Use of the Grant Sample Clauses
Use of the Grant. 4.1 The Grant shall be used by the Recipient for the delivery of the Project in accordance with the Project Programme, the Grant Application, the Grant Determination Letter and in accordance with the Agreement. For the avoidance of doubt, the amount of the Grant that the Recipient may spend on any item of Eligible Expenditure listed in the Project Programme shall not exceed the forecasted amounts as listed in the Project Programme (without prior written agreement of Salix).
4.2 The Recipient shall not use the Grant to:
4.2.1 make any payment to members of its Governing Body;
4.2.2 purchase buildings or land; or
4.2.3 pay for any expenditure commitments of the Recipient entered into before the Grant Payment Date, unless this has been approved in writing by the Secretary of State.
4.3 The Recipient shall not spend any part of the Grant on the delivery of the Project after the date of Practical Completion.
4.4 Should any part of the Grant remain unspent at the date of Practical Completion, or should any part of the Grant be provided for items of Eligible Expenditure which subsequently cost less than forecasted in the Project Programme, the Recipient shall, unless otherwise agreed in writing by the Secretary of State, ensure that any unspent monies are returned to the Secretary of State.
4.5 Where the Recipient enters into a contract with a third party in connection with the Project, the Recipient will remain responsible for paying that third party. Neither the Secretary of State nor Salix has responsibility for paying the invoices of third parties.
4.6 Onward payment of the Grant and the use of sub-contractors shall not relieve the Recipient of any of its obligations under the Agreement.
4.7 Any liabilities arising at the end of the Project and which are not otherwise incorporated within the Project Programme, including but not limited to any redundancy liabilities for staff employed by the Recipient to deliver the Project, must be managed and paid for by the Recipient using other resources of the Recipient and not using the Grant. There will be no additional funding available from the Secretary of State for this purpose.
Use of the Grant. The amount of the grant support will be used strictly for the purpose of the project and not for any other purpose. In case it is found/established at any stage that the amount of grant has been mis utilized /misappropriated by the DA, if any, directly or indirectly, the further disbursement of installments will be stopped by DRDO. In such case, the DA, if any, shall be liable to refund the entire Grant/disbursements made by DRDO till date, together with interest shall also be liable to be prosecuted for appropriate civil and/or criminal action which might be taken by DRDO against the DA, its directors and guarantor and/or official/agent of the DA.
Use of the Grant. (a) The Government will ensure that the Grant and any assets or services funded by the Grant, in whole or in part, will be used solely in furtherance of this Agreement and the Program.
(b) The Government also will ensure that no Grant funding will be used for any purpose that would violate United States law or policy, as specified in this Agreement or as further notified to the Government in writing by MCC, including but not limited to the following purposes:
(i) for assistance to, or training of, the military, police, militia, national guard or other quasi-military organization or unit;
(ii) for any activity that is likely to cause a substantial loss of United States jobs or a substantial displacement of United States production;
(iii) to undertake, fund or otherwise support any activity that is likely to cause a significant environmental, health or safety hazard, as further described in the “MCC Environmental Guidelines” posted at xxx.xxx.xxx (the “MCC Website”) or otherwise made available by MCC to the Government (“MCC Environmental Guidelines”) (to the extent applicable to the Threshold Program and as may be further instructed by MCC from time to time); or
(iv) to pay for the performance of abortions as a method of family planning or to motivate or coerce any person to practice abortions, to pay for the performance of involuntary sterilizations as a method of family planning or to coerce or provide any financial incentive to any person to undergo sterilizations or to pay for any biomedical research which relates, in whole or in part, to methods of, or the performance of, abortions or involuntary sterilization as a means of family planning.
Use of the Grant. The Applicant shall apply the amount of the Grant to the carrying out of the Project in accordance with the terms of the Application and the Project budget forming part thereof, of this Agreement. The Applicant shall not use any part of the Grant for any other purpose without the written consent of WHC. WHC funds cannot be used to contribute to any endowment fund(s).
Use of the Grant. 5.1 The Council shall use the Grant to pay for Eligible Expenditure only.
5.2 The Council shall not use the Grant for any of the following purposes:
(a) purposes that are detrimental or derogatory to the generation or distribution of renewable energy;. or
(b) purposes that are specifically counterproductive, detrimental or derogatory towards or in conflict with the operation of the Funder’s projects.
Use of the Grant. 2.1 The Recipient shall use the Grant only to fund the costs of the Project in accordance with the terms of this Agreement.
2.2 The Project must commence by 20th March 2021 and be completed by 30th September 2021.
2.3 The Grant shall not be used for any other purpose without the prior written agreement of the Funder.
2.4 The Recipient shall ensure that all use of the Grant is in accordance with the Fund guidance and any other guidelines or policies that the Funder may specify to the Recipient as being relevant to the Project.
Use of the Grant. 6.1. The Grantee shall not use the Grant for any purpose other than the performance of the relevant Project as specified in Item 2 of Schedule A.
6.2. The Grantee shall only use the Grant and the Grantee’s Contribution for the purposes of expenditure on Project Costs.
6.3. The Grant is made available for a particular Project and is not transferable between projects undertaken by the Grantee.
Use of the Grant.
(a) The Government shall ensure that the Grant and any Program Assets or services funded by the Grant, in whole or in part, are used solely in furtherance of this Agreement and the Program.
(b) The Government also shall ensure that no Grant funding is used for any purpose that would violate United States law or policy, as specified in this Agreement or as further notified to the Government in writing by MCC, including but not limited to the following purposes:
(i) for assistance to, or training of, the military, police, militia, national guard or other quasi-military organization or unit;
(ii) for any activity that is likely to cause a substantial loss of United States jobs or a substantial displacement of United States production;
(iii) to undertake, fund or otherwise support any activity that is likely to cause a significant environmental, health or safety hazard, as further described in MCC’s Environmental Guidelines provided by MCC or posted at xxx.xxx.xxx (the “MCC Website”) and any guidance documents issued by MCC in connection with such guidelines (collectively, “MCC Environmental Guidelines”); or
(iv) to pay for the performance of abortions as a method of family planning or to motivate or coerce any person to practice abortions, to pay for the performance of involuntary sterilizations as a method of family planning or to coerce or provide any financial incentive to any person to undergo sterilizations or to pay for any biomedical research which relates, in whole or in part, to methods of, or the performance of, abortions or involuntary sterilization as a means of family planning.
Use of the Grant. 4.1 The Grant Recipient shall only use the Grant for the Allowable Expenditure and for the delivery of the Project.
4.2 The Grant Recipient shall not use the Grant to:
4.2.1 make any payment to members of its Governing Body;
4.2.2 purchase buildings or land; or
4.2.3 pay for any expenditure commitments of the Grant Recipient entered into before the Commencement Date, unless this has been approved in writing by the Council.
4.3 The Grant Recipient shall not spend any part of the Grant on the delivery of the Project after termination of this Agreement or expiry of the Term.
4.4 Should any part of the Grant remain unspent at the expiry of the Term, the Grant recipient shall ensure that any unspent monies are returned to the Council unless agreed otherwise in writing with the Council.
4.5 Any liabilities arising at the end of the Project including any redundancy liabilities for staff employed by the Grant Recipient to deliver the Project must be managed and paid for by the Grant recipient using the Grant (provided it constitutes Allowable Expenditure) or other resources of the Grant Recipient. There will be no additional funding available to the Council for this purpose.
