Management of Change a. The parties to this Collective Agreement accept that change in the health service is necessary in order to ensure the efficient and effective delivery of health services. They recognise a mutual interest in ensuring that health services are provided efficiently and effectively, and that each has a contribution to make in this regard.‌ b. Regular consultation between the employer, its midwives and the union is essential on matters of mutual concern and interest. Effective communication between the parties will allow for: • improved decision making; • greater co-operation between employer and midwives; and • a more harmonious, effective, efficient, safe and productive workplace.

Management of Change. 29.1 The parties to this agreement accept that change in the health service is necessary in order to ensure the efficient and effective delivery of health services. Regular consultation between the employer, employees and their union is desirable on matters of mutual concern and interest. The aim of consultation is to contribute to: • maintaining co-operation between the parties • improved decision making • contribute to a more harmonious, effective, efficient, safe and productive workplace. (i) The employer accepts that elected delegates are the recognised channel of communication between the union and the employer in the workplace. (ii) Paid time off shall be allowed for recognised delegates to attend meetings with management and to consult with employees covered by this Agreement, other recognised workplace delegates and union officials. The purpose will be to consult and discuss the issues addressed in this clause, other clauses of this Agreement and employee participation, staff surplus, effectiveness studies and options for resolving staff surplus. (iii) The amount of time off and facilities provided shall be sufficient to allow full consideration of these issues addressed by this clause.

Effective communication between the parties will allow for: (a) improved decision making (b) greater cooperation between employer and employees; and (c) a more harmonious, effective, efficient, safe and productive workplace. The employer recognises the role of the employee’s staff delegate and the NZNO in assisting in the positive management of change. 28.1.2 Prior to the commencement of any significant change to staffing, structure or work practices, the employer will identify and give reasonable notice to employees who may be affected and to the NZNO to allow them to participate in the consultative process so as to allow substantive input. 28.1.3 Where an employer receives an indication of potential significant changes, they undertake to advise staff and the NZNO as soon as practicable of the possibility of these changes. 28.1.4 Where changes are deemed commercially sensitive to the employer, NZNO and the employees involved in the management of such change, shall meet with the employer and endeavour to reach agreement on any necessary and appropriate confidentiality.

The aim of mechanisms established for this purpose will be to reach agreement and to make recommendations to the Employer, who will endeavour to take the views of those groups into account as far as possible before making final decisions. In accordance with the principles contained above, the Employer agrees that the Union will be advised of any review (prior to commencement) which may result in significant changes to either the structure, staffing or work practices affecting employees, and will provide the Union with an opportunity to be involved in the review. When the implementation of decisions arising from any such reviews will result in staff surpluses the procedures below shall be adopted.

Management of Change. 26.1 The parties acknowledge the following principles: (a) The need to strive to achieve the most efficient and effective use of available resources. (b) That retention of employees is a primary goal. (c) Consideration of health and safety and work life balance issues are imperative ingredients of the employment relationship and its associated structures. During the term of this agreement, the parties will meet as required to discuss initiatives either party has that would advance the above principles. 26.2 Regular consultation between the parties is desirable on matters of mutual concern and interest. 26.3 The aim of mechanisms established for this purpose will be to allow input and to make recommendations to management, who will take the views of employees into account before making final decisions. 26.4 In accordance with the principles contained in 26.2 and 26.3, the employer agrees that APEX will be advised of any review which may result in significant changes to either the structure, staffing or work practices affecting employees, and may provide an opportunity to be involved in the review. When the implementation of decisions arising from any such reviews will result in staff surpluses the procedures in clause 27 below shall be adopted.

Effective communication between the parties will allow for the following: • improved decision-making. • greater cooperation between employer and employees, and • a more harmonious, effective, efficient, safe and productive workplace. Therefore, the parties commit themselves to the establishment of effective and ongoing communications on all employee relations matters. The employer accepts that employee delegates are a recognised channel of communication between the union and the employer in the workplace. Prior to the commencement of any significant change to staffing, structure or work practices, the employers will identify and give reasonable notice to employees who may be affected and to the PSA to allow them to participate in the consultative process so as to allow substantive input. Reasonable paid time off shall be allowed for employee delegates to attend meetings with management and consult with employees to discuss issues concerning the management of change and staff surplus. Prior approval of such meetings shall be obtained from the employer, and such approval shall not be unreasonably withheld.
