ACTIONS TO INCREASE ATHLETIC OPPORTUNITIES. If through the above-described assessment, the District identifies a sport or sports in which there is sufficient but unmet interest and, if applicable, ability of female students to participate at the interscholastic level at a particular high school, the District will add athletics opportunities as described below at the high school(s) until such time as either (1) the high school is fully and effectively accommodating the expressed interests and abilities of female students (i.e., there remains no unmet interest and ability); or (2) the participation rate for female students in the high school’s interscholastic athletics program is substantially proportionate to their rate of enrollment at the high school. For purposes of this provision, “sufficient interest” is defined as the minimum number of athletes needed to support a team. For “sufficient ability,” it is sufficient that interested students and admitted students have the potential to sustain an interscholastic team and students will not be required to demonstrate they have sufficient ability in a new sport or team if students participating in existing sports or teams are not required to demonstrate through try-outs or some other process that they possess sufficient ability to participate in the specific sport or at the particular level of competition (varsity, junior varsity, etc.) in which they have expressed interest. In providing additional athletic opportunities for female students to either accommodate their expressed interests and abilities or until their rate of participation is substantially proportionate to their rate of enrollment at each subject school, the District shall do the following:

ACTIONS TO INCREASE ATHLETIC OPPORTUNITIES. A. If the District is unable to demonstrate compliance pursuant to either Part I - Substantially Proportionate Participation Opportunities or Part III - Effective Accommodation of Interests and Abilities, then the District, using the results of the District Assessment, will submit its detailed plan with timeframes to effectively accommodate the interests and abilities of middle school female students to the extent necessary to provide equal opportunity in its middle school interscholastic athletics program by the 2019-2020 school year. The District’s detailed plan will include the steps noted below. In addition, the plan will include a description of interim steps that will be taken by the District during the 2018-2019 school year to increase interscholastic athletic participation opportunities for middle school female students. The District also agrees to conduct periodic assessments of the athletic interests and abilities of its middle school students in subsequent years to ensure it is equally and effectively accommodating the athletic interests and abilities of its male and female students consistent with Title IX and its implementing regulation. The District will begin implementation of the plan approved by OCR within 30 days of OCR’s approval. In developing its plan to ensure it is equally and effectively accommodating the athletic interests and abilities of its male and female middle school students, the District will undertake the following steps:
ACTIONS TO INCREASE ATHLETIC OPPORTUNITIES. If the University is unable to demonstrate current compliance under Section I of this Agreement for 2016-2017 or 2017-2018 as outlined above, then the University will by June 30, 2018, submit to OCR its detailed plan with timeframes to ensure that it effectively accommodates the interests and abilities of the underrepresented sex to the extent necessary to provide equal opportunity in its intercollegiate athletics program by no later than the 2018-2019 academic year, including the steps noted below, as applicable to bring the University into compliance with at least one part of the three- part test:

In addition, the plan will include a description of interim steps that have been or will be taken by the University during the 2016-2017 and 2017-2018 academic years to increase intercollegiate athletic participation opportunities for women. The University will begin implementation of the plan within 30 days of OCR’s approval.

Based on recent survey results, the District identified slow pitch softball and volleyball as sports in which there is sufficient but unmet interest and, , ability of female students to participate at the interscholastic level at Franklin County High School (School). The District will continue to add athletics opportunities at the School until such time as either (1) the School is fully and effectively accommodating the expressed interests and abilities of female students (i.e., there remains no unmet interest and ability); or (2) the participation rate for female students in the high School’s interscholastic athletics program is substantially proportionate to their rate of enrollment at the high school. Competitive and practice facilities, whether provided on campus or through access to community facilities will be provided in a manner consistent with the Title IX regulation at 34
