Weather Days. A. Weather days are excusable delays. When weather conditions at the site prevent work from proceeding, immediately notify the Owner’s Project Manager for confirmation of the conditions. At the end of each calendar month, submit to the Owner’s Project Manager a list of Weather Days occurring in that month along with documentation of the impact on critical activities. Based on confirmation by the Owner’s Project Manager, any time extension granted will be issued by Change Order. If the Contractor and Owner cannot agree on the time extension, the Owner may issue a Unilateral Change Order for fair and reasonable time extension.
Weather Days. Contractor shall submit a written request to the City Project (e-mail is the preferred method) for additional days for which work is suspended or delayed by weather. Weather days shall be reconciled with each monthly pay application for the time period which the application is submitted and shall be final. Contractor performance and execution of work shall be considered in the determination for granting additional days.
Weather Days. No additional time will be granted for weather days associated with this Contract. All Work must be completed by the specified Contract dates, including the dates for each phase and milestone. However, weather events that are exceptionally irregular are excluded. An exceptional weather event shall be defined as an event that prevents work on one (1) or more critical path activities within the baseline schedule for ten (10) or more consecutive planned workdays. The eleventh (11th) consecutive planned workday prevented from occurring by an exceptional irregular weather event shall be grounds for requesting a time extension.
Weather Days. Adverse Weather conditions are those wherein the weather satisfies all of the following conditions: (1) unusually severe precipitation, sleet, snow, hail, heat, or cold conditions in excess of the norm for the location and time of year it occurred, (2) unanticipated, and (3) at the Project. Delays due to Adverse Weather will only be permitted in compliance with any applicable provisions in the Agreement and only if the number of days of Adverse Weather exceeds the following parameters and Contractor can verify that the excess days of Adverse Weather caused delays: January 6 July 0 February 7 August 0 March 5 September 1 April 3 October 2 May 2 November 2 June 1 December 4
Weather Days. Management retains sole discretion to define what is considered a weather day/emergency. If the Executive Director and/or their designee determine there is a weather emergency, employees unable to work their scheduled shift may be eligible to receive payment for that shift with the approval of their Director of Residential Services. Employees will not be denied coverage in an arbitrary, capricious or discriminatory manner. An employee working during a weather emergency, they will receive time and one half for hours worked over sixteen (16) hours. A weather day is a day where schools or other community programs may close, outings may be cancelled, driving may not be safe and NCYF may consider grounding agency vans. A weather emergency is when the state governor declares a “state of emergency” that affects the geographic area that encompasses our group homes. In a weather emergency issued by the governor, the Executive Director and/or their designee will ultimately determine a weather emergency for the agency. If a state of emergency is called and confirmed by the Ex Dir all vehicles will be grounded and only used if Ex Dir states that the transport is an emergency and necessary. If a client has a scheduled home visit during a weather day or a weather emergency, NCYF agrees to contact DCF (Department of Children and Families) and/or guardian, to consider adjustments to the visit schedules.
Weather Days. The EMP proposal shall include in its assumptions and clarifications the number of "weather days" that are included as an allowance in the proposed schedule and Amendment No. 1 shall specify the agreed number of weather days. Weather impacts will only constitute Excusable Delays to the extent they exceed the allowance in Amendment No. 1 and otherwise meet the criteria for an Excusable Delay.
Weather Days. A. A “Weather Day” is defined as a normal work day during which the CONTRACTOR was unable to perform critical path work for a continuous period of more than four (4) hours during that day.
B. The CONTRACTOR shall be required to submit a record of rain delay in accordance with the contract documents and within 48 hours of the occurrence of the event to the ENGINEER and the OWNER for review.
C. Weather Days must be reported in the Progress Schedule Update Narrative Report and substantiated with the amount of rainfall obtained from the nearest CITY identified rain gauge and a description of the activity that was interrupted.

Weather Days. Section 15.1.5.2 is replaced to read: “The Project Schedule contemplates [twenty (20)] “Weather Days,” such that there shall be no Claim for a Construction Manager change in time based on weather delays unless and until all [20] days have occurred. Weather Days shall mean days in which contractors in the Denver Metropolitan area would not work as a result of adverse weather conditions as further described below. Construction Manager shall provide Owner with written notice no later than 24- hours after it has used a Weather Day, which notice shall include the number of hours and/or days of the delay. In the event that the number of actual Weather Days exceeds that set forth above, the parties shall promptly meet to discuss the effect, if any, on the Contract Time. Whether the weather causing them is considered normal or abnormal shall have no bearing on determining a weather delay day. The sole criteria for a weather delay will be that the weather made it impossible, impractical, or unsafe to perform the work on the critical path of construction, that the weather made it impossible for workers to get to the site, that the weather made it impossible for materials to be delivered to the site, or that the weather made it impossible for materials to be exported from the site. Weather days will be documented on a log and may be issued as a change order for both time and cost when they exceed the quantity set forth above. The current status of schedule, whether ahead of or behind schedule, shall have no bearing on whether a weather day is approved.”
