Determination of Layoffs. The University will determine the timing of layoffs, the number of Local 6070 Bargaining Unit Members to be laid off, and the seniority pool(s) in which layoffs will be affected. Layoffs will occur in the following order: 1. temporary employees in that pool, 2. probationary Local 6070 Bargaining Unit Members in that pool, 3. Local 6070 Bargaining Unit Members in that position and pool determined by seniority. The least senior Local 6070 Bargaining Unit Member in the seniority pool shall be the first laid off.

The County retains the right to determine the timing of layoffs, the number of employees to be laid off, the amount of time required to be laid off and in which seniority pool(s) layoffs will be affected as is consistent with the delineation of management rights set forth in Article 6 of this Agreement. b. Unless a layoff is imposed uniformly on each member of a seniority pool, the County shall lay off the employee(s) with the least amount of seniority within the affected seniority pool.

A uniform reduction in the number of hours scheduled in a workweek for all employees in a seniority pool shall not constitute a layoff. If the Company determines that one (1) or more employees in a seniority pool shall be laid off for ten (10) or more calendar days, the Company will lay off based upon the least qualified employees with lowest seniority in the seniority pool. An employee who is laid off may bump an employee with lower seniority if the laid off employee is immediately qualified, without training or break-in, for the position held by employee with lower seniority.
