Temporary Measures. 1. Nothing in this Agreement shall be construed to prevent a Party from adopting or maintaining temporary restrictive measures with regard to trade in goods and services and with regard to payments and capital movements: (a) in the event of serious balance of payments or external financial difficulties or threat thereof; or (b) where, in exceptional circumstances, payments and capital movements cause or threaten to cause serious difficulties for macroeconomic management, in particular, monetary policy or exchange rate policy in either Party. 2. Measures referred to in paragraph 1 shall: (a) be in accordance with the rights and obligations established in the WTO Agreement and consistent with the Articles of Agreement of the International Monetary Fund (IMF), as applicable; (b) avoid unnecessary damage to the commercial, economic and financial interests of the other Party; (c) not exceed those necessary to deal with the circumstances set out in paragraph 1; (d) be temporary and be phased out or eliminated as soon as situation specified in paragraph 1 improves; and (e) be non-discriminatory. 3. Nothing in this Agreement shall be regarded to affect the rights enjoyed and obligations undertaken by a Party as a party to the Articles of Agreement of the IMF. 4. A Party shall publish or notify to the other Party of any restrictions adopted or maintained under paragraph 1, or any changes therein, to the extent that it does not duplicate the process under the WTO and the IMF.

Temporary Measures. 11.1 This Agreement shall not affect the rights of any Party to take temporary measures in the interests of defence and security, public safety, public order, economic interests of the State, public morality, public health, and any other circumstances of a similar nature. Such temporary measures shall include, but not limited to, the temporary closure of the border post within that Party’s territory. 11.2 The Party taking any temporary measures under this Article shall, prior to taking such temporary measures, inform the other Party without delay through the exchange of diplomatic notes and refer the matter to the Joint Commission for consideration. 11.3 In circumstances where prior notification shall not be practical, the Party taking such temporary measures shall simultaneously inform the other Party of the temporary measures imposed through the exchange of diplomatic notes and refer the matter to the Joint Commission for consideration. 11.4 Each Party shall take responsibility to expeditiously informing its Officers working in the control zone about the temporary measures imposed.
Temporary Measures. Without prejudice to the right of taking such temporary measures as are permitted under the general rules of international law, the provisions of this Agreement shall remain in force notwithstanding a conflict arising between the Contracting Parties. The measures referred to above shall be repealed no late than the date of the actual termination of the conflict between the Contracting Parties, irrespective of whether or not diplomatic relations have been reestablished between them.
Temporary Measures. In July of 2012, the Parties agree that due to economic conditions, as well as actions by the State of California, that the City was forced to seek concessions from its Employees. The Parties recognized that the City could balance its budget by laying off Employees, but the Parties agree that it was preferable to rely on concessions that would ensure the Employees did not lose their jobs and that the community did not suffer a more radical reduction in service delivery. The Parties met and conferred in good faith and agreed to certain concessions, as well as certain recompense for these concessions. The Parties have also agreed to their preferences for unwinding these concessions as the fiscal situation improved. The Pay Cuts and suspension of COLAs have been discontinued due to improved economic conditions, and the Parties hereby declare that it is their mutual intention that the remaining concessions be temporary and that they be unwound as soon as they can possibly be removed without fiscal harm to the City.

Products which were produced and labelled in conformity with national law before this Agreement entered into force but which do not comply with the requirements of this Agreement, may continue to be sold until stocks run out. 2. Products which were produced and labelled, in conformity with domestic law, with the geographical indications listed in paragraphs 3 and 4 below after this Agreement entered into force and before the termination of the periods referred to in paragraphs 3 and 4 below, but which do not comply with the requirements of this Agreement, may continue to be sold in the territory of the Party where the product originated until stocks run out. 3. For a transitional period of 10 years from the entry into force of this Agreement, the protection pursuant to this Agreement of the following geographical indications of the EU Party shall not preclude these geographical indications from being used in order to designate and present certain comparable products originating in Ukraine: (a) Champagne, (b) Cognac, (c) Madeira, (d) Porto, (e) Jerez /Xérés/ Xxxxxx, (f) Calvados, (g) Grappa, (h) Anis Portugués, (i) Armagnac, (j) Marsala, (k) Malaga,
Temporary Measures. 6.7.1. If a measure needs to be taken urgently, the Director for Welfare shall: a. decide upon a temporary measure not exceeding one week; b. consult the International Board of XXXX and the Organising Committee of the respective International Event, if applicable, on the enforcement of the measure; c. within a reasonable time after the decision is made, convene the Ethical Committee, which may convert the temporary measure into a permanent one.

Temporary Measures.  Once grouping has taken place and on the signing date of this Agreement, employees in post on 31 December 2015 with at least 10 years’ seniority in the insurance sector who are classified in the new role groups 1 to 5 shall benefit from the group change guarantee provided for in Article 13-I-C as of 31 January 2016, subject to them never having changed groups in their insurance sector careers. The same principle shall apply for the 2017 financial year and subsequent years.  Migration to new role groups shall occur as follows, whereby it should be noted that each employee is guaranteed that their scaled pay shall remain the same on the transition date and, in the event that their scaled pay at the time of transition is lower than the starting scale for the new group, they are guaranteed this starting scale:  employees included in the old groups 1-6 shall be classified in the new role group 1  employees included in the old group 7 shall be classified in the new role group 2  employees included in the old group 8 shall be classified in the new role group 3  employees included in the old group 9 shall be classified in the new role group 4  employees included in the old groups 10 and 11 shall be classified in the new role group 5  employees included in the old groups 12 and 13 shall be classified in the new role group 6 These migrations are not treated as group changes.

  • Temporary Safeguard Measures 1. A Contracting Party may adopt or maintain measures not conforming with its obligations under Article 2 relating to cross- border capital transactions and Article 15: (a) in the event of serious balance-of-payments and external financial difficulties or threat thereof; or (b) in cases where, in exceptional circumstances, Movements of capital cause or threaten to cause serious difficulties for macroeconomic management, in particular, monetary and exchange rate policies. 2. Measures referred to in paragraph 1: (a) shall be consistent with the Articles of Agreement of the International Monetary Fund, so long as the Contracting Party taking the measures is a party to the said Articles; (b) shall not exceed those necessary to deal with the circumstances set out in paragraph 1; (c) shall be temporary and shall be eliminated as soon as conditions permit; (d) shall be promptly notified to the other Contracting Party; and (e) shall avoid unnecessary damages to the commercial, economic and financial interests of the other Contracting Party. 3. Nothing in this Agreement shall be regarded as altering the rights enjoyed and obligations undertaken by a Contracting Party as a party to the Articles of Agreement of the International Monetary Fund.

  • Temporary Positions A) The Employer may create regular temporary positions for vacation relief for more than one (1) incumbent for up to six (6) months duration. B) The Employer may create regular temporary project positions (i.e. grant funded, capital projects, pilot projects, or term specific assignments) for up to twelve (12) months’ duration. In taking measures under these WTO provisions, a Party shall, consistent with WTO law and jurisprudence and in accordance with its domestic legislation, exclude imports of an originating product from one or several Parties if such imports do not in and of themselves cause or threaten to cause serious injury.

  • Emergency Measures Additional measures and/or other special requirements necessary during periods of critical fire-weather conditions shall be included in the fire prevention and presuppression plan.
