Existing Infrastructure. To facilitate Operator’s use of existing horizontal or vertical infrastructure to deliver Services, Owner agrees to take all reasonable steps, including invoking of the “Inside Wiring Rules” (FCC regulations at 47 C.F.R. §§ 76.800, et seq.), to gain control of existing “Home Run Wiring” (as defined by FCC regulations) and to make such components available for Operator’s distribution of Services. Existing infrastructure can include conduit either inside or outside the Buildings that exists on either public or private property (including all telecommunication and utility accesses and easements).
Existing Infrastructure. (a) Land where Infrastructure that exists at the Effective Date has the effect of excluding or restricting public access, either by practically or by regulation, continuously or from time to time; including:
(i) land that is necessary for, or incidental to, the operation of the Infrastructure including all of a leased area where the Infrastructure is on leased land; and/or
(ii) land adjacent or proximate to Infrastructure that is covered by a modification or extension of that Infrastructure; and/or
(iii) land on which the Infrastructure has been demolished to enable the replacement or refurbishment for the same purpose; and
(iv) specifically:
(A) the entire road reservation area, and the road, where the road has been constructed;
(B) railways and tramways and their respective reservations;
(C) that part of a cemetery or crematorium reserve or other area of Public Land that is being utilised as a cemetery or crematorium;
(D) public recreation facilities that are for organised sporting activities; and
(E) Major Public Works.
(b) Item 2.1(a) does not apply to existing Minor Public Works.
(c) Item 2.1(a) ceases to apply to Infrastructure if:
(i) the Infrastructure is removed so as to permit safe public access to the former footprint of the Infrastructure; or
(ii) the land on which the Infrastructure is located is granted, sold or transferred in a fee simple estate; or
(iii) the Infrastructure consists of a road which is sought to be upgraded.
(d) In the case of item 2.1(c)(ii), item 2.1(a) ceases to apply immediately before the grant, sale or transfer.
Existing Infrastructure. Department of Science and technology, Government of Gujarat (GoG) was always at the fore front when we talk about the initiatives and key differential steps taken by the state governments throughout the country in the area of e‐Governance and e‐Services provided at the door step of the citizens. DST, GoG has implemented Gujarat State Wide Area Network (GSWAN) in the year 2001‐02. The erstwhile project currently under the third phase of upgradation while Gujarat State Data Centre (GSDC) commissioned in the year 2008 currently under the second phase of upgradation. DST, GoG has issued a work order for up gradation of entire IT Infrastructure created under the GSWAN with vision to provide internet services throughout the state to all the Government official working with the various Departments/Boards/Corporations/ PSUs etc. and to cater this multi fold requirement DST, GoG is also upgrading the bandwidth availability at each level by more than 10 times. Upgraded GSWAN is envisaged to be upgraded as next‐generation intelligent network that can deliver a wide variety of advanced, value‐added services. Integration components, including Layer 3 Network, Layer 2 Network, Traffic Engineering, Quality of Service (QoS) and IPv6 will enable creation of a highly efficient, scalable, and secure GSWAN that will be able to cater the desired Service Level Uptime and Availability
Existing Infrastructure. FCC regulations published at 47 C.F.R. §§ 76.800, et seq. (the “Inside Wiring Rules”) provide a legal procedure by which an MDU owner may gain ownership or control over cable Home Run Wiring and Cable Home Wiring owned by an incumbent multi-channel video programming distributor (“MVPD”) in order to make that wiring available for use by a competitor. In order to facilitate Dealer’s use of existing infrastructure for the provision of DIRECTV Services as set forth in this Agreement, Owner agrees to take commercially reasonable steps, including when appropriate use of the Inside Wiring Rules, to gain control over existing Home Run Wiring at the Property and to make that existing wiring available for Dealer’s use in distributing DIRECTV Services to Residents. Therefore, to the extent that an incumbent MVPD owns Home Run Wiring (as defined in 47 C.F.R. § 800(d)) located at the Property, and does not maintain a legally enforceable right to remain on the Property, or a legally enforceable right to maintain the Home Run Wiring dedicated to any particular Unit at the Property, the Owner will promptly deliver to the incumbent MVPD the proper notices described in 47 C.F.R. §§ 76.804(a) or 804(b), respectively, and take other appropriate and legally authorized actions to gain ownership or control over such Home Run Wiring, and to make the Home Run Wiring available for Dealer’s use in providing DIRECTV Services to Residents of the Property. Owner authorizes Dealer to send a letter to the incumbent MVPD on owner’s behalf regarding Dealer’S intended use of the Inside Wiring and, if Dealer does not send such a letter, Owner will promptly notify Dealer in writing that appropriate notices have been delivered to any incumbent MVPD, and in the event that Owner fails to provide such notice to Dealer within 10 days after the Effective Date, then Dealer: (1) has no obligation to install the Distribution System or provide the DIRECTV Service; and (2) may terminate this Agreement without liability.

Existing Infrastructure. Current Global Fund malaria activities implemented by Merlin target one division in each of Kisii, Gucha, and Nyamira districts. Xxxxxx’s operational track record in malaria and HIV PEPFAR activities will be utilized to ensure rapid project start-up and expand coverage in these districts.
Existing Infrastructure. The Lessee shall protect existing utilities and other infrastructure co- located within or adjacent to the Leasehold during Pipeline Activities. Any damages caused by the Lessee to existing improvements shall be promptly repaired by the Lessee to a condition which is reasonably satisfactory to the Commissioner.
Existing Infrastructure. Except as set out in Item 4.6, Agreement Land does not include any Public Land:
(a) on which Infrastructure exists as at the Effective Date; and
(b) the Infrastructure has the effect of excluding or restricting public access, either practically or by regulation, continuously or from time to time, including any land:
(i) on which a constructed road, railway or tramway is located;
(ii) utilised for a cemetery or crematorium;
(iii) on which public recreation facilities that are for organised sporting activities have been constructed; and any land:
(iv) that is necessary for, or incidental to, the operation of the Infrastructure;
(v) that is adjacent or proximate to Infrastructure that is covered by a modification or extension of that Infrastructure;
(vi) that comprises the leased area, where the Infrastructure is on leased land;
(vii) on which the Infrastructure has been demolished to enable the Infrastructure to be replaced or refurbished, and will be used for the same purpose; or
(viii) on which a Major Public Work is located.
Existing Infrastructure. The existing slurry pump motors are rated 355kW and gets its power supply from the 690V Ash Dam Pump Station Boards. The 690V Ash Dam Pump Station Boards are fed from the 11kV Ash Dam Pump Station Boards. The 11kV Ash Dam Pump Station Boards are fed from Overhead Lines (XXXx) 1 and 2. Any upgrade to these motors would require an assessment on the existing switchgear and XXXx. The new slurry pumps and its motors will be situated in the new DB Pump House. Power supply to these motors will be from the XXXx via switchgear. The XXXx and the upstream electrical infrastructure (11kV Station Boards 1-4, Unit Transformers A, etc.) needs to be assessed. The existing AWR booster pump motors are fed from the 3.3kV AWR Boards 1 and 2. Any upgrade to these motors will require the XXXx and the upstream electrical infrastructure (11kV Station Boards 1-4, Unit Transformers A, etc.) to be assessed. The existing OHL network is supplied from 11kV Station Board 3 and 4 through a series of links and sections. These lines are of a Mink ACSR type, rated at 260A. Any upgrade to the mechanical plant will require an assessment of these Overhead Lines. Inherently, any upgrade to the existing mechanical plant will require a load flow and a fault study to be conducted by the Contractor.
Existing Infrastructure. In the event the Tenant intends to use, disrupt or remove any buried infrastructure as described in schedule 2, the Tenant is responsible for communicating and/or negotiating with the owner of the relevant infrastructure for such proposed use, disruption or removal of the infrastructure.
