Within 10 calendar days of the Board of Supervisorsaward of the Contract, CONTRACTOR shall submit to OWNER for its review: acceptable bonds; proof of insurance; initial job progress schedule; and any additional documentation required prior to execution of this Contract by the Contract Documents, Supplementary General Conditions or Special Provisions. If OWNER rejects the submitted documents, CONTRACTOR will have 5 additional calendar days to resubmit. If CONTRACTOR fails to submit documents within the required time(s), the Contract Time (as defined below) will be reduced by the number of days which exceed the time for submittal. The Contractor shall begin work within fifteen (15) calendar days after receiving notice that the contract has been executed and approved by the County. This work shall be diligently prosecuted to completion before the expiration of three hundred and sixty (360) WORKING DAYS beginning on the fifteenth calendar day after approval of the contract. The total number of days is for the both the construction season (approximately 180 days per each Stage of construction) Attention is directed to the provisions of Section 8-1.10, “Liquidated Damages,” of the Standard Specifications and these Special Provisions. The Contractor shall pay to Napa County the sum of $2,000.00 per day for each and every calendar day delay in finishing the work in excess of the number of working days prescribed above and any extension of time granted.

(See Drawings and Supplemental General Condition 7 for details). All phases of work must be scheduled during the summer period when affected schools are out, typically mid-June to the end of August. Contractor shall coordinate this work with Engineer and affected Cities of Xxxxx Xxxxx and Placentia 30 days in advance. If the Liquidated Damages exceed the unpaid balance of the Contract Price otherwise owed to Contractor, then Contractor shall immediately pay County the difference. Contractor also agrees to forfeit and pay to County the sum of $1,000 per day (“Liquidated Damages”) for each calendar day that completion of all the Imperial Highway adjacent Linear Park Area Improvements in the City of Brea between stations 10+00 and 16+00 if work exceeds 45 workdays in duration. The intent here is to complete the work expeditiously in an area the public uses regularly. Contractor shall coordinate this work with Engineer and affected City of Brea via encroachment permit at least 30 days in advance. If the Liquidated Damages exceed the unpaid balance of the Contract Price otherwise owed to Contractor, then Contractor shall immediately pay County the difference. Contractor also agrees to forfeit and pay to County the sum of $1,000 per day (“Liquidated Damages”) for each calendar day that completion of the El Cajon Trail Work Improvements in the City of Xxxxx Xxxxx between stations 9+00 and 11+00 if work exceeds 22 workdays in duration. The intent here is to complete the work expeditiously in an area the public uses regularly. Contractor shall coordinate this work with Engineer and affected City of Xxxxx Xxxxx via encroachment permit at least 30 days in advance. If the Liquidated Damages exceed the unpaid balance of the Contract Price otherwise owed to Contractor, then Contractor shall immediately pay County the difference.
