Application of terms and conditions of employment. All terms provided for in this collective agreement shall apply to employees employed on a permanent variable hours basis except: those terms detailed in the table below which are explicitly identified as not being applicable; and those terms which are otherwise dealt with in clause 13.2 below, as they apply specifically to employees employed on a permanent variable hours basis. The following terms and conditions as set out in this collective agreement shall not apply to employees appointed on a “Permanent Variable Hours” basis: Clause 3.1-3.3 Provisions relating to hours of work, overtime, TOIL.   • GENERAL TERMS AND CONDITIONS OF EMPLOYMENT This Agreement is subject to all applicable laws of the State of California, the rules and regulations of the Board of Governors of the California Community Colleges, and the rules, regulations, policies, and procedures of the District, all of which shall be made a material part of the terms and conditions of this Agreement as if set forth in full. This agreement shall prevail over any conflicting District rules, regulations, policies or procedures.

  • Terms and Conditions of Employment The term “terms and conditions of employment” means the hours of employment, the compensation therefore including fringe benefits except retirement contributions or benefits, and the Board of Education’s personnel policies affecting the working conditions of the employees. All contracts are also contingent upon successful completion of criminal background check. Where applicable, certified salaries include $3000 from the “Targeted Educator Compensation Act” of 2001. Where applicable the employee has also had included within Compensation For Services a stipend for 18 years of Local Longevity Credit.

  • Survival of Terms and Conditions The Parties understand and agree that all terms and conditions of the Agreement that require continued performance, compliance, or effect beyond the termination date of the Agreement shall survive such termination date and shall be enforceable in the event of a failure to perform or comply.

  • Waiver of Terms and Conditions Failure to enforce any of the terms or conditions of this Agreement shall not constitute a waiver of any such terms or conditions, or of any other terms or conditions.
