Employee Waiver. An employee may voluntarily waive, in writing, entitlement to premium pay under any provision of this Article other than Section 5.3.1.
Employee Waiver. The Employee acknowledges and agrees that if the Agreement and the benefits described in the Agreement constitute an employee benefit plan or part of an employee benefit plan for purposes of Title I of the Employee Retirement Income Security Act, as amended ("ERISA"), (a) such plan is an unfunded plan, (b) the Employee belongs to a select group of management or highly compensated employees, and, therefore, (c) such plan is exempt from the participation, vesting, benefit accrual, joint and survivor and preretirement survivor annuity, minimum funding, fiduciary responsibility, and other requirements of Title I of ERISA. The Employee further agrees that, should the Agreement and the benefits described in the Agreement be construed as a funded plan or part of a funded plan for purposes of Title I of ERISA, the Employee irrevocably waives on behalf of himself and any spouse to whom he may now or in the future be married, any rights and claims the Employee or his spouse or both of them may have now or in the future under Title I of ERISA with respect to such plan. The Employee acknowledges that he has had sufficient opportunity to review this waiver with counsel.

DRAFT period at the discretion of the Employer; such cases are not grievable under the grievance procedure. A probationary employee is not entitled to seniority status until the probationary period has been completed, at which time the date of hire will become the employee’s seniority date.

Employee Waiver. An Employee has the right to have a NASA representative present during any investigation interview or disciplinary meeting. However, an Employee may waive his/her right to representation by signing the waiver form (see Appendix ‘G’). A copy of the signed waiver form shall be sent to and kept by Employee Relations. An Employee may repeal his/her waiver, in writing, at anytime during the discipline process.
Employee Waiver. Effective upon the closing of the contemplated IPO, Employee hereby waives the Employee’s Piggyback Right with respect to the IPO Piggyback Shares.
Employee Waiver. The Partner further expressly acknowledges and agrees that the closing of the Transactions (including, for the avoidance of doubt, the Pre-Closing Transactions and the Closing Transactions (including the Merger)) and any changes to the Partner’s title, authority, duties, responsibilities or reporting lines attributable to or otherwise related to the Transactions, shall not constitute, or be deemed to constitute, “Good Reason” under the Employment Letter (or for any other employment arrangement) or a breach of the Employment Letter. Alabama Co is party hereto solely with respect to this Section 2(i) and accordingly may enforce the terms and conditions of this Section 2(i). Schedule F sets forth certain employment terms that shall apply to the Partner from and after the Closing.
Employee Waiver. Xxxxxxx Xxxxxx hereby confirms that he has not been misclassified as a an independent contractor to the Company and that he does not have any pending claims for or right or entitlement to, and releases and discharges the Company and the Buyer and their respective officers, directors, managers, employees, agents and representatives from any and all claims for any treatment as an employee, including any and all claims for overtime wages and associated damages. Nothing in this provision waives any rights of Xxxxxxx Xxxxxx to accrued, but unpaid compensation owed to him for service during the month of July 2018 or to any rights to payment of an equity or equity compensation as provided to Sellers or Optionees under this Agreement. Furthermore, nothing in this release alters the at-will status of the relationship between Xxxxxxx Xxxxxx and the Company.
Employee Waiver. If I am receiving a University employee tuition waiver awarded by British American University, I understand that I am responsible for paying all charges not covered by my waiver. Payment is due by the due date stipulated on my monthly billing statement. Failure to make payment may result in a hold placement and late fee assessment.
