Delivery Standards. The Offeror should deliver the products by the delivery date specified on any executed Attachment, Appendix, or Order referencing this Agreement. The Supplier should ensure Delivery Date standards are met no less than 97% of the time.

Delivery Standards. All financial statements and other documents to be delivered pursuant to this Agreement shall (i) be in form and substance acceptable to Required Lenders, (ii) be prepared in accordance with GAAP or the cash basis of accounting consistently applied, and (iii) be certified by a Responsible Officer of Borrower as being true, correct, complete and accurate in all material respects and fairly reflecting the results of operations and financial condition of Borrower for the relevant period.
Delivery Standards. Party A shall deliver the Premises as is on May 16, 2022 (the “Scheduled Delivery Date”), and neither Party A nor Party B has any objection on the delivery time and delivery status.

In addition, Borrower shall promptly pay to Lender an additional late charge of $500 per delinquent item for each full month during which such item remains undelivered following written notice from Lender. Borrower acknowledges that Lender will incur additional expenses as a result of any such late deliveries, which expenses would be impracticable to quantify, and that Borrower’s payments under this Section 3.31.8(b) are a reasonable estimate of such expenses. Borrower acknowledges further that the payment by Borrower of this late charge does not in any manner affect or otherwise impair or waive any rights and remedies Lender may have hereunder, under the Loan Documents or pursuant to any Legal Requirements for any Event of Default.
Delivery Standards. 5.1 ALL VEHICLES MUST MEET THE FOLLOWING CONDITIONS: a. Conform and be equipped to meet the requirements of the Vermont Department of Motor Vehicles. b. Meet California emissions standards c. Include manufacturers standard quantity of keys and fobs that normally are included with the vehicle. d. All necessary paperwork required to register vehicle. e. Be eligible to be registered in Vermont. f. Vendor is to provide order acknowledgement to “invoice to” address or an address determined by the ordering parties. g. Pricing for XM Satellite radio should be deducted from the bid price. h. OnStar (if standard with vehicle) may be included. i. All vehicles offered must be new; shall not be used, rebuilt, refurbished and shall not have been demonstration vehicles. Initial delivery of the vehicles shall not exceed 200 miles on the odometer without prior approval from the ordering entity. j. All products provided by the Contractor must meet all federal, state, and local standards for quality and safety requirements. k. All vehicle components, brake linings, clutch disks, etc. will be manufactured with asbestos free material. l. All equipment normally advertised as standard is to be included on the vehicles ordered unless superseded by the detailed specification. m. Vendor shall install a license plate bracket to the front of any purchased vehicle, so long as the option for a bracket exists. n. Be completely serviced by vendor including: i. Steering geometry. ii. Balancing of all wheels and tires. 5.2 Products not meeting the requirements of this section will be deemed unacceptable and returned to the Contractor for credit at no charge to the State.
Delivery Standards. Accuray will meet or exceed an on-time delivery requirement of ninety-five percent (95%). Following issuance of a Quote, Accuray shall notify AS&E in writing of significant risks to meeting Delivery Dates relating to such Quote as soon as reasonably practicable. Within 72 hours of providing such notification to AS&E, Accuray will develop plans to mitigate such delivery risk and minimize delay to the extent feasible and communicate such plans to AS&E. Accuray and AS&E agree to work together in the event of a significant risk to meeting Delivery Dates. Accuray shall be responsible for all costs Accuray /s/DJM and expenses it incurs to ensure delivery of Products within the Minimum Lead Time or by the Delivery Date indicated in the applicable Quote, provided that Accuray shall not be liable for any costs and expenses incurred as a result of AS&E’s delay or failure to perform its obligations hereunder.

Delivery Standards. Concessionaires and/or their vendors/contractors will be responsible for reporting any problems with the freight elevators and will work with the Airport to maintain safe and efficient elevators. All damaged or non-operable carts, etc. must be removed from the area immediately. • Weight loads must not exceed the maximum limits specified by the transporting equipment’s manufacturer. • Merchandise and products must be delivered to Concessionaire’s locations without interfering with public traffic in the Terminal. • Daytime deliveries are not authorized without prior approval of the Port. • Deliveries must not be transported on the passenger elevators, moving sidewalks, or the train system. In the event that train service is needed, the Concessionaire must coordinate the use of the train in advance with Aviation Maintenance at (000)000-0000. • The number of vehicles on the Airport ramp is limited during normal hours of operation by delivering the majority of products and merchandise during the night and early morning hours. Airport safety is our primary concern and every Concessionaire will cooperate with all Airport Rules & Regulations (which can be found at xxxx://xxx.xxxxxxxxxxx.xxx/Business/Airport- Tenants/Pages/default.aspx). • Concessionaires will ensure the restocking of the unit occurs during non- peak hours as specified in the Deliveyr Standards • The load dock supervisors will monitor all daytime activity. Parking is at a premium during the day, and coordination for extended use of parking spaces is vital.
