Provisions of Service. NP will provide those Services selected by Customer as set forth in the attached Addendums, Service, or Purchase Agreement. Services will be subject to specific terms and conditions set forth in this Agreement and the applicable Addendums, Service and/or Purchase Agreements.

Provisions of Service. The Service is provided on an “As Is” and “As Available” basis. Xxxx does not warrant that the Service will perform at any particular speed or provide any specific bandwidth or throughput, or that transactions through the Service will be uninterrupted, error-free or secure. Xxxx disclaims any and all warranties for the Service and any equipment provided in connection therewith (including any Antenna), whether express or implied, including any warranty of merchantability or fitness for a particular purpose, all of which are expressly excluded. In no event shall Xxxx be liable for any indirect, special, consequential or incidental damages, including damages for lost profits or revenues, or any damages for lost or damages files or data, or any damages attributable to the use or inability to use the Service or any information obtained thereby, even if Xxxx has been informed of the possibility or likelihood of such damages. Xxxx’x maximum liability in the aggregate to you for any and all claims, regardless of form or cause of action shall be limited in any and all events to Three Hundred ($300.00) Dollars. The limitations, exclusions, maximum liability provisions and disclaimers in this Section (Collectivity, the “Limitations”) apply to all claims by you irrespective of the cause of action underlying your claim, including warranty, breach of contract, product liability or product dissatisfaction or any form or tort, including allegations of Xxxx’x negligence or misrepresentation. You shall never assert claims against Xxxx if those claims are barred by the Limitations or the provisions of this Agreement and agree that any such claims shall be subject to immediate dismissal.
Provisions of Service. The Retailer shall provide prompt, efficient and courteous service at reasonable cost, and warranty service at no cost, to an owner or lessee of an Automobile, regardless of origin of purchase or lease, in accordance with the provisions of applicable Retailer Bulletins and shall perform such service in such a manner as to secure and maintain the goodwill of the Retailer, ZMC and the Products and to achieve the highest possible level of customer satisfaction.
Provisions of Service. 2.1. Beauvoir Group’s provision of the Services is conditional upon Beauvoir Group receiving: 2.1.1. sufficient funds from the Contracting Party or the Managed Entity to enable Beauvoir to provide the Services and to be remunerated for the provision of the Services as contemplated in these Standard Terms; and 2.1.2. such satisfactory professional, bank or other references, proof of Contracting Party identification and address, and evidence of the source of the funds or such other information as Beauvoir shall reasonably require to comply with the Law. 2.2. Beauvoir Group is in the business of providing support and services identical or similar to the Services to other Managed Entities. Beauvoir Group shall be at liberty to provide support and services of an identical or similar nature to the Services and any other services to any other person, firm, company or other body without being under any obligation to account for any profit arising thereby or to advise the Contracting Party that Beauvoir Group is providing such services. 2.3. Beauvoir Group may in its discretion accept either directly or indirectly (from the Contracting Party or any person nominated in writing by the Contracting Party) advice, recommendations and requests for action that it believes to be genuine, whether received orally or in written form (including electronically or by facsimile). Such advice, recommendations and requests for action shall be given to the Key Contact. If any such advice, recommendations or requests for action are given otherwise than in writing then as soon as is reasonably possible such communication shall be sent to the Key Contact in written form. 2.4. Where the Contracting Party is constituted by two or more persons then Beauvoir Group may accept instructions from any of the persons unless agreed otherwise in writing between the Parties
Provisions of Service. As a part of its service offering, WCRTC is responsible for providing all necessary provisions and/or repairs on WCRTC's side of the Network Interface Device. WCRTC is not responsible for any repairs on the customer side of the network interface device. While most troubleshooting and repair work will fall under our “Pledge” support program, service calls (outside of the scope of pledge) will incur a labor charge of $80/hr (one hour minimum billed, plus quarter hour increments) plus materials. Customer will be advised of said charges before work commences. Customer consents to the reasonable use of (and right of way to) their real property to construct, maintain, and repair telecommunications facilities at no cost to the Cooperative. When requested by the Cooperative, the member agrees to execute any easement or right-of-way contract on a form to be furnished by the Cooperative.
Provisions of Service. Both parties agree that providing comprehensive and universal preschool services to families is a high priority and that all families will be offered comprehensive services as outlined in the Head Start Performance Standards. Details are outlined in the Memorandum of Understanding between the parties (Note: Child Development Services/Head Start State Memorandum of Understanding in place). Furthermore, both parties agree to the Improving Head Start for School Readiness Act of 2007 as outlined in Attachment A. STAFFING PATTERNS: Both parties will insure that teachers/staff have the appropriate credentials as required by funding sources. The District will support HEAD START PROGRAM staff for the Department of Education (DOE) certification and renewal process. Staffing patterns for each location and weeks of child and family service are mutually agreed upon between the District and HEAD START PROGRAM. Coaching supports will be made available to all staff. VERIFICATION OF PERSONNEL INFORMATION REQUIRED BY THE HEAD START PERFORMANCE STANDARDS: In order to meet the requirements of the Head Start Performance Standards, and honor the confidentiality of District staff, the District agrees to complete the information in Attachment B on any staff, contractors, or individuals whose activities involve contact with and/or direct services to children and families or anyone who could have unsupervised access to children and families. Valid checks are required every 5 years. Signed forms can be mailed to the HEAD START PROGRAM C&FS Grants and Information Coordinator.
Provisions of Service. Billing 6.1 Normal service charges will be invoiced monthly. Payment is due upon receipt of the invoice, and accounts are in default if payment is not received within thirty (30) days after the invoice date. Accounts in default are subject to a $5 late charge and if disconnected due to nonpayment, a reconnect fee of $20 for each internet service will be assessed. 6.2 Accounts in default may have service interrupted. Service interruption does not relieve Customer of its obligation to pay charges. 6.3 Use of Kanokla’s network and services constitutes acceptance of the Terms and Conditions. Kanokla may modify these Terms and Conditions, including availability of services, upon notice furnished to Customer or published online.

Provisions of Service. Aloha has the legal right to determine if Customers are accepted for service provision or not. When a Customer applies for an Account or Service, Aloha has the right to check whether their application is genuine and meets any criteria that may apply to the Account or Service. Accounts with Aloha are, unless told otherwise, prepaid. In addition, on most occasions, a Customer will be able to manage their Account or Service with online. However, on occasions, online management facilities may be reduced, limited, removed, improved or similar.
Provisions of Service. 3.1. Prior to any Account or Service(s) establishment, Aloha reserves the right to inspect each sign-up, refuse and cancel an Account or Service on the basis of: 3.1.1. commercially not viable; or 3.1.2. suspected/confirmed fraud; or 3.1.3. crime prevention; or 3.1.4. technical or operational reasons; or 3.1.5. where in Xxxxx’s sole opinion to believe the Account or Service will not be used in accordance to this agreement or similar. 3.2. Xxxxx aims, but makes no guarantee to review a sign-up request within 5 working days. 3.3. Once Aloha has accepted a sign-up request, the Customer may order Service(s) for which the Brand says it provides (i.e Free03Numbers provides only 03 numbers, not SIP Trunking etc.). 3.4. Aloha reserves the right to withdraw, without notice, the ability for a Customer to order new Service(s). 3.5. Unless explicitly mentioned at the time of ordering a new Service, each Service is prepaid and comes with no minimum term and can be cancelled any time by contacting Aloha as long as the Customer Account is in a positive balance. To cancel a Service, the Customer will need to contact Aloha. 3.6. The Customer agrees to be responsible for all costs in establishing, making changes to or terminating Service(s). 3.7. Aloha does not guarantee that at all times the Customer will be able to order all Service(s) and should contact Xxxxx to request clarification. 3.8. Aloha reserves the right without notice to withdraw any features that may be available to the Customer in configuring their Service(s).
