Construction Completion Certificate. 14.1.1 Upon satisfactory completion of the construction works, the Concessionaire shall have to avail the Construction Completion Certificate for the Project from Maha-Metro, who is also the Special Planning Authority for the Project. No payment shall be made by the Maha-Metro to the Concessionaire towards the construction, operations and maintenance of the Project including any incidental charges as incurred by the Concessionaire for the Construction/ development of the Project.
14.1.2 The Concessionaire shall have to avail the Construction Completion Certificate and Occupancy certificate from Maha-Metro before commencing Commercial Operations.
14.1.3 Maha-Metro shall allow for Commercial Operations of the Project only after availing the Construction Completion Certificate for the project.
Construction Completion Certificate a. The construction work in this Concession Agreement shall not be considered to be completed until the Construction Completion Certificate has been signed by the Independent Engineer and delivered to the Authority and the Concessionaire, stating that the Concessionaire has completed its construction obligations under the Concession Agreement to the Independent Engineer's satisfaction.
Construction Completion Certificate. For purposes of this Section, the Municipality and the Developer agree that no Local Improvement shall be considered complete and a Construction Completion Certificate will not be issued unless and until:
Construction Completion Certificate. 12.01 Upon Completion of the Work, the Developer shall provide written notice to the Director, Calgary Approvals Coordination requesting joint inspection of the Work. The Developer shall submit to the Director, Calgary Approvals Coordination, for each of the CCC Items, four (4) original copies of the Construction Completion Certificates and four (4) copies of an 81/2 inch by 11 inch map indicating the area that the infrastructure has been completed, to the satisfaction of the Director, Calgary Approvals Coordination, duly signed and sealed by the Developer's Consulting Engineer. Where applicable the Developer shall attach to each copy of the Construction Completion Certificate a separate certificate duly signed, and sealed, by a registered Professional Engineer of Alberta who is licensed to practice in the Province of Alberta, certifying that all the backfilling operations carried out by the Developer have been carried out in accordance with the backfilling requirements as specified in Section 504.08.00 of The City of Calgary Standard Specifications for Calgary Waterworks Construction, and Sections 403.07.00 and 403.08.00 of The City of Calgary Standard Specifications for Sewer Construction, and shall attach copies of the soil moisture/density tests.
Construction Completion Certificate a. The construction and development work in this Concession Agreement shall not be considered to be completed until the Construction Completion Certificate has been signed by the Independent Engineer and delivered to the Authority and the Concessionaire, stating that the Concessionaire has completed its construction obligations under the Concession Agreement to the Independent Engineer's satisfaction.
b. The Construction Completion Certificate shall be given by the Independent Engineer within 28 (twenty-eight) days after:
(i) The Concessionaire has provided all the Construction Documents (including completion drawings) for the Works;
(ii) The Concessionaire has remedied any defects in the Works;
(iii) The Concessionaire has completed and tested all the Works, as specified by the Independent Engineer;
(iv) The Works as an integrated structure is in conformity with the Technical Requirements; and
(v) The Concessionaire has submitted “Structural Safety Certificate”.
c. The Independent Engineer would be required to issue the Construction Completion Certificate after the construction of the project has been completed in all respect and is ready to use. However, the required documents as stated in Article 14.1 (b) shall be submitted by the Concessionaire and also, comply with all the obligations, wherein mentioned in the Concession Agreement, required to be met before and after the issuance of the Construction Completion Certificate.
Construction Completion Certificate. Upon completion of all project related work items, the Contractor shall notify the Engineer in writing that the project is one hundred percent (100%) completed and request a Construction Completion Certificate for the project. Upon a satisfactory inspection of the Works, the Engineer shall prepare and forward a Construction Completion Certificate to the Owner and to the local approving agencies, for their acceptance of the project and signature on the noted Certificate. The project Maintenance Period will begin on the date of issuance of the Substantial Completion Certificate.

14.1.2 It shall be mandatory for the Concessionaire shall have to avail the Construction Completion Certificate and Occupancy Certificate from Maha-Metro before commencing Commercial Operations.
14.1.3 On receipt of intimation of completion of Construction Works, the work shall be inspected by the General Manager/ Town Planning, Maha-Metro. The work shall be inspected and verified in accordance with the Sanctioned Building Plan and the terms and conditions of the Concession Agreement. The Concessionaire shall have to carry out rectifications, if any, as may be directed by the General Manager/ Town Planning Maha-Metro.
Construction Completion Certificate. Construction Completion Certificate Upon satisfactory completion of the construction works, the Concessionaire shall have to avail the Construction Completion Certificate for the Project from Maha-Metro. No payment shall be made by the Maha-Metro to the Concessionaire towards the construction, operations and maintenance of the Project including any incidental charges as incurred by the Concessionaire for the Construction/ development of the Project. The Concessionaire shall have to avail the Construction Completion Certificate from Maha-Metro before commencing Commercial Operations. Maha-Metro shall allow for Commercial Operations of the Project only after availing the Construction Completion Certificate for the project. Withholding of Construction Completion Certificate
14.2.1 If Maha-Metro determines that the Project or any part thereof does not conform to the provisions of this Agreement and cannot be safely and reliably placed in commercial operation, it shall forthwith make a report in this behalf and send copies thereof to the Concessionaire. Upon receipt of such a report from the concerned Planning Authority/ Maha-Metro and after conducting its own inspection, if the concerned Planning Authority/ Maha-Metro is of the opinion that the Project is not fit and safe for commercial service, it shall, within 15 (fifteen) days of receiving the aforesaid report, notify the Concessionaire of the defects and deficiencies in the Project and withhold the issuance of the Construction Completion Certificate. Upon receipt of such notice, the Concessionaire shall remedy and rectify such defects or deficiencies. Such procedure shall be repeated as necessary until the defects or deficiencies are rectified.
Construction Completion Certificate. 9.1 Upon Completion of the Work, the Contractor shall provide written notice to the Director requesting Inspection of the Work.
9.2 The Director shall make an Inspection verifying Completion of the Work within four (4) months from the date of the receipt of the Inspection request.
9.3 If the Director determines there are defects or deficiencies in the Work, the Construction Completion Certificate will not be issued by the Director and a list of identified defects and deficiencies will be returned to the Contractor. The Contractor shall correct the said defects and deficiencies and any other defects or deficiencies, upon the Completion of which the Contractor shall request a further Inspection of the Work.
9.4 If an Inspection shows that the Work is Completed to the satisfaction of the Director, the Director will issue the Construction Completion Certificate.
Construction Completion Certificate. When the Work has been completed, such remaining inspections thereof as the Municipal Engineer shall consider appropriate shall be conducted and the Municipal Engineer shall make a recommendation to the City as to whether the Work is substantially complete and:
(a) following such report, provided that the Work of that service is substantially complete, the City shall issue a Construction Completion Certificate (the “Construction Completion Certificate”); and
(b) where the Work is found to not be substantially complete, the Municipal Engineer shall provide the Developer with a written list of such deficiencies pertaining to the Work to be corrected by the Developer along with a reasonable time frame or time frames for the rectification of such deficiencies. The Developer shall be bound to rectify such deficiencies in accordance with the time frames as may be reasonably stipulated by the City.
