FOREIGN TOURING a) The Musicians’ Union shall be consulted over the terms of each foreign tour prior to final agreement. b) The Company shall comply with the Code of Practice for Foreign Touring in the planning and execution of foreign tours (refer to the Players’ Handbook). c) The Musician may ask to be released from his/her obligations to participate in a foreign tour by the Orchestra without financial loss, on grounds of conscience, domestic situation or health. d) The Company shall in good time before any foreign tour discuss the schedule with the Orchestra and consult them about the itinerary. e) Any necessary subsistence payments shall be negotiated within a reasonable time before the beginning of the tour to take account of exchange rates and costs. f) The Company shall ensure that the Musician’s position with regard to health insurance and other cover for death, disablement, medical expenses and treatment arising during or as a result of the tour is no less favourable than when the Musician is in the UK. g) The Company shall throughout the tour insure the Musician’s instruments at the value for which they are insured in the UK and shall also insure the Musician’s personal belongings up to an agreed limit. h) The Company shall consult the Orchestra about the type and method of travel.

FOREIGN TOURING. (A) Touring in the United States (B) Touring Outside Continental United States
FOREIGN TOURING. 5.1 Work outside the United Kingdom (“foreign touring”) shall be deemed to form part of the Musicians’ normal duties (as defined in clause 2.1 above). In exceptional circumstances, as agreed by the Trust, a request for the Musician to be released from his/her obligation to participate in an engagement by the Orchestra outside of the United Kingdom without the Musician suffering a deduction in salary will not be unreasonably refused. 5.2 A working party consisting of two members of the Orchestra Committee and the orchestra management shall be convened at the earliest opportunity to consider the terms and conditions of any proposed foreign tour. 5.3 At least six weeks prior to the commencement of a foreign tour, the Trust and the members of the Orchestra shall agree the tour schedule, the type and location of accommodation, the methods of travel, the subsistence payments and the main details of the itinerary, although subsequently the itinerary may be subject to minor amendment for legitimate logistical and operational reasons. The Musicians’ Union shall be consulted on the terms of each foreign tour at the time of agreement. 5.4 The Trust may require the Musician not to participate in a foreign tour without the musician suffering any deduction in salary. 5.5 The Trust shall ensure that the Musician has adequate insurance cover with regard to health and cover for death, disablement, medical expenses and treatment arising during or as a result of the tour is no less favourable than his/her position when in the UK. Nothing herein shall impose upon the Trust an obligation to meet the cost of any treatment that could have been foreseen by the Musician before the tour, nor any obligation to maintain or extend to overseas any private UK medical insurance that the Musician may have. The Musician shall inform the Trust of any pre-existing or recently diagnosed medical condition that could affect his/her ability to undertake the tour. 5.6 Prior to the commencement of any foreign tour, the Musician shall ensure that he/she is in possession of a valid passport and, where applicable, a valid UK Global Health Insurance Card. 5.7 The Trust shall, throughout the tour, insure the Musician’s instruments at the value for which they are insured in the UK and shall also insure his/her clothing and suitcase up to an agreed limit (ie. not cameras, jewellery or cash). 5.8 On the Orchestra’s standard schedule the Trust shall specify the number of hours of work which are allocated f...
FOREIGN TOURING. Arrangements regarding all aspects of foreign touring shall be subject to separate local agreement.
FOREIGN TOURING. (a) The Company will agree in advance substantive arrangements concerning schedule, itinerary, travel, accommodation and additional payments for engagements outside the United Kingdom. (b) The Company will provide comprehensive travel insurance for foreign touring. (c) Any Foreign touring agreement under clause (a) shall be binding on all Musicians. (d) The Company may call the Musician’s services for a basic week of 50 working hours in a week involving a tour of not less than 2 concerts outside the UK without additional payment. Touring involving a long haul flight with be subject to discussion. (e) The Musician is responsible for holding, and travelling with, a current valid passport. Arrangements for absence from the Company including Compassionate, Special Leave, time off for Dependants, Domestic Emergencies, Sabbaticals and Maternity, Paternity, Adoption, Parental Leave are detailed in the Employee Handbook. The Musician is entitled to request unpaid release for up to 7 days per calendar year (1 January to 31 December), subject to a deduction of salary at the individual day rate for the role or position. All musicians are required to give a minimum of 28 days’ notice of such requests and requests will be dealt with on a first come first served basis. This is detailed in the Unpaid Release Policy which is in the Employee Handbook.

  • Export/Import 14.1 The Works (including, without limitation, any Software) may be subject to the export or import laws and regulations of: 14.1.1 the United States, including without limitation the International Traffic in Arms Regulations (ITAR) (22 C.F.R. Parts 120-130), the U.S. Export Administration Regulations (15 C.F.R. Parts 730-774), and the economic and trade sanctions administered by the U.S. Department of Treasury Office of Foreign Assets Control; 14.1.2 the European Union and its member states, including without limitation Council Regulation (EC) No. 1334/2000; and 14.1.3 other countries (collectively, “Export/Import Law”). Buyer agrees to comply strictly with all Export/Import Laws applicable to the Works. Buyer shall promptly notify Supplier of any authorisation requirements under Export/Import Laws that may apply to delivery of the Works to Buyer site(s). Buyer acknowledges and agrees that the Works shall not be exported, re-exported, trans-shipped or otherwise transferred to Cuba, Iran, North Korea, Syria, Sudan, or any other countries for which the United States and/or the European Union maintains an embargo (collectively, "Embargoed Countries"), or a national or resident thereof, or to any person or entity on the U.S. Department of Treasury List of Specially Designated Nationals, the U.S. Department of Commerce Denied Parties or Entity List, or to any person on any comparable list maintained by the European Union or its member states (collectively, "Denied or Restricted Parties"). The lists of Embargoed Countries and Denied or Restricted Parties are subject to change without notice. Buyer represents and warrants that neither it nor any of their customers or their users is located in, a national or resident of, or under the control of an Embargoed Country or similarly Denied or Restricted Party. Buyer specifically shall obtain all required authorizations from the U.S. (or EU as applicable) Government before transferring or otherwise disclosing technical data or technology (as those terms are defined in 22 C.F.R. § 120.10 and 15 C.F.R. § 722, respectively), to any Foreign Person (as defined in 22 C.F.R. § 120.16). 14.2 Registration In accordance with 22 C.F.R. Part 122, any person who engages in the United States in the business of either manufacturing or exporting defense articles or furnishing defense services is required to register with the U.S. State Department’s Directorate of Defense Trade controls. Engaging in the business of manufacturing or exporting defense articles or furnishing defense services requires only one occasion of manufacturing or exporting a defense article or furnishing defense services. Manufacturers who do not engage in exporting must nevertheless register. 14.3 Acceptance of these terms and conditions certifies to the Supplier that the Buyer is in compliance with 22 C.F.R. Part 120 as required and the Buyer’s registration will remain valid during the terms of this agreement. 14.4 Further to acceptance, the Buyer further certifies it: 14.4.1 Understands its obligation to protect EAR or ITAR controlled Goods and Services as data as necessary from unauthorized disclosure or access to foreign person employees or visitors. 14.4.2 In the performance of the contract, the Buyer understands its obligation to determine whether it will require the use of third party subcontractors to access any technical data, Goods and Services. If required, the Buyer is responsible for identifying and licensing any activity that requires export authorization from the Department of Commerce, Bureau of Industry and Security or the Department of State, Directorate of Defense Trade Controls. 14.5 The Goods shall not be resold or exported to countries specified in the Country Guidance Chart which can be found at xxxx://xxx.xxxxxx.xxx/about-cobham/aerospace-and-security/about- us/useful-information.aspx without prior written approval of Supplier.

  • Traffic Control The Surveyor shall control traffic in and near surveying operations adequately to comply with provisions of the latest edition of the Texas Manual on Uniform Traffic Control Devices – Part VI which can be found on the State’s internet site. In the event field crew personnel must divert traffic or close traveled lanes, a Traffic Control Plan based upon principles outlined in the latest edition of the Texas Manual on Uniform Traffic Control Devices – Part VI shall be prepared by the Surveyor and approved by the State prior to commencement of field work. A copy of the approved plan shall be in the possession of field crew personnel on the job site at all times and shall be made available to the State’s personnel for inspection upon request.

  • Export Control This Agreement is made subject to any restrictions concerning the export of products or technical information from the United States or other countries that may be imposed on the Parties from time to time. Each Party agrees that it will not export, directly or indirectly, any technical information acquired from the other Party under this Agreement or any products using such technical information to a location or in a manner that at the time of export requires an export license or other governmental approval, without first obtaining the written consent to do so from the appropriate agency or other governmental entity in accordance with Applicable Law.

  • Human Trafficking Prohibition Under Section 2155.0061 of the Texas Government Code, Contractor certifies that the individual or business entity named in this Contract is not ineligible to receive this Contract and acknowledges that this Contract may be terminated and payment withheld if this certification is inaccurate.

  • Export 12.1 Export laws and regulations of the United States and any other relevant local export laws and regulations apply to the Services. Such export laws govern use of the Services (including technical data) and any Services deliverables provided under this Agreement, and You and we each agree to comply with all such export laws and regulations (including “deemed export” and “deemed re-export” regulations). You agree that no data, information, software programs and/or materials resulting from the Services (or direct product thereof) will be exported, directly or indirectly, in violation of these laws, or will be used for any purpose prohibited by these laws including, without limitation, nuclear, chemical, or biological weapons proliferation, or development of missile technology. 12.2 You acknowledge that the Services are designed with capabilities for You and Your Users to access the Services without regard to geographic location and to transfer or otherwise move Your Content between the Services and other locations such as User workstations. You are solely responsible for the authorization and management of User accounts across geographic locations, as well as export control and geographic transfer of Your Content.

  • Foreign Assets Control Regulations, Etc (a) Neither the Company nor any Controlled Entity (i) is a Blocked Person, (ii) has been notified that its name appears or may in the future appear on a State Sanctions List or (iii) is a target of sanctions that have been imposed by the United Nations or the European Union. (b) Neither the Company nor any Controlled Entity (i) has violated, been found in violation of, or been charged or convicted under, any applicable U.S. Economic Sanctions Laws, Anti-Money Laundering Laws or Anti-Corruption Laws or (ii) to the Company’s knowledge, is under investigation by any Governmental Authority for possible violation of any U.S. Economic Sanctions Laws, Anti-Money Laundering Laws or Anti-Corruption Laws. (c) No part of the proceeds from the sale of the Notes hereunder: (i) constitutes or will constitute funds obtained on behalf of any Blocked Person or will otherwise be used by the Company or any Controlled Entity, directly or indirectly, (A) in connection with any investment in, or any transactions or dealings with, any Blocked Person, (B) for any purpose that would cause any Purchaser to be in violation of any U.S. Economic Sanctions Laws or (C) otherwise in violation of any U.S. Economic Sanctions Laws; (ii) will be used, directly or indirectly, in violation of, or cause any Purchaser to be in violation of, any applicable Anti-Money Laundering Laws; or (iii) will be used, directly or indirectly, for the purpose of making any improper payments, including bribes, to any Governmental Official or commercial counterparty in order to obtain, retain or direct business or obtain any improper advantage, in each case which would be in violation of, or cause any Purchaser to be in violation of, any applicable Anti-Corruption Laws. (d) The Company has established procedures and controls which it reasonably believes are adequate (and otherwise comply with applicable law) to ensure that the Company and each Controlled Entity is and will continue to be in compliance with all applicable U.S. Economic Sanctions Laws, Anti-Money Laundering Laws and Anti-Corruption Laws.

  • Foreign Asset Control Regulations Neither of the advance of the Loans nor the use of the proceeds of any thereof will violate the Trading With the Enemy Act (50 U.S.C. § 1 et seq., as amended) (the “Trading With the Enemy Act”) or any of the foreign assets control regulations of the United States Treasury Department (31 CFR, Subtitle B, Chapter V, as amended) (the “Foreign Assets Control Regulations”) or any enabling legislation or executive order relating thereto (which for the avoidance of doubt shall include, but shall not be limited to (a) Executive Order 13224 of September 21, 2001 Blocking Property and Prohibiting Transactions With Persons Who Commit, Threaten to Commit, or Support Terrorism (66 Fed. Reg. 49079 (2001)) (the “Executive Order”) and (b) the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001 (Public Law 107-56)). Furthermore, none of the Borrowers or their Affiliates (a) is or will become a “blocked person” as described in the Executive Order, the Trading With the Enemy Act or the Foreign Assets Control Regulations or (b) engages or will engage in any dealings or transactions, or be otherwise associated, with any such “blocked person” or in any manner violative of any such order.
