Equipment Modifications. 5.1 The Contractor is to advise the Authority when mandatory and other modifications are required for installation on equipment received under the SOR, and to include options within the menu prices for supply of kits and when Ministry supplied parts are used. Should the Contractor require the Authority to supply the modification kits from Bonded Stores then a formal request is to be passed to the Authority in support of each DEFFORM 300 or P2P order task.

Equipment Modifications. If, after the initial construction, installation or other work is completed, Licensee proposes to modify existing Equipment or install new equipment on the existing License Area, and such proposal is different in any material way from the specifications or design configurations shown in the Approved Plans, then Licensee shall first obtain the City’s prior written consent to modify this License to reflect the material difference, which the City shall approve or deny in accordance with the City’s small cell design standards and/or other applicable Laws. No modification to this License shall be required for any modification to existing Equipment that (a) involves only substituted internal components or replacements of like-kind equipment; (b) will be in compliance with applicable Laws (such as radio-frequency emission standards); (c) does not result in any change to the Equipment’s external appearance, dimensions or weight; and (d) does not cause any interference with any municipal functions or equipment. In any case, Licensee’s modification shall be performed in compliance with all applicable provisions in this License, which includes, without limitation Licensee’s obligation to obtain and pay for all Regulatory Approvals required for the proposed modification.
Equipment Modifications. If, after the initial construction, installation or other work is completed, Licensee proposes to modify existing Equipment or install new equipment on the existing License Area, then the following process and standards shall apply. (a) Routine Maintenance/Repair & “Like for Like” Replacement. Without the requirement of obtaining the City’s prior consent, Licensee shall have the right to (a) perform routine maintenance and repair of any Equipment installed on a Vertical Infrastructure approved for use by the City pursuant to this License, and (b) perform “like- for-like” replacements of Equipment so long as (i) any such “like-for-like” replacement does not alter the visible aesthetic appearance of the installed Equipment, and (ii) the resulting installation does not (A) result in an increase in the size of the License Area, (B) materially increase the weight, size or structural loading of Licensee’s Equipment or on the applicable Vertical Infrastructure beyond the loading or utilization, if any, that was established as of the Effective Date of this License or any subsequent City approval of Licensee’s Equipment for which City’s prior written consent was required, as the case may be; (c) does not change the status of Licensee’s compliance with radio frequency emission standards under applicable Laws and (d) and does not cause any interference with any municipal functions or equipment.
Equipment Modifications. OAI will give the Company at least 90 days’ prior notice of modifications to the Equipment that will likely result in incompatibility/ineffectiveness of the Products with respect to the Equipment. The Company shall not be in default hereunder if it is unable to conform the Products to such Equipment modifications.

Equipment Modifications. 3.7.1 The articles shall be modified to the latest Ministry approved Modification State at the time of repair, unless a different modification state is specifically called for on the Electronic Demand Order. The articles modification status shall be recorded on the Articles record plate. Any anomaly between the Authority requested Modification state and Contractor’s documentation is to be bought to the attention of the MES-ESG Project Manager. The Contractor shall notify the MES-ESG Project Manager when mandatory (due to change in statutory legislation or to maintain the safety of an article) and other modifications are required on any articles received under this enabling Contract. Options are to be included within the menu prices for supply of modification kits detailing if they incorporate any Authority supplied parts. Should the Contractor require the supply of Authority purchased modification kits held in the Bonded Stores then a formal request is to be passed to the Authority in support of each affected Electronic Demand Order.
Equipment Modifications. At its sole cost and expense, Lessee shall have the right to modify its Facilities on the Premises as described and depicted in Exhibit C-4, which is attached hereto and incorporated herein by this reference.

Equipment Modifications. Client agrees that it will not make any alterations, additions or improvements to the Equipment and may not disassemble the Equipment except to the extent necessary to replace consumables. In the event of any material modifications, Client will be responsible for all reasonable costs of PLAY in restoring the Equipment to its normal condition.
Equipment Modifications. OlyPen shall have the right to upgrade, modify and enhance OlyPen Equipment and Software from time to time through “downloads” from OlyPen’s network or otherwise. Without limiting the foregoing, OlyPen may, at any time, employ such means to limit or increase throughput available through OlyPen and/or its affiliates’ networks.
Equipment Modifications. Client shall notify and obtain prior written approval from Host before any material modifications, alterations, firmware adjustments, or other changes are made to any Client Equipment (the “Modified Equipment”) that is intended to or might reasonably be expected to cause the Client Equipment’s performance to deviate from the standard or factory specifications in a manner than could reasonably be expected to effect the continued function and safe operation of such Client Equipment and Host Facility. For any modifications made after the initial installation of Client Equipment, Host shall notify Client if Client must purchase from Host, or other third-party, additional equipment, accessories, software, or hardware, such as power cords to ensure the Modified Equipment is in compliance with the technical and fire safety codes and standards at a Host Facility. Host shall have the right to consent to any Modified Equipment necessary to ensure continued function and safe operation of the Client Equipment and the Host Facility which consent shall not be unreasonably withheld, delayed, or conditioned.
