The Seller shall comply with 49 USC 5301(d), stating Federal policy that the elderly and persons with disabilities have the same rights as other persons to use mass transportation services and facilities and that special efforts shall be made in planning and designing those services and facilities to implement that policy. The Seller shall also comply with all applicable requirements of Sec. 504 of the Rehabilitation Act (1973), as amended, 29 USC 794, which prohibits discrimination on the basis of handicaps, and the Americans with Disabilities Act of 1990 (ADA), as amended, 42 USC 12101 et seq., which requires that accessible facilities and services be made available to persons with disabilities, including any regulations and subsequent amendments.
ACCESS REQUIREMENTS FOR INDIVIDUALS WITH DISABILITIES. The CONTRACTOR agrees to comply with 49 U.S.C. § 5301(d), which states the Federal policy that elderly individuals and individuals with disabilities have the same right as other individuals to use public transportation services and facilities, and that special efforts shall be made in planning and designing those services and facilities to implement transportation accessibility rights for elderly individuals and individuals with disabilities. The Recipient also agrees to comply with all applicable provisions of section 504 of the Rehabilitation Act of 1973, as amended, 29 U.S.C. § 794, which prohibits discrimination on the basis of disability in the administration of programs or activities receiving Federal financial assistance; with the Americans with Disabilities Act of 1990 (ADA), as amended, 42 U.S.C. §§ 12101 et seq., which requires that accessible facilities and services be made available to individuals with disabilities; with the Architectural Barriers Act of 1968, as amended, 42 U.S.C. §§ 4151 et seq., which requires that buildings and public accommodations be accessible to individuals with disabilities; and with other laws and amendments thereto pertaining to access for individuals with disabilities that may be applicable. In addition, the Recipient agrees to comply with applicable implementing Federal regulations and any later amendments thereto, and agrees to follow applicable Federal implementing directives, except to the extent FTA approves otherwise in writing. Subgrantee agrees to comply with all applicable requirements of the Americans with Disabilities Act of 0000 (XXX), 00 X.X.X.§ 00000 et seq.; Section 504 of the Rehabilitation Act of 1973, as amended, 29 U.S.C.§ 794; Section 16 of the Federal Transit Act, as amended, 49 U.S.C.§ 5310(f); and their implementing regulations including, but not limited to, the following specific requirements for landside improvements:
1. As required under DOT ADA Standard 206.4.1, the Subgrantee must ensure that 60 percent of all public entrances to the facility will be accessible. lf a station has only two entrances, then both must be accessible.
2. As required under DOT ADA Standard 206.3, the Subgrantee must ensure that accessible rautes coincide with or are located in the same area as general circulation paths, and elements such as ramps, elevators, and fare vending and collection areas are placed to minimize the distance that wheelchair users and other persans who cannot climb steps must travel in comparison to the general public.
3. As required under DOT ADA Standard 406.8, the Subgrantee must ensure that curb ramps will have detectable warnings. li. PREFERENCE FOR UNITED STATES PRODUCTS AND SERVICES
A. Buy America Requirements: Subgrantee's contractor(s) must agree to comply with 49 U.S.C.§ 5323U) and 49 CFR Part 661, which provide that Federal funds may not be obligated unless steel, iran, and manufactured products used in FTA-funded projects are produced in the United States, unless a waiver has been granted by FTA or the product is subject to a general waiver, listed in 49 CFR 661.7.
