Cooperative Procurement. To the maximum extent permitted by applicable law, we agree that this Agreement may be used as a cooperative procurement vehicle by eligible jurisdictions. We reserve the right to negotiate and customize the terms and conditions set forth herein, including but not limited to pricing, to the scope and circumstances of that cooperative procurement.
Cooperative Procurement. A. In circumstances where the Institution determines and documents that statewide contracts for goods and services, including information technology and telecommunications goods and services, do not provide goods and services to the Institution that meet its business goals and objectives, the Institution is authorized to participate in, sponsor, conduct, or administer a cooperative procurement arrangement on behalf of or in conjunction with public bodies, public or private health or educational institutions, other public or private organizations or entities, including public-private partnerships, charitable organizations, health care provider alliances, or purchasing organizations or entities, or with public agencies or institutions or group purchasing organizations of the several states, territories of the United States, or the District of Columbia, for the purpose of combining requirements to effect cost savings or reduce administrative expense in any acquisition of goods and services, other than professional services. The Institution may purchase from any authority, department, agency, institution, city, county, town, or other political subdivision of the Commonwealth's contract even if it did not participate in the request for proposal or invitation to bid, if the request for proposal or invitation to bid specified that the procurement was being conducted on behalf of other public bodies. In such instances, deviation from the procurement procedures set forth in these rules and the administrative policies and procedures established to implement these rules shall be permitted. Notwithstanding all of the provisions of this section above, use of cooperative contracts shall conform to the business requirements of the Commonwealth's electronic procurement system, including the requirement for payment of applicable fees. Nothing herein shall prohibit the payment by direct or indirect means of any administrative fee that will allow for participation in any such arrangement.
B. In circumstances where statewide contracts for goods and services, including information technology and telecommunications goods and services, do not provide goods and services to meet the Institution's business goals and objectives, and as authorized by the United States Congress and consistent with applicable federal regulations, and provided the terms of the contract permit such purchases:

BSA reserves the right to negotiate and customize the terms and conditions set forth herein, including but not limited to pricing, to the scope and circumstances fitting to that cooperative procurement.
Cooperative Procurement. This Agreement is entered into pursuant to City of Palm Desert Municipal Code section 3.30.160, which authorizes participation with other governmental agencies who have, through a bidding process, determined to award or purchase goods and/or services from Supplier.
Cooperative Procurement. Pursuant to ORS 279A.205 thru 279A.215, other public agencies within the State of Oregon may use the service agreement unless Contractor expressly notes that the prices quoted are available to the District only. The condition of such use by other agencies is that any such agency must make and pursue contact, purchase order, delivery arrangements, and all contractual remedies directly with the Contractor; the District accepts no responsibility for performance by either the Contractor or such other agency using this agreement. With such condition, the District consents to such use by any Exhibits A through [C or D] are attached.
Cooperative Procurement. This Agreement is intended to be a cooperative procurement under Virginia Code § 2.2-4304. However, the Police make no representations regarding whether the procurement of this Agreement satisfies the requirements of Virginia Code § 2.2-4304 or any other applicable law, regulation, or ordinance. The contractor and any other government entity that enter into any contract or agreement pursuant to this cooperative procurement acknowledge and understand that the Police shall not be involved in or responsible for the negotiation, administration, or any other aspect of that contract or agreement.
Cooperative Procurement. This agreement may be used as a cooperative procurement vehicle by any jurisdiction that is eligible. Licensor reserves the right to negotiate and customize the terms and conditions set forth herein, including but not limited to pricing, scope and circumstances of that cooperative procurement.
Cooperative Procurement. Where applicable, the joint powers of the public members of the OETC consortium acknowledge the right of other state and local government entities to utilize this contract as a cooperative procurement.
a. Authorized Agencies may utilize a Permissive Cooperative Contract pursuant to ORS 279A.215. Generally:
i. Authorized Agencies may establish a Contract with the Provider to purchase the Goods and Services awarded by this Solicitation;
ii. Authorized Agencies may not Materially Change or alter the terms, conditions, and prices from the original Contract between the Awardee and the OETC consortium.
b. Provider must state (on the Offer Cover enclosed) that it will/will not extend the terms, conditions, and prices to any Participating Agency that desires to establish a Contract awarded to the Provider resulting from this Solicitation. Volumes of other agencies are not included in this Solicitation.
Cooperative Procurement. As authorized in Section 2.2-4304 of the Code of Virginia, this procurement is being conducted on behalf of and may be used by public bodies, agencies, institutions, and localities of the several states, territories of the United States, and the District of Columbia with the consent of the Contractor.
Cooperative Procurement. As additional consideration for this User License Agreement, and pursuant to state and local laws and procurement rules, Permitium agrees to extend an option to purchase products or services covered under this contract at the same prices, and under the same terms and conditions, to other contracting agencies. Any such purchases shall be between Permitium and the participating agency and shall not impact Permitium’s obligations to the Customer under this User License Agreement. Each contracting agency shall execute its own contract with Permitium. Any estimated purchase volumes or user counts listed herein do not include other public agencies and the Customer makes no guarantee as to their participation.
