CANCELLATION OR SUSPENSION. The CLINICAL TRIAL may be cancelled or suspended by one of the PARTIES in any of the situations provided for in article 27 of RD 1090/2015, and also in the following cases: Due to breach of the essential obligations undertaken by one of the PARTIES. Due to breach or defective performance of the remaining obligations undertaken by another of the PARTIES, as long as such breach is not rectified within fifteen (15) days from when the other Party informs it of the breach in writing. By mutual agreement between the PARTIES, stated in writing.
CANCELLATION OR SUSPENSION. The STUDY may be cancelled or suspended by one of the PARTIES in the following cases: Due to breach of the essential obligations undertaken by one of the PARTIES. Due to breach or defective performance of the remaining obligations undertaken by another of the PARTIES, as long as such breach is not rectified within fifteen (15) days from when the other Party informs it of the breach in writing. CANCELLATION OR SUSPENSION. 3.1 The Contractor acknowledges that Gravity Media does not and cannot guarantee the number of work days or hours detailed in the Call Sheet. Gravity Media may at any time change, reduce, postpone or cancel work days without liability to the Contractor or Freelancer and in which event Gravity Media shall be under no obligation to pay the Contractor or Freelancer any sums (including the Job Role Rate, per diems or otherwise) in respect of any work days that are changed, reduced, postponed and/or cancelled.
3.2 If an Event is cancelled or the Services are no longer required by Gravity Media for any reason (Cancellation), Gravity Media may, at its absolute discretion, provide the Contractor:
(a) maximum of 8 hours payment (the precise amount to be determined at Gravity Media’s discretion) on a pro-rata basis at the Job Role Rate, if the Contractor is notified of the Cancellation less than 24 hours before the scheduled commencement of the Freelancer’s shift;
(b) any per diems or agreed travel costs, only if the Freelancer has commenced work at the Event.
3.3 Gravity Media will make no payment to a Contractor if more than 24 hours notice of the Cancellation is provided prior to the commencement time of a Freelancer’s shift outlined in the Call Sheet.
3.4 Gravity Media may require the Contractor to provide the Services on additional days (including as a result of rain delay and/or cancellation or postponement of the Event(s) for any reason and/or at a different Location) at the Job Role Rate if so required by Gravity Media at its absolute discretion. For the avoidance of any doubt, if the Event(s) are postponed, extended or there is any change to the dates of such Event(s) , Gravity Media shall not be under any obligation to use the Contractor in respect of any such postponed, re-arranged or extended Event(s).
3.5 Subject to Clause 3.2, the Job Role Rate and/or per diem shall not be payable in respect of any period during which Freelancer is unable to perform the Services for any reason including in respect of any period during which the Services are suspended pursuant to clause 10.
3.6 You acknowledge and accept that under the terms of an agreement or arrangement with a Client, the Client may have the right to require Gravity Media to remove the Freelancer from an Event and to cease providing the Services, in which case, the Contractor will not be entitled to any compensation under Clause 3.2 unless determined otherwise by Gravity Media in its absolute discreti...
CANCELLATION OR SUSPENSION. You or your administrator may cancel your right to use Online Banking or any feature of Online Banking at any time by notifying us of the cancellation. The cancellation will not take effect until we receive the notice and have a reasonable time to act on it. We may cancel or suspend your right or the right of your administrator or any additional user to use Online Banking, any feature of Online Banking or any means of accessing Online Banking (for example, a mobile banking device). The cancellation or suspension will take effect immediately unless we decide to have it take effect later. Despite the cancellation by you or your administrator of your right or the right of your administrator or any additional user to use Online Banking or any feature of Online Banking or the cancellation or suspension by us of your right or the right of your administrator or any authorized user to use Online Banking, any feature of Online Banking or any means of accessing Online Banking (for example, a mobile banking device), we may process any order given through Online Banking. The cancellation or suspension will not affect any of your obligations under this agreement. For example, you will remain liable under Sections 24 and 25 of this agreement.
CANCELLATION OR SUSPENSION. 13.1 Subject to section 47 of the Act, this mining right may be cancelled or suspended if the Holder:
13.1.1 Submits inaccurate, incorrect and or misleading information in connection with any matter required to be submitted under the Act;
13.1.2 Fails to honour or carry out any agreement, arrangement, or undertaking, including the undertaking made by the Holder in terms of the Broad Based Socio Economic Empowerment Charter and Social and Labour plan, on which the Minister relied for the conversion of this right;
13.1.3 Breaches any material term and condition of this mining right;
13.1.4 Conducts mining operations in contravention of the provisions of the Act;
13.1.5 Contravenes the requirement of the approved Environmental Management Programme; or
13.1.6 Contravenes any provisions of this Act in any other manner.
13.2 Before the Minister cancels or suspends this right, the Minister shall:
13.2.1 Give written notice to the Holder indicating the intention to suspend or cancel this right;
13.2.2 Give reason/s why the Minister is considering the suspension or cancellation of this right;
13.2.3 Give the Holder 30 days to show reasons why the right should not be suspended or cancelled;
13.2.4 Notify, the mortgagee [if any], of the intention to suspend or cancel this right; and
13.2.5 Direct the Holder, where it is possible to remedy any contravention, breach or failure, to comply or to take such specified measures to remedy any contravention, breach or failure to comply.
13.3 If the Holder does not take the measures as specified by the Minister to remedy a contravention, breach or failure, the Minister may cancel or suspend this right after considering representations made by the Holder in terms of clause 13.2.3.
CANCELLATION OR SUSPENSION. 19.1 We may cancel or change the date, timing or content of an Event at any time without notice.
19.2 If you fail to pay the Fees and any applicable tax on or before the Due Date, we may cancel or suspend your right to attend an Event. If that becomes necessary, you will not be entitled to any refund in respect of the Fees already paid.
CANCELLATION OR SUSPENSION. 5.1 Notwithstanding anything contained in this Agreement, the Organizer may at any time cancel or suspend the Exhibition if in the reasonable opinion of the Organizer the Exhibition is affected or is potentially affected by any Force Majeure Event or any other matter (including and without limitation to third party action) which may materially hinder, prevent or obstruct the Exhibition or the preparation thereof or it is undesirable or impracticable in the general safety and interest of the Exhibition or the attendees to the Exhibition to hold or continue the Exhibition but without incurring or owing any liabilities or obligations whatsoever to the Exhibitor save and except the refund of a part of the Contract Fees stipulated in Clause 5.3 hereunder.
5.2 If the Organizer decides to cancel or suspend the Exhibition, the Organizer shall give a notice in writing to the Exhibitor informing of its decision thereof and the ground of its decision made ("Cancellation/ Suspension Notification").
5.3 If the Exhibition needs to be cancelled by the Organizer due to Force Majeure Event, the Organizer shall make refund to the Exhibitor. The amount of the refund shall be calculated on the basis of the date of the Cancellation/ Suspension Notification (refers to as “Notification Date”): (a) if the Notification Date is 60 days or more before the opening date of the Exhibition, the refundable amount shall be 85% of the Contract Fees; (b) if the Notification Date is less than 60 days but 30 days or more before the opening date of the Exhibition, the refundable amount shall be 80% of the Contract Fees; (c) if the Notification Date is less than 30 days before the opening date of the Exhibition and before the first day of move-in period, the refundable amount shall be 75% of the Contract Fees. If the Notification Date falls on a Saturday, Sunday, or a public holiday in PRC or Hong Kong, the next good business day will apply instead. The refund shall be made by the Organizer within 45 days from the Notification Date. Save and except the refundable amount, the Exhibitor shall have no right to make any further claim whatsoever against the Organizer due to the cancellation, and the Organizer shall be fully discharged from all of its obligations in this Agreement. CANCELLATION OR SUSPENSION. In the event you wish to cancel Bill Pay, you may have the ability to do so in accordance with Part II, Paragraph P (“Cancellation and Suspension”) below. Any bill payment(s) we have already processed before the requested cancellation date will be completed. All Pending Payments including recurring payments will not be processed once the Bill Pay Service is cancelled.
