Contractor General Requirements. 2.1 Attend pre-construction meetings and site walk-through as requested by Purchaser. 2.2 Comply with the requirements of applicable local building code inspection(s) and local utility inspection(s), as defined by the authority having jurisdiction (AHJ) over the Site where the work is to be performed. 2.3 Comply with the requirements of the applicable version of the National Electrical Code (NEC) for all aspects of the electrical installation.‌ 2.4 Comply with OSHA requirements and recommendations, including but not limited to, non-roof penetrating visible safety barriers, fall protection, non-penetrating fall protection tie-off, hard hats, safety vests, eye protection and other PPE. Submit safety plan to Client prior to start of construction. 2.5 All work, within or around electrical equipment, shall include the appropriate PPE as defined by OSHA and EPC Contractor’s approved safety code.‌ 2.6 Comply with all applicable NFPA 70E, or applicable fire code, standards.

Contractor General Requirements. Contractor shall ensure that all insurances required contain the following provisions: 14.6.1 With the exception of workers’ compensation and errors and omissions/professional liability insurance, the Concessionaire and the Department shall be named as an additional insured on all policies. Each such policy shall also include the appropriate severability of interest and cross-liability clauses to allow one insured to bring claim against another insured party. 14.6.2 All insurance coverages shall be considered primary and non- contributory with regard to other insurances that might be available to Contractor or the Concessionaire. 14.6.3 All insurers shall waive rights of subrogation against the Concessionaire for any claims covered by insurance required herein. 14.6.4 Any inadvertent errors or omissions by Contractor in procuring the insurance required herein shall in no way prejudice the rights of the Concessionaire to collect under such policies. 14.6.5 Any deductibles shall be the sole responsibility of Contractor. 14.6.6 The insurance shall remain in full force and in effect and will remain in effect for the duration required by this Agreement; and 14.6.7 No insurance coverage will be canceled, renewal refused, or materially changed unless at least thirty (30) days prior written notice is given to Concessionaire. 14.6.8 With the exception of Workers’ Compensation and Automobile Insurance, the insurance policies shall specifically delete any design-build or similar exclusions that could compromise coverages because of the TTMS Work. 14.6.9 With the exception of errors and omissions/professional liability and builder’s risk insurance, Contractor shall require all Subcontractors to carry the same insurance required by Section 14.5 above, in the same amounts as outlined in Section 14.5 above. 14.6.10 Contractors shall file certificates of insurance with the Concessionaire evidencing the coverages and limits described above within the times required by this Agreement. The certificates shall be executed by approved insurance companies authorized to do business in Virginia with a minimum “Best Rating” of “A-VII” or greater, and shall cover this Agreement. 14.6.11 The insurance coverage limits shall not be construed to relieve Contractor or Subcontractor(s) of liability in excess of such coverage, nor shall it preclude the Concessionaire from taking such actions as are available to it under any other provision of this Agreement or otherwise in law.
Contractor General Requirements. Contractors shall be subject to the OSHA/VOSH provisions outlined in the Contractor Safety Standard which has been prepared for the protection and safety of WPCB employees, other Contractors, property, and anyone who may be affected by work being performed. Contractor work can potentially affect the safety of all employees and property, and for this reason the Contractor Safety Standard shall be provided to all Contractors working at the WPCB. Due to the wide variety of services that Contractors and construction companies could provide while working at the WPCB,, it is not feasible to outline every applicable law, standard and work practice in this document. Contractors bear sole responsibility for the safety of their employees. Contractors must take all steps necessary to establish, administer, and enforce health and safety rules and regulations that meet or exceed the regulatory requirements of VOSH (Virginia Occupational Safety and Health), OSHA (Occupational Safety and Health Administrator)), the DEQ ( The Virginia Department of Environmental Quality), Then Virginia Workers’ Compensation Commission, all Local, State and Federal lawas as well as applicable national consensus Safety and Environmental standards. Contractors are expected to take all steps necessary to establish, administer and enforce safetyh rules that meet or eceed the regulatory requirements listed above. Hazardous conditions or practices not outlined in a specific VOSH or PSHA standard may be covered under section 5(a) (1), 5(a) (2) i.e. the General Duty clause of the Occupational Safety and Health Act of 1970 which states that “Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are likely to cause death or serious physical harm to his employees.” Contrators bear sole responsibility for communication and safety-related information and requirements to sub- Contractors working under their direction. Contractors shall assure that their sub- Contractors comply with the requirements outlined herein.

  • CONTRACT WORK HOURS AND SAFETY STANDARDS As per the Contract Work Hours and Safety Standards Act (40 U.S.C. 3701-3708), where applicable, all Customer Purchase Orders in excess of ,000 that involve the employment of mechanics or laborers must include a provision for compliance with 40 U.S.C. 3702 and 3704, as supplemented by Department of Labor regulations (29 CFR Part 5). Under 40 U.S.C. 3702 of the Act, each contractor must be required to compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided that the worker is compensated at a rate of not less than one and a half times the basic rate of pay for all hours worked in excess of 40 hours in the work week. The requirements of 40 U.S.C. 3704 are applicable to construction work and provide that no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence.

  • Contract Work Hours and Safety Standards Act The following clauses apply to any Federal-aid construction contract in an amount in excess of $100,000 and subject to the overtime provisions of the Contract Work Hours and Safety Standards Act. These clauses shall be inserted in addition to the clauses required by 29 CFR 5.5(a) or 29 CFR 4.6. As used in this paragraph, the terms laborers and mechanics include watchmen and guards.
