Time Extensions. 2.03.1 If Contractor requests an extension of time to complete its performance, then the Director, in consultation with the CPO, may, in his or her sole discretion, extend the time so long as the extension does not exceed 90 days. The extension must be in writing but does not require amendment of this Agreement. Contractor is not entitled to damages for delay(s) regardless of the cause of the delay(s).

2.03.2 If the Director requests an extension of time to complete Contractor’s performance, then the CPO may, upon consultation with the Director involved, extend the time so long as the extension does not exceed 90 calendar days. The extension must be in writing but does not require amendment of this Agreement. Contractor is not entitled to damages for delay(s) regardless of the cause of the delay(s).
Time Extensions. DB Contractor shall be entitled to an extension of a Completion Deadline due to Hazardous Materials only as provided in Section 4.6.9.4.2 of the General Conditions and subject to Section 4.6 of the General Conditions, unless otherwise specified in this Section 6.3.2.
Time Extensions. A reasonable extension of time for completion of various Phases may be granted by the Owner should there be a delay on the part of the Owner in fulfilling its obligations pursuant to this Agreement. Such extension shall not be the basis or cause for any claims or causes of action by the Project Consultant for additional or extra compensation. Under no circumstances shall the Project Consultant be entitled to additional compensation or payment as a result of or relating to delays on the Project.
Time Extensions. 7.1 Where a Milestone Failure occurs or is in the opinion of the GLA reasonably likely to occur (having regard to any information provided pursuant to any of Conditions 9.1.4, 10.3 or 11) and:
7.1.1 where such failure is directly caused by a Milestone Extension Event the GLA shall, subject always to Condition 7.3, extend the relevant Milestone Date and associated Named Project Completion Date by such period as it (acting reasonably) considers appropriate to take account of the delay caused or likely to be caused by the Milestone Extension Event; or
7.1.2 where such failure is not directly caused by a Milestone Extension Event, the GLA shall notify the Grant Recipient of the Milestone Failure and the parties shall within fifteen (15) Business Days of such notification seek to agree revised Milestone Dates and:
(a) where revised Milestone Dates are agreed within such period the Grant Recipient shall promptly amend the Milestone Dates on OPS in accordance with Condition 6.1; or
(b) where revised Milestone Dates are not agreed within such period the Milestone Failure shall be treated as a Project Default under Condition 18.2.10.
7.2 The GLA shall not be obliged to extend a Milestone Date:
7.2.1 unless a Milestone Extension Event exists; or
7.2.2 in circumstances where such extension would (when taken individually or together with other extensions in relation to the Grant Recipient) in the GLA’s reasonable opinion materially and adversely affect the delivery of the Approved Bid or (when taken individually or together with other extensions allowed in relation to the Grant Recipient or other grant recipients of the AHP 2016/21) materially and adversely affect the GLA’s projected expenditure profile in relation to any year of the AHP 2016/21 and in particular (but without limitation) such expenditure profile in relation to the last Quarter of the relevant Financial Year.
7.3 The GLA shall not under any circumstances be required or obliged to extend a Named Project Start Date beyond 31 March 2021 but may at its sole discretion elect to do so.
Time Extensions. Subrecipient must spend the funds allocated through this Agreement within the timeframes as specified in Exhibit B.
Time Extensions. Subject to Section 4.6 of the General Conditions and this Section 6.9, DB Contractor shall be entitled to an extension of applicable Completion Deadlines for delays to a Critical Path attributable to the performance of presence/absence surveys at a Karst Feature required by Section 12.2.5.8 of the Design-Build Specifications, and the need to work around locations subject to temporary no-work restrictions due to performance of such surveys (“Karst Investigation Delay”). A Karst Investigation Delay begins on the date DB Contractor notifies TxDOT, in accordance with the Section 12.2.5.8 of the Design-Build Specifications, that a Karst Feature contains suitable habitat for endangered karst invertebrates and ends upon the earlier of (a) completion of the presence/absence surveys required under Section 12.2.5.8 of the Design-Build Specifications for such Karst Feature and (b) discovery of any species listed as a Threatened or Endangered Species at the Karst Feature location. DB Contractor shall bear 100% of the risk of Karst Investigation Delays up to 30 days per individual Karst Feature and up to a cumulative total of 60 days for all Karst Feature locations. If the Karst Investigation Delay exceeds 30 days for a particular Karst Feature, then the risk of such Karst Investigation Delay in excess of 30 days for that Karst Feature shall be borne by TxDOT. If aggregate Karst Investigation Delays for which DB Contractor is 100% responsible exceed 60 days, then the risk of Karst Investigation Delays in excess of 60 days shall be borne by TxDOT. If a Karst Investigation Delay is concurrent with another delay that is DB Contractor’s responsibility under the Design-Build Contract, then DB Contractor shall bear 100% of the risk of such Karst Investigation Delay and the delay to the Critical Path shall not be counted towards the 60-day aggregate cap described in this Section 6.9.5. If a Karst Investigation Delay at one location is concurrent with another Karst Investigation Delay at one or more other locations, the 30-day period of DB Contractor’s responsibility for the delays at the locations shall run concurrently and only one of the concurrent Karst Investigation Delays shall apply to the 60-day cap. The limitations on Karst Investigation Delays shall not preclude DB Contractor from obtaining a time extension with respect to an event that qualifies as an Other Relief Event under Section 4.6.9.3.2(b) of the General Conditions (that is, the discovery of any species liste...

All requests for extensions must be made in writing, and will be reviewed and approved or disapproved by the Assistant Secretary of Public and Indian Housing or the Deputy Assistant Secretary for the Office of Public Housing Investments.
