APPOINTMENTS AND TRAINING. 6.1 The Mandatary shall appoint competent persons as per Section 16(2) of the OHS Act. Any such appointed person shall be trained on any occupational health and safety matter and the OHS Act provisions pertinent to the work that is to be performed under his / her responsibility. Copies of any appointments and certificates made by the Mandatary shall immediately be provided to the Client.
6.2 The Mandatary shall at the beginning of the project or activities where there are 5 people and more people working appoint a full time dedicated Health and Safety resource whom will be dedicated to the project to ensure that Safety, Health and Environmental Requirements are met at all times. The allocated resource shall be based where the project is undertaken for the duration of the project or scope of work execution. The resource shall be trained and qualified on Occupational Health and Safety matters and the OHS Act provisions pertinent to the work that is to be carried out.
6.3 The Mandatary shall further ensure that all his / her employees are trained on the health and safety aspects relating to the work and that they understand the hazards associated with such work being carried out on the airports. Without derogating from the foregoing, the Mandatary shall, in particular, ensure that all his / her users or operators of any materials, machinery or equipment are properly trained in the use of such materials, machinery or equipment.
6.4 Notwithstanding the provisions of the above, the Mandatary shall ensure that he / she, his / her appointed responsible persons and his / her employees are at all times familiar with the provisions of the OHS Act, and that they comply with the provisions of the Act.
6.5 The Mandatary shall at all material times be responsible for all costs associated with the performance of its own obligations and compliance with the terms of this Agreement, unless otherwise expressly agreed by the Parties in writing.

5.3 Notwithstanding the provisions of the above, the Mandatary shall ensure that he, his appointed responsible persons and his employees are at all times familiar with the provisions of the OHS Act, and that they comply with the provisions of the Act.

The Mandatory shall further ensure that all his employees are trained on the health and safety aspects relating to the work and that they understand the hazards associated with such work being carried out on the premises. Without derogating from the foregoing, the Mandatory shall, in particular, ensure that all his users or operators of any materials, machinery or equipment are properly trained in the use of such materials, machinery or equipment. APPOINTMENTS AND TRAINING. 3.1 The Mandatary shall appoint competent persons to work on site. The Supervisor of the workers will be trained on any occupational health and safety matter, as well as the OHS Act and Regulations of the OHS Act provisions, relevant to the work to be performed under his responsibility.
3.2 The Mandatary shall ensure that all employees are trained on the health and safety aspects relating to the work and that they understand the hazards associated with such work being carried out on our premises. Without derogating from the foregoing, the Mandatary will in particular ensure that all users or operators of any materials, machinery or equipment are properly trained in the use of such materials, machinery or equipment.
3.3 The Mandatary shall ensure that all employees are at all times familiar with the provisions of the OHS Act and that they comply with the provisions of the Act.

1.1). Any such appointed person shall be trained on any occupational health and safety matter, and the OHS Act provisions pertinent to the work that is to be performed under their responsibility. Copies of all appointments made by the Mandatary must be made in writing and shall immediately be provided to the Client.
5.2. The Mandatary warrants that he has familiarized himself with the hazards associated with the work being carried out on the premises. The Mandatary shall further ensure that the Employees are trained on the health and safety aspects relating to the work and that they understand the hazards associated with such work being carried out on the Premises. Without derogating from the aforegoing, the Mandatary shall, in particular, ensure that all his users or operators of any materials, machinery or equipment are properly trained in the use of such materials, machinery or equipment.
5.3. Notwithstanding the provisions of the above, the Mandatary shall ensure that he, his appointed responsible persons and the Employees are at all times familiar with the provisions of the OHS Act, and that they comply with the provisions.
APPOINTMENTS AND TRAINING. 4.1 The Contractor shall appoint competent persons as per Section 16(2) of the OHS Act and in terms of such additional requirements as may be imposed by the Act or under the regulations promulgated thereunder. Any such appointed person shall be a competent person sufficiently experienced in the work to be performed and shall be trained on any occupational health and safety matter and the OHS Act provisions pertinent to the work that is to be performed under his responsibility. Copies of any appointments made by the Contractor shall immediately be provided to ArcelorMittal South Africa Ltd and shall clearly set out the qualifications and previous experience of such persons to be appointed.
4.2 In as much as the appointment of such persons does not relieve ArcelorMittal South Africa Ltd of its responsibility in terms of the OHS Act, the Contractor will, in addition to its own responsibility under such legislation, be required to carry out any instruction of ArcelorMittal South Africa Ltd.
4.3 The appointed persons shall not at the same time be in charge of any other work, unless the site on which such other work is to be performed is adjacent to the Site of the Contract Works and provided that prior written permission is obtained from ArcelorMittal South Africa Ltd and furthermore provided that all necessary permission in terms of the applicable legislation have been obtained.
4.4 The appointed persons shall also be responsible for the work, if any, to be carried out by any Sub-Contractors and the Contractor hereby indemnifies and hold harmless ArcelorMittal South Africa Ltd against any damaged that may accrue to any Sub- Contractor of the Contractor.
4.5 As soon as the Contractor becomes aware that its appointed person is likely to be absent from the Site for a period of more than 4 (four) days, the Contractor shall immediately notify ArcelorMittal South Africa Ltd and nominate a suitable person to act during such absence. If the period of absence exceeds or is expected to exceed 30 (thirty) days, the Contractor shall immediately take steps to nominate a person for appointment in the place of the principal appointee for the period of such absence and shall make the appointment letter of such substitute appointment available to ArcelorMittal South Africa Ltd.

APPOINTMENTS AND TRAINING. Prior to the Departure Date, STC will appoint a suitably qualified Trip Leader appropriate to the demands of the Trip who will lead the Trip. The School will, in good time prior to the Departure Date, appoint a Head Link Teacher and supporting Link Teacher(s) who will be briefed by STC as to the implementation of emergency procedures in the event of an accident or other incident affecting the Trip Leader. It is the responsibility of the School to ensure that: • relevant First Aid qualifications are held by the Head Link Teacher and/or supporting Link Teacher(s) and that those qualifications are valid until after the Trip returns. • the Head Link Teacher and supporting Link Teacher(s) all have enhanced DBS clearance for the duration of the Trip.
