Compatibility Testing. (i) Prior to the release of each of the Licensee Products and for each Update, Upgrade and New Version of a respective PS Licensed Product that Licensee may embed into Licensee Products (each a “Test Product”), Licensee shall submit the Test Product at its expense to any of PalmSource’s approved independent compatibility testing labs or, at PalmSource’s sole option, to PalmSource (collectively, an “Approved Testing Lab”) for compatibility testing in accordance with the test criteria attached hereto as Exhibit B, as may be changed as set forth below (the “Test Criteria”). If the Approved Testing Lab rejects the Test Product because of a nonconformance with the Test Criteria, then such testing lab will provide Licensee and PalmSource a detailed written statement of the reasons for such rejection (“Statement of Errors”). Upon receipt of the Statement of Errors, Licensee shall use reasonable efforts to modify the Test Product to conform to the Test Criteria. Licensee shall then resubmit the Test Product to an Approved Testing Lab for further testing. Licensee and the Approved Testing Lab shall repeat the foregoing procedures as needed. Subject to Section 2.3(a)(ii) below, the parties acknowledge that the contents of the Test Criteria may need to be changed from time to time if new functionality is added to the PS Licensed Products. PalmSource shall use its reasonable discretion in determining new Test Criteria for such PS Licensed Products with such new functionality and will apply at least the same new Test Criteria to its internal customers and to Licensee and its other licensees of the respective version of PS Licensed Product, provided that PalmSource may change the Test Criteria in its sole discretion in response to Modifications by Licensee under Section 2.9 (Source Code), as set forth in Section 2.3(a)(iii) below. The Test Criteria for Licensee will not be changed to restrict separate and distinct industrial design features of Licensee Products which are independent of the PS Licensed Products. Compatibility Testing. Customer shall be responsible for running and passing the TCK tests as required by the Technology License, including Attachment E of the Sun Community Source License as applicable. Any product tested or used with the TCK cannot be deployed or distributed unless such product is subject to and in compliance with a valid Technology License permitting commercial redistribution.
Compatibility Testing. Compatibility Testing. Licensee shall be responsible for any compatibility testing of the Wireless Products required by CSPs, and further shall be responsible for the following: (i) quality assurance of the Wireless Products which is consistent with industry standards; and (ii) adequate operation and functionality of the Wireless Products on the Wireless Platform in connection with each Licensed CSP’s networks. To the extent that a material bug or defect is discovered in the Wireless Products which impacts in any manner the functionality of the Wireless Products, Licensee will promptly investigate and correct such bugs or defects, whether discovered by Licensee, Fox, the Wireless Platform manufacturer(s) or the CSP(s). Compatibility Testing. Licensee shall, and shall require in any agreement it enters into with Resellers, System Builders, or any other third party that such Resellers, System Builders, and any other third party shall, test and take other commercially reasonable measures to ensure the compatibility of the Software with Products and/or Computers and that Computers containing the Products function correctly (as applicable).
Compatibility Testing. FamilySearch agrees to make available to Company one or more software programs, documents, guides, pieces of sample code, and/or other tools of FamilySearch’s choosing (collectively, the “Compatibility Assessment Tools”) that are to be used by Company to review and test the Company App for compatibility with the FamilySearch Software. As of the Effective Date, the Compatibility Assessment Tools may be accessed by Company via the following URL (or any other URL, as determined by FamilySearch):
(a) It is intended that the Compatibility Assessment Tools will describe how various features of the Company App can interact with the FamilySearch Software using programmatic interfaces, XML standards, standardized interfaces, and/or other means. The Compatibility Assessment Tools may also define the specific features that the Company App may include, and the specific levels of compatibility that such features must achieve in order for a particular feature of the Company App to meet the requirements of the FamilySearch compatible web service affiliate program (the “FamilySearch Compatible Affiliate Program”).
(b) For all versions of the Company App developed by or before the Effective Date, Company will, within ten (10) calendar days of the Effective Date, provide FamilySearch with access to such versions of the Company App, allowing FamilySearch to conduct its own testing and potential classification of such versions of the Company App.
(c) A feature within the Company App that fulfills the requirements set forth in the Compatibility Assessment Tools, as determined by FamilySearch (in its sole discretion), will be referred to herein as a “Compatible Feature.” Upon finding that the Company App contains at least one Compatible Feature, Company will become a “FamilySearch Compatible Affiliate”, with all of the applicable rights and obligations of a FamilySearch Compatible Affiliate, as set forth in this Agreement.
(d) Company agrees that FamilySearch may, in its sole discretion, determine an applicable classification (e.g., as set forth, and as may be modified from time to time, at xxxxx://xxxxxxxxxxxx.xxx/developers/docs/certification, or another URL as determined by FamilySearch) for the Company App, any Compatible Feature, and/or any modification to the foregoing. This is often referred to as TR-905 Compatibility Testing. This certification testing shall be performed in accordance with the following ANSI documents:
a) T1.234 Telecommunications - Signaling System Number 7 (SS7) - MTP Levels 2 and 3 Compatibility Testing (ATIS);
b) T1.235 Telecommunications - Signaling System Number 7 (SS7) - SCCP Class 0 Compatibility Testing (ATIS); and
c) T1.236 Telecommunications - Signaling System Number 7 (SS7) - ISDN User Part Compatibility Testing (ATIS).
Compatibility Testing. Program Participant will work with the AHA Third Party Vendor (and/or Authorized Vendor) to confirm the mapping of the Data to be collected based on Program Registry specified inclusion criteria provided, and as amended from time to time, by AHA. For Programs requiring electronic data abstraction or data mapping, AHA and/or the AHA Third Party Vendor will provide specifications and information on Compatibility Testing.
Compatibility Testing. 3Com will finalize and provide to JD compatibility test criteria for ensuring interoperability of third party add-on software for the Palm OS and the JD Products ("Test Criteria") within ninety (90) days of the Effective Date. JD and 3Com will agree on a reasonable time period for compatibility testing of the JD Products by any of 3Com's independent testing labs ("Test Period") which shall be incorporated into the Test Criteria. When finalized, such Test Criteria shall be attached as Exhibit B (Test Criteria) to this Agreement. 3Com shall use its reasonable discretion in determining the contents of the Test Criteria; provided that, in the event JD does not approve of the Test Criteria, as its sole and exclusive remedy JD may terminate this Agreement immediately without liability within thirty (30) days of its first receipt of the Test Criteria from 3Com.
