Conditions of Payment. All services provided by the Contractor under Work Authorizations must be performed to the State’s satisfaction, as determined at the sole discretion of the State’s Authorized Representative and in accordance with all applicable federal, state, and local laws, ordinances, rules, and regulations including business registration requirements of the Office of the Secretary of State. The Contractor will not receive payment for work found by the State to be unsatisfactory or performed in violation of federal, state, or local law.
Conditions of Payment. Following the initial payment pursuant to Section 10.1, the UCRC shall make the final payment to the Contractor pursuant to Section 10.1 only upon determination by the UCRC that (i) the Contractor has fulfilled all of the requirements of this SCIA and (ii) the water that is the subject of this SCIA was legally or physically available for Contractor to consumptively use during the term of this SCIA. If the UCRC determines that the Contractor has not complied with any of the requirements of this SCIA and Exhibit A, Verification Plan, the UCRC has the option to holdback full or partial payment, at the UCRC’s sole discretion, until the Contractor has cured the non-compliance to the UCRC’s satisfaction. If the UCRC determines that the water that is subject to this SCIA was not legally or physically available during the term of this SCIA, the UCRC has the option to forego all or a portion of the final payment.
Conditions of Payment. All services provided by the Grantee under this grant agreement must be performed to the State’s satisfaction, as determined at the sole discretion of the State’s Authorized Representative and in accordance with all applicable federal, state, and local laws, ordinances, rules, and regulations. The Grantee will not receive payment for work found by the State to be unsatisfactory or performed in violation of federal, state, or local law.
Conditions of Payment. Alberta Innovates’ obligation to pay the Investment, or any portion or instalment thereof, is conditional on:
(a) the Applicant at all times being in compliance with the Investment Agreement;
(b) the Project progressing as set out in Article 4 - MILESTONE, REPORTING AND PAYMENT TIMELINES above;
(c) the Project being completed by the Project Completion Date;
(d) the Contribution to carry out and complete the Project remaining in place and being applied in accordance with Article 4 - MILESTONE, REPORTING AND PAYMENT TIMELINES;
(e) timely completion of all Reports as required.
Conditions of Payment. Benefits will be payable while the employee is disabled. An employee shall be considered to be disabled if he/she satisfies any one of the following conditions:
Conditions of Payment a. Payments under the Short Term and Long Term Disability Plans referred to in Sections 1 and 2 of this Article will not be made for:
1. Any disability occurring during the first 12 months that the employee's plan coverage is in effect if caused by any condition for which he/she received treatment during the three month period before his/her coverage became effective; or
2. Any period of incapacity beyond the third consecutive calendar day during which the employee is not under treatment by a licensed practicing physician; or
3. Any disability caused directly or indirectly by war declared or undeclared; or
4. Any intentionally self-inflicted injury; or
5. Any disability resulting from commission of a felony; or
6. Any disability due to willful misconduct, violation of plant rules, or refusal to use safety appliances.
b. Payments under these plans will be made only to employees whose absence is due to non- occupational or occupational disability and will not be paid to employees who are absent for other reasons.
c. Payments will only be made when the Company is provided, if it so requests, with a doctor's certificate, subject to confirmation by a doctor selected by the Company, as proof that the employee's absence was due to legitimate non-occupational or occupational illness or injury. Under normal circumstances, a doctor's certification will not be requested by the Company during the first three consecutive calendar days of the absence. However, certification may be requested by the Company for any or all of the first three days if the Company has reason to question the absence.
d. Payments will only be made when employees properly report their absence and the cause of their absence to the proper Company representative in a prompt manner.
e. Payments are applicable only for the normal workweek and normal workday. In case working hours of the plant are changed, it is understood that payment under the above schedule will be changed in direction proportion to the change in working hours.
f. It is recognized by the Union that the Company has a continuing interest in reducing absenteeism, no matter what the cause.
Conditions of Payment. The claim payment can only be made if you have duly complied with all the terms of this contract and have sent us all written evidence of the debt and the security possibly obtained and, if applicable, of the insolvency of the buyer.
Conditions of Payment. All services provided by CONTRACTOR pursuant to this contract shall be performed to the satisfaction of the STATE, as determined at the sole discretion of its authorized representative, and in accord with the CONTRACTOR'S duties set forth in Section I of this contract and all applicable federal, state, and local laws, ordinances, rules and regulations. CONTRACTOR shall not receive payment for work found by the STATE to be unsatisfactory, or performed in violation of federal, state or local law, ordinance, rule or regulation.
Conditions of Payment. 8.1. All work performed by the Providing Party under a work order contract must be performed to the Requesting Party’s satisfaction, as determined at the sole and reasonable discretion of the Requesting Party’s Authorized Representative and in accordance with all applicable federal and state laws, rules, and regulations. The Providing Party will not receive payment for work found by the Requesting Party to be unsatisfactory or performed in violation of federal or state law.
Conditions of Payment. All services provided by DHS pursuant to this Agreement shall be performed to the satisfaction of MNsure, as determined at the sole discretion of its Authorized Representative.
