Acceptance of Risk. You expressly acknowledge and agree that the Internet is a shared network that is not secure and is not controlled by Astound. Any content you access through the Internet access Services is provided by independent third-party content providers over which Astound does not exercise control. Astound does not preview, exercise editorial control over, or endorse any opinions or information accessed through the Services. You expressly understand and agree that it is possible data or files you send or receive over the Internet will be monitored by third-parties and/or subject to unauthorized access by third-parties. Third-parties may gain access to your data, including confidential information. Data or files transmitted over the Internet may contain computer viruses or other harmful components. Astound has no responsibility and assumes no liability for any such acts or occurrences. You expressly assume the risks inherent in connecting your internal network and your Customer Equipment to the Internet and in accessing and using the Internet through the Services.
Acceptance of Risk. As a condition of entering into the Agreement and participating in a Tour, Traveler represents, warrants, and agrees that is has received, reviewed, and executed the “Release and Assumption of Risk” document provided by Infinity or FA to Traveler.

Therefore, as consideration of the services rendered by Company, Pet Parent (A) hereby waives and releases Company, and its invitees, sponsors, members, managers, advertisers, owners, officers, directors, employees, volunteers, invitees, agents, lessors, and any parties owning, controlling or having any interest in the property where the Company facility is located, and all other representatives or agents of Company (collectively, “Company Parties”) from any and all claims, actions, damages or liability for injury, sickness or illness suffered by his or her pet while in the care of Company or otherwise relating to the care, control, health and/or safety of the pet arising from pick up, transport, drop off and/or stay at the Company facilities, except to the extent such illness or injury is the result of Company’s gross negligence or intentional misconduct, and (B) agrees not to initiate any legal proceedings against Company or any Company Parties with respect to such released claims. “Sickness and illness” shall be defined to include any illness, including, without limitation, bordetella (kennel cough) or any other form of contagious illness.

You acknowledge that you may be travelling to countries or regions where political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. It is your responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks apparent upon such travel.
Acceptance of Risk. 29) The Resident acknowledges that Derby Manor does not offer constant supervision or observation of The Resident in the building, on the grounds or while The Resident is participating in activities away from Derby Manor, whether arranged by Derby Manor, or otherwise. The Resident understands that while living at Derby Manor The Resident is responsible for his/her own safety and acknowledges that this may place him/herself at risk. The Resident acknowledges and accepts the risks associated with the residential nature of independent living in The Resident’s own Suite, and at Derby Manor (Building & Grounds or any property associated legally or otherwise with Derby Manor) consistent with The Resident’s choice of lifestyle.

If, for any reason, I feel the Equipment is not in safe condition to use, I will return the Equipment and notify EYC of my concern prior to use. If, for any reason, while the Equipment is in use, I believe the Equipment is unsafe to use, I will immediately discontinue use and return the Equipment to EYC, and notify EYC of my concern. As an adult I agree to take all responsibility for minors that I take as passengers or crew. If I release Equipment to a minor for their use, I agree that they will be under my supervision and I will assume all responsibility of the minor and their actions. Indemnification and Hold Harmless: I agree to indemnify and hold harmless EYC, its members, Board of Directors, agents, servants, employees, and volunteers (collectively “Releasees”) from and against all claims, demands, and judgements, including attorney fees, made or recovered against Releasees including, but not limited to, damages to real or tangible personal property or for bodily injury or death to any person, arising out of, or in any way related to my participation in Sailing or the use of Equipment (collectively “Claims”). I will notify EYC in writing of any Claims and shall cooperate with EYC in a reasonable manner to facilitate defense of such Claims. Permission to Publish: I give EYC permission to publish photos, videos, and recordings taken of my child or I during activities related to Sailing. I understand that neither my child nor I will be paid any royalty or other compensation and I give up any right my child or I may have to payment if a photo, video, or recording is published.
