Board and University Documents. (a) The Board shall make available to the UFF with timely written or electronic copy of the following: (1) The minutes and agendas of the meetings of the Board and its subcommittees; (2) Board regulations published under the Regulation Development Procedure; and (3) Copies of the BOT/UFF Agreement and all supplements to the Agreement, consistent with the provisions of Section 28.5. The Board shall create an electronic report and shall provide an electronic report to the UFF which reflects the annual salary increases provided to employees. The cost associated with the UFF’s use of such file shall be borne by the UFF consistent with the costs charged others. (b) The University shall ensure that a dated copy of the following documents is made available in an easily accessible location in its main library or by links on the University Web site as soon as promulgated: (1) The minutes of the meetings of the Board; (2) Board Regulations and the University’s policies; and (3) The University’s operating budget, including the previous year’s expenditure analysis.

(1) The minutes of the meetings of the Council of Presidents; (2) The minutes of the meetings of the Board and its committees; (3) Board rules adopted and disseminated to University employees; and (4) The University's operating budget, including the previous year's expenditure analysis. (b) The Board will also provide the UFF with a computer account for purposes of accessing any State data file(s) reflecting the annual salary increases provided to faculty within the public universities in the State of Florida. Costs associated with the UFF's use of such files will be borne by the UFF consistent with the costs charged to other users accessing the data file(s).

(d) Upon a UFF-UCF request the University shall make the following documents available to the UFF, at no cost, no more than once per calendar year: (1) On or before March 1st, a report reflecting employee salaries for the then-current academic year. This report will include the following data elements in spreadsheet format: listing of employees with name, salary administrative plan annual rate, job code, job code title, college, department, date of hire, and complete work address. (2) Worksheet reports, on or before March 1st, where prepared, to reflect posted payroll changes. These worksheets would include the following data elements in spreadsheet format: employee name, job title, administrative title, liability department name, date of hire, prior rate of pay, new rate of pay, percent increase, type of increase (e.g., equity, market, merit, etc.), and FTE. (3) A report showing fall faculty and administrative and professional employment for the then-current academic year, on or before March 1st of that academic year (e.g., report for fall 2014 would be available on or before March 1, 2015). This report will include the following data elements in spreadsheet format: name, job code, employee class, home department number, liability department number, budget entity (E&G, C&G, Auxiliary), primary campus assignment, FTE, budgeted weeks, date of hire, highest degree earned, year of highest degree, faculty rank, tenure status, tenure date, annual salary, termination date. (4) On or before November 1st, one or more reports summarizing faculty activity for the prior acad...
Board and University Documents. (a) Upon request, the University Administration shall provide the UFF with an electronic or print copy of documents necessary to administer grievances and other provisions of this Agreement or otherwise carry out UFF’s obligations as the certified bargaining agent for the faculty. (b) No later than when they are made available to the participants, the University Administration shall provide the UFF with an electronic copy of the agenda and minutes of those policy meetings that may bear materially on the terms and conditions of employment of faculty members, including meetings (and subcommittee meetings) of the Board of Trustees. (c) The University Administration shall ensure that a copy of the following documents is made available by links on the University web site, or in an easily accessible location in its main library if the material cannot easily be made available on the website: (1) the minutes of the meetings of the Board and its committees; (2) Board rules published under the Administrative Procedure Act (The University Administration shall advise UFF when new rules are posted to the website. In the event any new rule or policy is made available at another location, the University Administration shall advise UFF of the place/website where it is available.); (3) the University’s operating budget and the previous year’s Expenditure Analysis; (4) this collective bargaining agreement and all supplements to the Agreement; and (5) a copy of any other University policies and procedures affecting faculty terms or conditions of employment.

(c) The Board shall ensure that a copy of the following documents is made available in an easily accessible location in its main library or by links on the university web site: (1) minutes of the meetings of the Board and its committees; (2) Board rules published under the Administrative Procedures Act; (3) the University’s operating budget and the previous year’s Expenditure Analysis; (4) the FAMU/UFF Agreement and all supplements to the Agreement; and (5) any other University policies and procedures affecting faculty terms or conditions of employment. (d) All copies of materials, and access to materials, shall be provided without cost.

  • Existing Management and Franchise Agreements Seller has furnished to Buyer true and complete copies of the Existing Management Agreement and the Existing Franchise Agreement, which constitutes the entire agreement of the parties thereto with respect to the subject matter thereof and which have not been amended or supplemented in any respect. There are no other management agreements, franchise agreements, license agreements or similar agreements for the operation or management of the Hotel or relating to the Brand, to which Seller is a party or which are binding upon the Property, except for the Existing Management Agreement and the Existing Franchise Agreement. The Improvements comply with, and the Hotel is being operated in accordance with, all requirements of such Existing Management Agreement and the Existing Franchise Agreement and all other requirements of the Existing Manager and the Franchisor, including all “brand standard” requirements of the Existing Manager and the Franchisor. The Existing Management Agreement and the Existing Franchise Agreement are in full force and effect, and shall remain in full force and effect until the termination of the Existing Management Agreement and the Existing Franchise Agreement at Closing, as provided in Article V hereof. No default has occurred and is continuing under the Existing Management Agreement or the Existing Franchise Agreement, and no circumstances exist which, with the giving of notice, the lapse of time or both, would constitute such a default.

No waiver, modification or amendment of any provision of this Agreement shall be valid or effective unless made in a writing referencing this Agreement and signed by a duly authorized officer of each Party.
