Furnishing of Services and Information. 4.2.1 Prior to the issuance of the Notice to Proceed, at its own cost and expense, Owner shall provide the following items to Design-Builder for Design-Builder’s information and use and all of which Design-Builder is entitled to rely upon in performing the Work: (a) surveys describing the property, boundaries, topography and reference points for use during construction, including existing service and utility lines; (b) geotechnical studies describing subsurface conditions including soil borings, and other surveys describing other latent or concealed physical conditions at the Site; (c) temporary and permanent easements, zoning and other requirements and encumbrances affecting land use, or necessary to permit the proper design and construction of the Project and enable Design-Builder to perform the Work; (d) A legal description of the Site; (e) to the extent available, as-built and record drawings of any existing structures at the Site; and (f) all environmental studies, reports and impact statements describing the environmental conditions, including Hazardous Conditions, in existence at the Site that have been conducted or performed. 4.2.2 Owner shall provide to Design-Builder all Owner’s deliverables under Exhibit C pursuant to Owner’s Milestones. Such deliverables shall be provided, at Owner’s own cost and expense, for Design-Builder’s information and use. Design-Builder is entitled to rely upon such deliverables in performing the Work. 4.2.3 Owner is responsible for securing and executing all necessary agreements with adjacent land or property owners that are necessary to enable Design-Builder to perform the Work and that have been identified and notified in writing by Design-Builder to Owner prior to the Effective Date. Owner is further responsible for all costs, including attorneys’ fees, incurred in securing these necessary agreements.

Furnishing of Services and Information. 3.2.1 Department has provided RFP Information Documents in Part 2 of the RFP for Design- Builder to consider in developing the Proposal and for executing the Work. Design-Builder shall thoroughly review and compare all such documents during the Scope Validation Period and, to the extent that any Scope Issues arise, Department shall consider such issues in accordance with Section 2.2 above.

Furnishing of Services and Information. 4.2.1 Except as set forth in Schedule 4.2.1, as of the Effective Date, Owner has provided to Design-Builder, at its own cost and expense, for Design-Builder’s information and use, the following, all of which Design-Builder is entitled to rely upon in performing the Work: (a) surveys of the property performed by JEO Consulting Group Inc. dated December 12, 2005 describing the property, boundaries, topography and reference points for use during construction, including existing service and utility lines; (b) geotechnical studies performed by Terracon Consultants, Inc. dated September 2, 2005 (Terracon Project No. 05055094) describing subsurface conditions including soil borings, and other surveys describing other latent or concealed physical conditions at the Site; (c) temporary and permanent easements as described in the site survey, zoning and other requirements and encumbrances affecting land use or necessary to permit the proper design and construction of the Project and enable Design-Builder to perform the Work; (d) a legal description of the Site; (e) to the extent available, as-built and record drawings of any existing structures at the Site; (f) environmental studies, reports and impact statements describing the environmental conditions, including Hazardous Conditions, in existence at the Site performed by the Natural Resources Group, Inc. in the Phase I Environmental Assessment dated January 12, 2006; (g) Owner’s deliverables under Exhibit C; and (h) the permits listed on Exhibit G that are described as “obtained”. Owner shall provide Design-Builder all items listed on Schedule 4.2.1 no later than sixty (60) Days prior to the issuance of the Notice to Proceed, except for those items related to water treatment and fire protection requirements, which items shall be provided no later than ninety (90) Days after the issuance of the Notice to Proceed. 4.2.2 Owner is responsible for securing and executing all necessary agreements with adjacent land or property owners that are necessary to enable Design-Builder to perform the Work and that have been identified and notified in writing by Design-Builder to Owner prior to the Effective Date. Owner is further responsible for all costs, including attorneys’ fees, incurred in securing these necessary agreements.

Furnishing of Services and Information. 4.2.1 Prior to the issuance of the Notice to Proceed, at its own cost and expense, Owner shall provide the following items to Xxxxx for Xxxxx’x information and use and all of which Xxxxx is entitled to rely upon in performing the Work: (a) surveys describing the Site, boundaries, topography and reference points for use during construction, including existing service and utility lines; (b) geotechnical studies describing subsurface conditions including soil borings and other surveys describing other latent or concealed physical conditions at the Site; (c) temporary and permanent easements, zoning and other requirements and encumbrances affecting land use, or necessary to permit the proper design and construction of the Plant and enable Xxxxx to perform the Work; (d) legal descriptions of the Site; (e) to the extent available, as-built and record drawings of any existing structures at the Site; (f) all environmental studies, reports and impact statements describing the environmental conditions, including Hazardous Conditions, in existence at the Site that have been conducted or performed; (g) all standard operating procedures and permits necessary to construct the Plant; (h) all P&IDs, ISOS (Pipe Detail Drawings), ORTHOS (Pipe Layout and General Drawings), Mechanical (Including Plumbing & HVAC), Electrical Power Drawings (Including all instrument & motor loops), Electrical Control Drawings, Civil Drawings, Structural Drawings, Architectural Drawings, General Arrangement Drawings, and Equipment Arrangement Drawings in each case that are in Owner’s possession; (i) all Civil, Structural, Mechanical (equipment), and Electrical specifications in Owner’s possession; and (j) such other information as Xxxxx may reasonably request in order to perform the Work. 4.2.2 Owner shall provide to Xxxxx all Owner deliverables under Exhibit C pursuant to Owner’s Milestones. Such deliverables shall be provided, at Owner’s own cost and expense, for Xxxxx’x information and use. Xxxxx is entitled to rely upon such deliverables in performing the Work. 4.2.3 Owner is responsible for securing and executing all necessary agreements with adjacent land or property owners that are necessary to enable Xxxxx to perform the Work and that have been identified and notified in writing by Xxxxx to Owner prior to the Effective Date. Owner is further responsible for all costs, including attorneys’ fees, incurred in securing these necessary agreements.
Furnishing of Services and Information. 3.3.1 Unless expressly stated to the contrary in the Contract Documents, and to the extent Design-Builder has received such items from Owner, Design-Builder shall provide for Design-Build Subcontractor’s information the items listed below. Design-Builder does not warrant the accuracy or completeness of such items provided, however, that Design-Build Subcontractor is entitled to rely on these items to the same extent Design-Builder is entitled to rely upon such items in the Design-Build Agreement: SAMPLE 3.3.1.1 Surveys describing the property, boundaries, topography and reference points for use during construction, including existing service and utility lines; 3.3.1.2 Geotechnical studies describing subsurface conditions, and other surveys describing other latent or concealed physical conditions at the Site; 3.3.1.3 Temporary and permanent easements, zoning and other requirements and encumbrances affecting land use, or necessary to permit the proper construction of the Project and enable Design-Build Subcontractor to perform the Work; 3.3.1.4 A legal description of the Site; 3.3.1.5 Record drawings of any existing structures at the Site; 3.3.1.6 Environmental studies, reports and impact statements describing the environmental conditions, including Hazardous Conditions, in existence at the Site;
