USE OF THE VEHICLE. 15.1 The Customer agrees that, during the Rental Period, the Customer will not allow the Vehicle to be:
(a) driven otherwise than in a prudent and cautious manner. A single Vehicle rollover is considered a breach of this condition. A single Vehicle rollover may include, but is not limited to, a vehicle that has rolled, tipped or fallen over and this has caused damage to the side and/or roof area of the Vehicle in circumstances within the control of the Customer. Customers who have purchased The Bundle (in conjunction with the Liability Reduction Option) or the maui Inclusive Pack will have the cost of damage resulting from an accidental single vehicle rollover covered, provided that the Customer has not otherwise breached this agreement in relation to the rollover;
(b) driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law;
(c) left with the ignition key in the Vehicle while it is unoccupied;
(d) submerged in water, brought into contact with salt water, used in a creek or river crossing, driven on a beach or through flooded areas;
(e) used for any illegal purpose or in any race, rally or contest;
(f) used to tow any vehicle or trailer;
(g) used to carry passengers or property for hire or reward;
(h) used to carry more persons than is permitted by any relevant authority or detailed in the Vehicle manual or on the Vehicle or specified in this Agreement;
(i) used to carry volatile liquids, gases, explosives or other corrosive or inflammable material; and
(j) used for transporting and haulage of goods other than what might be reasonably expected of a leisure rental.
15.2 Road restrictions apply as follows:
(a) maui vehicles may only be driven on sealed/bitumen or well-maintained roads.
(b) Vehicles are not permitted to be driven on Skippers Road (Queenstown), the Crown Range Road (Queenstown), Ball Hut Road (Mt. Cook), Ninety Mile Beach (Northland), North of Colville Township (Coromandel Peninsula) and all ski field access roads (from 01 June to 31 October). The Customer is responsible for all damage if travelling on these roads.
15.3 We value your well-being, and for safety purposes, maui reserves the right, at its sole discretion, to restrict Vehicle movements in certain areas due to:
(a) adverse road or weather conditions;

USE OF THE VEHICLE. It is expressly forbidden to use the vehicle for the following cases:

USE OF THE VEHICLE. The Hirer shall not:
USE OF THE VEHICLE. 10.1 The Hirer or any person permitted to use the Vehicle in accordance with clause 3, shall not use or operate or permit the Vehicle to be used or operated:
a) Under the influence of alcohol or any drug that affects his or her ability to drive the Vehicle;
b) If it becomes unsafe or in unroadworthy condition that arose during the Term of Hire;
c) In any race, speed test, rally or contest;
d) If at any time he or she is disqualified from holding or has never held a drivers license appropriate for that Vehicle;
e) Sublet or hire the Vehicle to any other person;
f) Permit the Vehicle to be operated by any person not named in clause 3, or outside his or her authority;
g) In circumstances that constitute an offense by the driver against the Land Transport Xxx 0000;
h) In breach of the Transport Xxx 0000, Xxx Xxxx Xxxxxxxxx Xxx 0000, the Traffic Regulations 1976, or any other act, regulation, rules or bylaws relating to road traffic;
i) For the transport of more than the number of passengers or more than the weight of goods specified in the certificate of loading for the vehicle; and
j) On any beach or unsealed road.
USE OF THE VEHICLE. A copy of this rental agreement shall be kept in the vehicle during the rental period, and on request be presented to a police officer, customs officer or another person acting on behalf of the lessor's interests. The vehicle may be employed for normal use in Sweden by the lessee. Should another person wish to drive the vehicle, the expressed written consent of the lessor shall be required. The lessee is responsible for ensuring that the driver of the vehicle is authorised to drive the vehicle. Should the lessee wish to use the vehicle outside of Sweden, this may be done only after the lessor has given written permission. The lessee is aware that his right to dispose of the vehicle according to the rental agreement is immediately terminated should he try to take the vehicle outside of Sweden, without the lessor's written permission. This means that the police / customs or another entity acting in the interest of the lessor has the right to seize and detain the vehicle. The lessee is responsible for all expenses the lessor may incur if the lessee or his representative has unlawfully taken the vehicle outside Sweden or into countries which the lessor has not approved in writing. The lessee must not rent the vehicle to a second party. Using the vehicle for the transportation of passengers or freight for remuneration is not permitted. The vehicle must not be used to help start, pull, push, or otherwise move another vehicle. Use of the vehicle in motor races is not permitted.
USE OF THE VEHICLE. I agree that during the rental period, I will not and will not allow the Vehicle to be;
a) Driven otherwise than in a cautious, prudent and normal manner;
b) Used in a manner which could cause damage
c) Driven in a prohibited area or in an area other than the areas indicated by me to GA;
d) Driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law;
e) Left open whilst the vehicle is unoccupied
f) Left with the ignition key in the vehicle while it is unoccupied
g) Left unoccupied without the TV/DVD covered.
h) Driven by persons :
i. Under the age of 25 years (or under 25 if an undergraduate or student);
ii. Over the age of 75;
iii. Who is not authorised by law to drive the Vehicle. Particulars of a proposed licensed driver of the Vehicle are set out under the heading 'Hire’s name/ contact’ on the Rental Agreement.
i) Damaged by :
i. Submersion in water ii. Contact with Salt Water
j) Used for any illegal purpose for any race, rally or contest
k) Used to tow any vehicle or trailer.
l) Used to carry passengers or property for hire or reward
m) Used to carry more persons than is permitted by any relevant authority or detailed in theVehicle manual or on the Vehicle or specified in this agreement n) Used to carry volatile liquids, gases, explosives or other corrosive or inflammable material o) Otherwise used in breach of my obligations under this Agreement.
USE OF THE VEHICLE. The Hirer will not allow the vehicle to be:
a) driven otherwise than in a prudent and cautious manner. A single vehicle rollover is considered a breach of this condition and has an excess of NZ$5000 plus occurring costs.
b) driven by a person under the influence of alcohol/drugs or a blood alcohol level in excess of that permitted by law.
c) left with the ignition key in the vehicle while it is unoccupied.
d) damaged by: submersion in water, contact with salt water, river crossing, driving through flooded areas, beach driving.
e) used for any illegal purpose or in any race, rally or contest.
f) used to tow any vehicle or trailer.
g) used to carry passengers or property for hire or reward.
h) used to carry more persons than is permitted by any relevant authority.
i) used to carry volatile liquids, gases, explosives or other corrosive or inflammable material.
j) used for transporting and haulage of goods other than what might be reasonably expected of a leisure rental.
k) used for smoking inside of the vehicle.
l) altered or any additions made.
m) used to transport animals, excluding registered guide dogs or with written permission
n) The Hirer and any user the Hirer permit to use the vehicle is solely responsible for observing the New Zealand Road Rules, safe driving and operation of the vehicle so as to avoid accidents or injury to people or property. Operating the vehicle in a careless or unsafe manner can be determined solely at the discretion of TaT and may result in the retention of the security bond (see clause 14) o) driven over the allowed speed limit
USE OF THE VEHICLE. 8.1. The Customer agrees that, during the Rental Period, the Customer will be responsible for the adequate use of the Vehicle and for its maintenance. All inadequate uses of the Vehicle will correspond to exclusion to the Liability deposit limit and will be at full expenses of the Customer. Exclusions to Liability deposit are detailed in Clauses 8, 9, 10 and 14.
8.2. The Customer shall take all reasonable steps to properly maintain the Vehicle, including daily checks of the oil, tyre pressure, coolant and batteries, and will inform Condor Campers immediately if Vehicle warning lights indicate any potential malfunction. Failure in these obligations may result in engine Damage, and will constitute a breach of this contract. The customer must always stop the Vehicle and not continue to drive if any engine warning lights appear.
8.3. The Customer shall not make any alterations to the Vehicle without the prior written consent from Condor Campers.
8.4. The driver should drive carefully, especially on roads “Ruta 40” in Argentina and “Carretera Austral” in Chile. In case of extremely high winds, the customer should stop the Vehicle and only continue to drive if safe to do so.
8.5. Vehicles must not be driven through or submerged in water or sand.
8.6. Condor Campers has the right, at its sole discretion, to restrict Vehicle movements in certain areas due to adverse road, weather conditions, distance or possible risks for the Vehicle. Condor Campers will advise you at pick up time of any travel restrictions known at the time. If Condor Campers mandates a change in drop-off location, fees as per change of drop-off destination will not apply.
8.7. Considering that Condor Campers is the unique owner of the Vehicle, the Customer shall not agree, attempt, offer, or sign any Agreement regarding the Vehicle.
USE OF THE VEHICLE. 3.1- Renter is obliged to normally and carefully use the Vehicle in a correct and diligent way and will be liable for any damage caused to it, unless the damage does not result from an act that is accountable to him.
USE OF THE VEHICLE. 3.1 You must ensure that the Vehicle or Replacement Vehicle is used properly and only for the purpose for which it was designed. You must not use or permit the Vehicle to be used for any unlawful or immoral purpose or in contravention of any statute, statutory instrument, regulation or order. The Vehicle or Replacement Vehicle may only be driven by Drivers and may only be used by or for the benefit of the Disabled Person. We reserve the right to install a vehicle telematics device in the Vehicle to track the location and use of the Vehicle and to monitor Driver behaviour.
3.2 You must keep the Vehicle or Replacement Vehicle under your control and not part with possession of the Vehicle nor sell, lease or lend the Vehicle or Replacement Vehicle or allow any other right to be created over the Vehicle or Replacement Vehicle. You must tell us immediately if you or any Driver change address or change the place at which the Vehicle is kept.
3.3 To avoid abuse of the Scheme we have strict qualification criteria for Drivers, which include the following:
3.3.1 each Driver must live within five miles of the Disabled Person’s home;
3.3.2 each Driver under the age of 21 must live with the Disabled Person; and
3.3.3 Drivers under the age of 25 are only allowed to drive Vehicles and Replacement Vehicles in ABI Insurance Group 16 or lower and which also have a power output of 115BHP or less.
3.4 The criteria as set out in clause 3.3 above shall not apply in the event that we have expressly agreed otherwise.
3.5 At the time an application is made to make a person a Driver we will ask a series of questions to establish whether or not the person meets the qualification criteria. If a Driver does not meet the qualification criteria at any time (either because false information is given about the Driver or because his/her circumstances change which means the Driver ceases to meet the qualification criteria) then this will have serious consequences for you and the Drivers (please read the rest of this Agreement for details). It is therefore important that you make each Driver aware of the significance of the qualification criteria and that you ensure that each Driver meets those criteria at all times during the term of this Agreement. Please note that you are responsible to us for ensuring that Drivers do not give us false information and tell us of any relevant changes to their circumstances.
