Authority, the Borrower shall cease to have the right to (i) possess and use the Project Site and the Improvements for the purpose of owning, constructing, maintaining and operating the Project in the manner contemplated by the Transaction Documents, for a period of thirty (30) consecutive days, or (ii) sell or otherwise dispose of any of its interest in the Project Site or the Project other than as permitted by the Loan Documents.

Use of Project Site. (a) The Concessionaire shall use the Project Site during the Concession Period only for the purposes of implementing the Project thereat and for purposes incidental or necessary thereto as permitted under this Agreement and shall not, without the prior written consent of H.D.A., use the Project Site for any other purpose. In the event for efficient operation and management of the plant, an office is required to for day to day operations of the Project Facility, H.D.A. may consider approving the same. The Concessionaire acknowledges, accepts, confirms and agrees that this is an essential condition of this Agreement.
