Legal guarantees. The Seller is liable for defects of conformity of the Products it sells under the conditions of article L.217-4 et seq. of the French Consumer Code, and for hidden defects under the conditions of articles 1641 et seq. of the French Civil Code. The Member must exercise its right exclusively with the Seller in accordance with the conditions provided by the Seller in its Sales Space. The legal guarantee of conformity applies independently of any commercial guarantee that may have been given. In the event that the Member enforces the guarantee for hidden defects with the Seller within the meaning of Article 1641 of the Civil Code, the Member may choose between cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code. It is recalled that if the Member enforces the legal guarantee of conformity with the Seller for Products purchased before the 1st of January 2022, the Member: - has a period of two (2) years from the date of delivery of the Product to act; - can choose between having the Product repaired or replaced, subject to the cost conditions provided for in Article L217-9 of the French Consumer Code; - is exempted from proving the existence of the defect of conformity of the Product during the twenty-four (24) months following the delivery of the Product, except for second-hand goods for which the period is six (6) months. • For Products purchased as of the 1st of January 2022, the Member: - has a period of two (2) years from the date of delivery of the Product to act; - can choose between having the Product repaired or replaced, subject to the cost conditions provided for in Article L217-9 of the French Consumer Code; - is exempted from proving the existence of the defect of conformity of the Product during the twenty-four (24) months following the delivery of the Product, except for second-hand goods for which the period is twelve (12) months. Any repair of the original Product, whether new or used, under the present warranty, will result in an extension of six (6) months of the said warranty. Any replacement implemented by the Seller within the framework of the present warranty will entail, as from the reception of the replacement product, a new period of the legal warranty of conformity attached to the replaced product. Legal guarantees. Independently of the commercial guarantee evoked in articles XI and XII, the Seller is bound in respect to defects in the conformity of the equipment with the contract and redhibitory defects in the conditions of articles 1641 to 1649 of the civil code. The Seller is bound to deliver equipment in conformity with the contract and answers for defects in conformity existing on delivery. It is also answerable for defects in conformity resulting from wrapping, assembly or installation instructions when the latter have been made its responsibility by the contract or have been carried out under its responsibility (L. 211-4 of the Consumer Code). The hidden defects guarantee covers you when your product has a hidden defect, i.e. a defect that is not apparent at the time of sale that makes the product unsuitable for its intended use or significantly reduces that use. If you are claiming under the legal guarantee of conformity, you : - have a period of two (2) years from delivery of the product in which to take action; - may choose between repairing or replacing the product. - are exempt from having to prove the existence of a lack of conformity in the goods during the 6 months following delivery of the goods. The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted. You may decide to invoke the hidden defects guarantee. In this case, you may choose between rescinding the sale or reducing the purchase price.

La formation pratique est indépendante de l’examen théorique et pourra avoir lieu avant ou après celui-ci. En cas d’échec aux examens et après accord sur les besoins de formation complémentaires, l’établissement s’engage à représenter le candidat après un délai administratif imposé par le Service Instructeur, dans la limite des places d’examens qui lui seront attribuées par celui-ci. Le candidat s’engage à respecter les prescriptions pédagogiques et le calendrier de formation. En cas de non respect par le candidat de ceux-ci, l’établissement se réserve la possibilité de surseoir à sa présentation aux épreuves théoriques. Le responsable de l’établissement l’en informera par un écrit motivé et lui proposera un calendrier de formation complémentaire. Après mise en conformité avec les prescriptions de l’établissement, il sera présenté à ces épreuves. Le candidat est tenu de respecter scrupuleusement les instructions délivrées par l’établissement ou ses représentants, en ce qui concerne notamment la sécurité et le déroulement des cours (ponctualité, respect des autres candidats, comportement à bord...).
