Data Use Restrictions. Client agrees that it will not, either directly or indirectly, itself or through any agent or third party, without the prior written consent of Experian, request, compile, store, maintain, resell or use the Services (including any of the information contained in the Services) to build its own credit reporting database. Client shall be solely responsible for assuring the secure and confidential manner in which it stores, delivers and transmits Services to its authorized employee users. Client shall, at a minimum, comply with Experian’s standard access security requirements.
Data Use Restrictions. 2.1. In accessing the Product provided via e-Markets Portal, You agree that You will not, without the prior written consent of the Company, sell, licence, sub-licence, distribute, lease, or otherwise transfer or allow the transfer of the Product, or any backup copy, to third parties, or use the product in any manner inconsistent with the rights granted by way of the aforesaid access. Where the Product is disseminated, or used in a manner that is prohibited, the Company reserves the right to deactivate the Authorised Representative(s)’ profile from the Data Portal, e-Markets Portal and if required, seek legal reliefs.
2.2. Access details to the Product is strictly on a per User basis and should not be shared or transferred by You, the Company reserves the right to take corrective measures as stated in Clause 2.1 above.
Data Use Restrictions. Participant shall: (i) access or use Data acquired through the Services solely for approved Use Cases, and; (ii) be responsible for obtaining all necessary consents and authorizations for its Authorized Users, its own use, and disclosure of Data in and through its Participant Solution and the Services. Participant is responsible for obtaining all necessary consents and authorizations for its own (including its Authorized Users’) use and disclosure of Data or PHI in and through its Participant Solution regardless of whether the Data was received through the Services or otherwise.

Data Use Restrictions. Use of the Licensed Dataset by the Data Users shall be governed by the following provisions:
A. The Licensed Dataset provided by NatureServe will be used by the Data Users for evaluating, refining, and implementing hazardous liquid pipeline integrity management plans as mandated by Congress, and described in the Notice of Proposed Rulemaking (NPRM) (71 FR 52504; September 6, 2006), or for any other activity that supports the protection of unique and important places along pipelines that are home to rare and imperiled species, and ecological systems.
B. In all cases where conservation, land-use, or management decisions are made using the Licensed Dataset, and there is the potential for local impacts to species and ecological systems, PHMSA will recommend that hazardous liquid pipeline operators consult with the relevant NatureServe network programs to ensure that they have access to any additional information and expertise. C. NatureServe grants to the Data Users during the term of this agreement a limited, nonexclusive, right of access to the Licensed Dataset. The dataset is non-transferable. The Data Users shall in all respects treat the dataset as the proprietary information of NatureServe and contributing network programs in accordance with all procedures reasonably necessary to protect their proprietary rights in the data and information. The Licensed Dataset may only be accessed by Data Users, as defined above.
D. Data Users may develop and share products derived from the Licensed Dataset such as maps, reports, analyses, and assessments, internally with other PHMSA employees and PHMSA contractors provided all such data, documents, reports, maps or other products (in paper, hardcopy, electronic, or any formats) are marked “Confidential and Proprietary -- For Internal Use Only” and “If access to this data is requested by any party other than PHMSA and hazardous liquid pipeline operators who have taken NatureServe’s Data Use Training, those parties should be directed to NatureServe at: XxxxxxxxxxxXxxxxxxx@xxxxxxxxxxx.xxx.” The only exception to these requirements is when such products display or describe species at geographic scales that are not sensitive as defined in section IV. D. below.
E. If Data Users develop products derived from the Licensed Dataset and want to share these products with external parties (i.e., parties who have not taken the Data Use Training, and ...
Data Use Restrictions. Absent KHC’s or a Purchaser’s (as applicable) prior written consent, KHC/Purchaser Data shall not be (i) monitored, analyzed, individualized, anonymized, aggregated, stored, copied or otherwise provided to third parties by Vendor, (ii) sold, assigned, or leased by Vendor, or (iii) commercially exploited in any form by or on behalf of Vendor. In the event of any actual or threatened breach of the security of KHC/Purchaser Data, Vendor will immediately notify KHC and the applicable Purchaser and fully cooperate with KHC and the applicable Purchaser to secure KHC/Purchaser Data. Vendor will not transfer KHC/Purchaser Data across a country border or to an offshore location unless Vendor obtains KHC’s or the applicable Purchaser’s prior written consent. KHC or a Purchaser, as applicable, shall retain exclusive ownership rights to all data transferred to Vendor as part of this Agreement and transfer of data shall not be interpreted as a transfer of ownership. Upon termination of this Agreement for cause or convenience Vendor agrees it will not use any KHC or Purchaser data for purposes other than as specifically directed by KHC or a particular Purchaser, or as otherwise required by law.
Data Use Restrictions. Maruzen acknowledges and agrees to the following:
a. The REMARC Bibliographic Database as provided by A-G to Maruzen pursuant to this Agreement is intended for and shall be re-licensed by Maruzen exclusively for use in its system and as a database re-seller within Japan. It is understood and acknowledged that Maruzen may act as an agent for NII (formerly NACSIS) in this capacity and within the framework of this Agreement.
b. Maruzen represents and warrants that it has no intention to use or permit the use by any person or entity of all or any portion of the REMARC Bibliographic Database to create, enhance, sell, market or otherwise promote an online bibliographic cataloging system outside of Japan.
c. In furtherance of such intended use, Maruzen hereby acknowledges and agrees not to provide or otherwise make available in whole or in part the REMARC Bibliographic Database to any library, library organization, commercial vendor or any other person or entity for sale, lease, distribution by such entity and/or other use as a cataloging resource, product, and/or service except as indicated above to such entities or their respective customers outside of Japan.
d. The DATA USE/RESTRICTIONS as defined in 15.a, b, and c, will be in effect during the term of this Agreement and shall survive the expiration and/or termination of this Agreement.
Data Use Restrictions. Customer will use the Ekata Data for identity verification and fraud detection and prevention use cases only, and will not: (a) use the Ekata Data for marketing purposes; (b) use the Ekata Data in violation of any applicable law, rule, or regulation or in violation of any third-party right; (c) store the Ekata Data for purposes other than You acknowledge that the Service is not provided by a “consumer reporting agency” as that term is defined in the Fair Credit Reporting Act (“FCRA”) and the Ekata Data do not constitute “consumer reports” as defined in the FCRA. Accordingly, the Ekata Data may not be used as a factor in determining eligibility for credit, insurance, employment or any other purpose in which a consumer report may be used under the FCRA (or any similar consumer credit law in the United States of America or otherwise).
Data Use Restrictions. Business Associate is prohibited from performing Data Aggregation services, or de-identifying (or reidentifying), selling, distributing, commercially exploiting, aggregating, data mining, analyzing, benchmarking or otherwise using or disclosing any PHI (including any anonymized, de-identified (or reidentified) or aggregated PHI) for any purpose except as required to provide the services to KP under the Business Relationship.

2. Although statewide data are available for internal use, Information Recipient should limit external reporting to information about its jurisdication, as applicable.
