General Functions. The Contractor shall operate a Member Services function during regular business hours, which must be accessible to Enrollees via a toll-free telephone line. Personnel must also be available via a toll-free telephone line (which can be the member services toll-free line or separate toll-free lines) not less than during regular business hours to address complaints and utilization review inquiries. In addition, the Contractor must have a telephone system capable of accepting, recording or providing instruction to incoming calls regarding complaints and utilization review during other than normal business hours and measures in place to ensure a response to those calls the next business day after the call was received. At a minimum, the Member Services Department must be staffed at a ratio of at least one (1) full time equivalent Member Service Representative for every 4,000 or fewer Enrollees. Member Services staff must be responsible for the following:
a) Explaining the Contractor's rules for obtaining services and assisting Enrollees in making appointments.
b) Assisting Enrollees to select or change Primary Care Providers.
c) Fielding and responding to Enrollee questions and complaints, and advising Enrollees of the prerogative to complain to the SDOH and LDSS at any time.
d) Clarifying information in the member handbook for Enrollees.
e) Advising Enrollees of the Contractor's complaint and appeals program, the utilization review process, and Enrollee's rights to a fair hearing or external review.
General Functions. 1.1 The Union acknowledges that it is the exclusive function of the Employer to:
a) maintain order, discipline and efficiency;
b) hire, discharge, transfer, promote, demote and discipline employees provided that a claim that an employee has been dealt with without reasonable cause may be the subject of a grievance as hereinafter provided;
c) generally manage and ensure the continuous operation of the public transit enterprise in which the Employer is engaged and without restricting the generality of the foregoing;
d) classify positions, development and implementation of policies and procedures and manage the affairs of the Employer so as to assure the most efficient and economic provisions of s ervice to the taxpayers and citizens of the City of Ottawa, providing such are not deemed in conflict with the collective agreement.
General Functions i. Coordinate departmental purchase and supply requests.
ii. Maintain an inventory of departmental materials including equipment and supplies as directed by the subject supervisor (inventory to be taken biannually maximum).
General Functions. To do anything which is calculated to facilitate, or is conducive or incidental to, any of its functions under this Agreement and to discharge such other functions as can be lawfully discharged in accordance with [Clause 7.1]41 of this Agreement.

General Functions. To attend all the meetings of the Executive Committee and report on the business of the Office of the Vice President (Internal);
General Functions. (a.) The Independent Consultant shall certify the occurrence of any such Force Majeure Event; however, the same would be subject to verification by the Authority.
(b.) Perform such functions as may be provided in the Agreement or authorized by Authority during the contract period from time to time.
(c.) To seek explanations from the Operator for delays or non-compliance with the quality control parameters;
(d.) To notify competent authority of delays and non-compliances and the explanations relating thereto for any remedial measures to be taken in this behalf. For the avoidance of doubt, unless otherwise specified in this Agreement or its Schedules, the Independent Consultant shall within a period of not more than 15 (Fifteen) days submit his comments / recommendations with the Authority as well as the Operator, on the submissions made by the Operator.

General Functions. The Sponsor agrees to perform the functions required of it by the terms hereof and of the Plan Documents. The Sponsor will use its best efforts to distribute Plans, maintain adequate office facilities and management staff, and keep current records. The Sponsor assumes full responsibility for the preparation, contents, and distribution of the current Plan prospectus and the current Fund prospectus, for complying with all applicable requirements of the 1933 Act, the 1940 Act, and any other applicable laws, rules and regulations of governmental authorities having jurisdiction. With respect to any duties for which the Custodian assumes primary responsibility but which it delegates to the Sponsor, the Sponsor covenants and agrees to take all action, and not to omit any action, necessary to carry out such duties, and agrees to furnish to the Custodian, upon request, evidence thereof satisfactory to the Custodian and its counsel. The Sponsor will use its best efforts to make shares of the Fund available for purchase by the Custodian at net asset value.
General Functions. (1)1.1 The Union acknowledges that it is the exclusive function of the City to:
1.1.1 maintain order, discipline and efficiency to make and enforce rules and regulations to be observed by employees.
1.1.2 hire, discharge, classify, transfer, promote, demote, discipline, layoff and recall employees subject to the seniority provisions of this agreement, and to terminate, suspend, demote or otherwise discipline employees for just and sufficient cause, subject to the right of the employee to grieve to the extent and manner provided for herein.
(1)1.2 Generally to manage and ensure the continuous operation of the public transit enterprise in which the City is engaged and, without restricting the generality of the foregoing, to determine the number of employees on the establishment, the arrangement of its transportation service and the location and type of equipment employed by it, the methods and techniques of work, the extension, limitation, curtailment or cessation of operations.
(1)1.3 It is understood by the Union that the express provisions of this agreement constitute the only limitation upon the employer’s rights.
