CONTRACT VOLUMES. 2.1 The Authority guarantees to pay the Contractor a sum at least equal to the cost of [*] blood samples to be genotyped per annum for the first three years of the contract. 2.2 The Authority undertakes to give the Contractor as much notice as is practically possible of any significant variation expected in sample volumes to be sent to the Contractor. The Authority does not undertake to send all samples collected under the National Scrapie Plan for genotyping to the Contractor. 2.3. The Authority will provide the Contractor with a three (3) month rolling forecast of expected sample volumes. The Contractor will take all commercially reasonable steps to handle variations in sample volumes but failure to meet the Authority’s requirement for the reporting of results where the variation in sample volume is greater than [*] of the forecast will not be considered a breach of contract.
CONTRACT VOLUMES. Service Fees shall be paid for each Insured Service performed, under General or Neuroleptic Anaesthesia, in accordance with the Service Fees set forth in Schedule B of this Agreement. As per Section 3.5 of the Agreement, there is no guaranteed minimum contract volume or value. The maximum achievable Service Fees payable over the Term is $500,000.00 per Fiscal Year based on an approximate maximum of 1100 cases per year. The maximum possible volume of procedures which may be performed has been determined having regard to anticipated growth in demand within AHS during the Term of this Agreement. The maximum achievable amount payable is dependent on AHS’ available financial resources during the Term. In accordance with Section 3.5 of the Agreement, the Operator specifically acknowledges and agrees that AHS does not represent or warrant that the stated maximum Service Fees or volumes of procedures or any specified proportions thereof, will be realized or achieved by the Operator. Without limiting any other requirements of the Agreement, the Operator shall meet or exceed the following standards, policies, and guidelines: Association (CSA), the Canadian Anesthesiologists' Society (CAS), and the CPSA Standards and Guidelines for NHSF and AHS, pertaining to critical, semi-critical and non-critical medical devices, in each case to the extent applicable. Equipment is to be in good working order for all scheduled and emergency surgeries. Facility to notify NHSF Contract Manager if Equipment downtime will affect scheduled Client care. Body. Anesthesia and surgical Equipment maintenance standards as per manufacturer specifications and guidelines, subject to review and acceptance by AHS. The Operator shall ensure that the Services, Equipment and supplies comply in all respects with the IPC Standards, attached hereto as Schedule C, Appendix 1, as amended by the Minister from time to time. The Operator shall obtain copies of the IPC Standards listed in Schedule “C”, Appendix 1 from time to time during the Term from the Minister‟s website at: In each Facility where general anesthetics or sedation are administered, there must be one member who is currently certified in Advanced Cardiac Life Support (ACLS) present at all times.   • Contract Quantity The Contract Quantity during each Contract Year is the amount set forth in the applicable Contract Year in Section D of the Cover Sheet (“Delivery Term Contract Quantity Schedule”), which amount is inclusive of outages.

  • Volumes The Authority gives no guarantees of volumes. Any volumes mentioned in this Contract, are indicative only and shall not be binding on the Authority.

  • Delivery Points ‌ Project water made available to the Agency pursuant to Article 6 shall be delivered to the Agency by the State at the delivery structures established in accordance with Article 10.

  • CONTRACT VALUE The current total Not-To-Exceed (NTE) value of this contract is: 2.3.1.1 The Contractor exceeds the NTE amount at his/her own risk. The Contractor is under no obligation to provide additional services that would cause the Contractor’s fees to exceed the NTE amount without prior revision of this amount by written change order. Further, the Agency reserves the right to amend this amount (increase/decrease) at any time during the ensuing contract period(s) when the Agency determines doing so is in its best interests.

  • Delivery Point The delivery point is the point of delivery of the Power Product to the CAISO Controlled Grid (the “Delivery Point”). Seller shall provide and convey to Buyer the Power Product from the Generating Facility at the Delivery Point. Title to and risk of loss related to the Power Product transfer from Seller to Buyer at the Delivery Point.
