2Representations by Contractor. The Contractor accepts that entering into this Contract creates a relationship of trust and confidence between the parties. In this regard, Contractor undertakes to furnish its best skill and judgment and to cooperate with Owner in furthering the interests of Owner and the Project. By entering into this Contract, Owner is relying upon the following representations and specific undertakings of the Contractor: .1Contractor has the ability, experience and personnel to perform the Work defined herein in accordance with all terms of the Contract Documents, including the Contract Time. In particular, Contractor represents that it has substantial experience in performing major projects with scopes of work similar to the Work defined herein. Contractor also represents that such experience includes performing major projects with stringent time constraints and where construction begins before all drawings and specifications have been issued for construction purposes. .2All of Contractor’s management and Site supervisory personnel listed in Exhibit "B" shall remain committed to and available for full-time assignments devoted to the Work unless otherwise specifically noted in Exhibit "B" or otherwise approved in advance in writing by Owner. .3Contractor has (i) visited and carefully examined and inspected the Site and its surroundings and documents which are a matter of public record, and any documents which may be provided by Owner, including the geotechnical report and survey; and, based on such inspections and documents, has satisfied itself as to: the condition of all circumstances affecting the Site and the Work, including the location and nature of the Work, nature of the geotechnical, ground and subsoil, the form and nature of the Site, the subsurface conditions of the Site (both manmade and natural), the location and character of any existing or adjacent work or structures, all conditions of and potential restrictions to Site access, the extent and nature of the Work and materials necessary for carrying out and completing the Work, the general character and accessibility of the Site; the type of equipment and facilities needed before and during prosecution of the Work; the general and local labor conditions under which the Work is to be performed; the presence of construction hazards, if any; the Applicable Laws (including, without limitation, healthcare laws, health laws, immigration and security laws, and labor laws); the accommodations Contractor may requir...
