Balconies and Patios. Balconies and Patios shall be kept neat and clean at all times and TENANT shall not store or hang rugs, towels, laundry, wash, or other such items on the railings or other portions of the balcony or patio. Bicycles, furniture, carts, and similar items should be kept in the rental dwelling or in storage, if available, and may not be kept on balconies or patios, or in or about entrance ways at any time. Any such items found in these areas may be removed by Management or maintenance staff. No dust, rubbish, litter, or anything else shall be swept, thrown, or emptied from any of the windows or balconies or patios or into the halls or entrance ways.

If the Premises has access to a patio or balcony, Tenant shall have a license to enter such area, subject to the following provisions: (i) Tenant’s access to such area shall be limited to the area immediately adjoining the Premises (and bounded by an extension of the demising lines of the Premises), and Landlord reserves the right to install materials separating Tenant’s area from the area adjoining other tenants’ premises, (ii) Tenant shall use such area only in a manner that is quiet and compatible with the nature of the Building as an office building, which only involves the use of benches or outdoor furniture approved by Landlord in writing, and which will not bother, disturb or annoy any other occupants of the Property, and (iii) Tenant’s use thereof shall be subject to the other provisions of this Lease, including the other Rules.

Balconies and patios shall be kept free of all personal belongings including, but not limited to, bicycles, furniture provided by Landlord, furniture designed for interior use, garbage, rubbish and bird, animal and insect feeders. Tenant may maintain lawn furniture thereon provided the same is maintained in a neat and orderly manner. Apartment furniture must remain inside the premises and may not be used outdoors. Storage of any items is prohibited. If items are found stored on balconies and patios, notification to Tenant will be made by Landlord. After receiving notification, if Tenant does not remove items from balconies and patios, each Tenant will be subjected to a $10 fine per day until items are removed.

Balconies and Patios. Balcony and patio areas (both front and rear) are to be kept clean and orderly. They are not to be used as storage areas and articles must not be hung over railings. No trash may be kept on balconies or patios at any time. Kegs are prohibited on the PROPERTY and within the UNIT and they are not to be permitted on balconies or patios. Additional lights are not permitted on balconies or patios. Only bona fide patio furniture may be kept on balconies or patios provided that only one-third of the balcony space may be covered by patio furniture. TENANT hereby acknowledges that all gas and charcoal barbecue grills, patio torches, fire pits and chimineas are strictly prohibited on balconies and patios. It is agreed that LANDLORD shall have the right to remove barbecue grills and any other of TENANT’S personal items or to remove and dispose of trash left on balconies and patios at TENANT’S sole expense. There will be a $100 fine for each bag of trash for small debris removed from a balcony or patio and $100 fine per large item that requires removal from a balcony or patio. TENANT further agrees that TENANT will be responsible for any property damage or bodily injury liabilities and responsibilities arising from any violation of this rule. LANDLORD reserves the right to remove and discard any items stored in the balcony or patio area that is not permitted. Balcony fines will be assessed to the entire UNIT unless it can be proven that the belongings in violation are the sole responsibility of one or more tenants occupying the UNIT. Notwithstanding anything provided in this RULES AND REGULATIONS or the LEASE, TENANT shall not place any item or permit any person on the balcony or patio area beyond the amount that is reasonably safe. Throwing objects from balconies, windows, sliding glass window/wall or any other area of the PROPERTY is strictly prohibited. TENANT understands that in the event ANY items are thrown from a UNIT balcony or window, TENANT will be subject to an immediate $1,000 fine and potential eviction and shall be subject to criminal prosecution. Items which may fall from a balcony are not allowed on the balcony and therefore any object which falls from a balcony will be treated the same as any that were thrown. Any investigation of alleged incidents will be reported to the applicable authorities. The balconies and/or patios, if any, adjacent to and accessible from the Premises shall be common areas and shall not be a part of the Rentable Area of the Premises; provided, however, that Tenant shall have a license (together with other tenants whose premises are adjacent to and accessible from such balconies and/or patios) to use any such balconies and/or patios in a manner consistent with a first-class office complex containing balconies and patios, on the terms and conditions set forth herein and subject to all limitations and restrictions on use of the Premises in this Lease. Tenant shall not make any improvements to the balconies. Tenant shall seek Landlord's advance written consent to all proposed furniture, fixtures, plants or other items of any kind whatsoever which Tenant desires to affix or to place on the balconies and/or patios. Landlord may withhold its consent to Tenant's proposed furniture, fixtures, plants or other items in Landlord's sole discretion, including without limitation, on wholly aesthetic grounds (e.g., as to size, color or design). Tenant shall not be permitted to display any graphics, signs or insignias or the like on the balconies or patios. Landlord shall have the right to make any improvements to the balconies and patios or display any graphics, plants or other items from the balconies and patios which it desires in its sole discretion in connection with overall Project graphics or improvements. Tenant shall clean, maintain and repair the balconies and/or patios in a manner consistent with the Premises. Tenant shall permit Landlord and its agents access to the balconies and/or patios at reasonable times for cleaning, general maintenance and plant maintenance. Tenant's license to use the balconies and/or patios shall be revocable, at Landlord's option, upon any event of default.
Balconies and Patios. Only residential exterior furniture, and plants in pots may be on the balconies and patios. The tenant is responsible for maintaining the balconies accessed through their units. Balconies, patios, and decks may never be used for storage of tools and equipment, trash, or any other items that are not patio seating, tables, and small potted plants that are healthy, alive and well maintained.
