Grading and Drainage. The Owner agrees to prepare a grading and a drainage plan acceptable to the Public Works Director and all surface and roof drainage shall be controlled in accordance with the approved plans in a manner satisfactory to the Town's Public Works Director.
Grading and Drainage. Buyer understands that the Property has been or will be graded by Builder to drain in accordance with an approved grading and drainage plan. Any future construction on the Property by Buyer (including pools, spas, fences, landscaping, etc.) can disrupt the drainage and cause flooding, excessive settlement and other problems. Builder is responsible for drainage of the Property as it is delivered at Closing in accordance with the grading and drainage plans. Any subsequent changes in grade or soil conditions and any damages or loss resulting therefrom shall be Buyer’s sole responsibility and Buyer hereby releases Builder, its agents and employees, from any and all liability and/or damages that may arise as a result of such changes.
Grading and Drainage. 8.14.1 The Developer shall complete the drainage works including all grading, ditches, swales, pipes, apparatus and equipment to service all the Lands within the Plan and adjacent thereto as required by and according to the Plans and Specifications approved by the Town.
8.14.2 The Developer shall maintain the complete drainage system, including clearing any blockage, until issuance of the Certificate of Maintenance and Final Acceptance is issued by the Town.
8.14.3 The Town may connect or authorize connections into the drainage system, and such connections will not constitute acceptance of the drainage system by the Town without issuance of the Certificate of Maintenance of Final Acceptance by the Town.
8.14.4 All Lots and all lands owned by the Developer abutting the Lands shall be graded to drain in accordance with the Plans and Specifications. Until the roads laid out according to the Plan have been expressly assumed by the Town as part of the Town road system, the Developer shall provide adequate drainage of the surface water from the Lands.
8.14.5 The Developer shall construct all Services in such a manner that no damage shall result by reason of the drainage therefrom or in connection therewith to persons other than the Developer or to property owner by persons other than the Developer. For the purposes of this clause, “persons other than the Developer” shall include successors in title to the Developer.
8.14.6 The Developer shall grant and convey or cause to be granted and conveyed any and all easements required for drainage purposes herein referred to or as may be required from time to time in the discretion of the Town Engineer. If Services are to be constructed to drain the Lands through lands other than the Lands, all such Services shall be designed in a sufficient size for the drainage requirements of an overall drainage area to be determined by the Town Engineer.
Grading and Drainage. Seller may construct the Home as will best conform, in Seller’s opinion, to the grade of the Lot or in accordance with the recommendation of Seller's engineers. Each lot within the Project is unique in its size, shape and drainage characteristics. Purchaser understands and agrees that the size of the Lot; the exact location of sidewalks and driveways (if any); and the drainage patterns of the Lot may differ from the plans, drawings or renderings Purchaser has examined, and Seller reserves the right to determine the location and configuration of the Home upon the Lot subject to subdivision requirements. The Lot is finished graded to comply with the general drainage requirements of the entire Project and Purchaser acknowledges that other property in the Project, including other lots, may drain onto the Lot.
Grading and Drainage. The Owner agrees that all surface and roof drainage shall be controlled in accordance with the Approved Site Plans. Maintenance of the Off-Site drainage works shall be at the sole cost of the Owner prior to the issuance of the Certificate Of Compliance.
Grading and Drainage. It is the Owner responsibility to:
(a) Not to permit the Land to drain otherwise than into a properly installed drainage system with proper catchbasins connected to a Municipality storm sewers or ditches and the grades and drainage facilities shall be so established as to provide roof water onto the internal system, to implement and maintain an on-site storm water management system to limit storm run-off from the site to a predevelopment rate of flow;
(b) To obtain approval from the Ministry of the Environment, the Nottawasaga Valley Conservation Authority and the Municipality with regard to stormwater management facilities;
(c) To implement and maintain an on-site storm water management system designed according to the policies and criteria of the Municipality.
(d) To implement and monitor on-site sediment and erosion control measures, during construction of this development, to the satisfaction of the Municipality and to allow the Municipality and its agents, in perpetuity, access to the Land to inspect roof drains, inlet control devices and storm water management facilities.
(e) To provide regular removal of snow from the site, or to provide sufficient snow storage areas on the Land, and that the parking spaces and landscaping areas will not be used for the stockpiling of snow.
Grading and Drainage. 9.01 Property Owners are responsible for ensuring that their Property is properly graded to allow for surface drainage. Any Improvement which creates an obstruction to surface drainage, or water flowing in its ordinary course is strictly prohibited.
9.02 In accordance with the recommendations made by P. Machibroda Engineering Ltd. in the Geotechnical Investigation and Slope Stability Assessment dated November 6, 2017, to ensure overall continued stability of the lakefront slope the following precautions are recommended:
i) Irrigation of lawns, trees, shrubs etc. should be kept to a minimum;
ii) Permanent sprinkler and/or irrigation systems are strictly prohibited;
iii) Drainage or discharge of water (i.e. roof downspouts, sump pump discharges, etc.) are not to be channeled over the slope and are to be directed towards the front of the Property, away from the slope;
iv) Run-off is to be directed toward the front of the Propertys;
v) Propertys shall be graded and/or landscaped to ensure there is no ponding or runoff of water over the slope;
vi) Existing drainage paths are not to be altered;
vii) Existing vegetation shall be disturbed as little as possible. Where vegetation is disturbed, erosion control and re-vegetation of the area is required to be implemented immediately;
viii) Construction activities (i.e. dumping of fill, construction of pathways, etc.) should not encroach on the existing slope;
ix) Site grading (i.e. fill placement) at the proposed house location should be kept to a minimum and should comply with the approved grading plan:
Grading and Drainage. 3.1 The Owner agrees to grade the lands in accordance with the gradients shown on the drawings identified on Schedule “B” and to provide at the Owner's cost, collection and disposal of storm, surface and waste water on and from the lands, in accordance with the drawings identified on Schedule “B”.
3.2 The Owner agrees that the grading of the lands shall be completed to the satisfaction of the Director of Municipal Engineering Services.
3.3 The Owner further agrees that all weeper tile drainage and roof drainage shall likewise be discharged into the drainage system to the satisfaction of the Director of Municipal Engineering Services.
3.4 The Owner agrees not to block or otherwise hinder drainage of surface and storm water from adjoining lands as same are presently constituted.
Grading and Drainage. 3.1 The Owner agrees to grade the lands in accordance with the gradients shown on the drawings identified on Schedule “B” and to provide at the Owner's cost, collection and disposal of storm, surface and waste water on and from the lands, in accordance with the drawings identified on Schedule “B”.
3.2 The Owner agrees that the grading of the lands shall be completed to the satisfaction of the Director of Municipal Engineering Services.
3.3 The Owner further agrees that all weeper tile drainage and roof drainage shall likewise be discharged into the drainage system to the satisfaction of the Director of Municipal Engineering Services.
3.4 The Owner agrees not to block or otherwise hinder drainage of surface and storm water from adjoining lands as same are presently constituted.
3.5 The Owner agrees contribute $750.00 in accordance with Schedule “D” for the purposes of meeting the recommendation of the West Gage Master Drainage Plan and shall be made payable to the Municipality of Port Hope prior to execution of the Site Plan Agreement.
Grading and Drainage. 1. Observation: Water is standing in the yard. Comments: The lot surrounding the home has been graded to direct water away from the foundation of the home. Drainage xxxxxx have been developed on the lot to direct water away from the lot. Often, the drainage swale also collects surface water from adjoining lots in the drainage plan. After a normal rain, it is not unusual for water to stand on the lot for 24 hours. It is acceptable for xxxxxx to hold water for 72 hours after a normal rainfall. It is normal for water to lie in the yard and in xxxxxx during a rainfall. It is the homeowner’s responsibility to maintain grass or other ground cover on the lot, including areas prone to erosion. Do not plant trees or shrubs in the xxxxxx. Do not fill in the xxxxxx. Standing water caused by obstructions placed in the drainage swale by the homeowner that alter the drainage pattern will not be corrected by the builder. The builder is not responsible for erosion. Erosion is considered as an act of nature and is beyond the builder’s control. Following extended periods of rainfall where the ground is saturated, no determination will be made until the ground has returned to its normal condition. Action Required: Riptide Builders, LLC. will correct standing water that lasts for more than 48 or 72 hours, as set forth above. No determination will be made in less than the 48 or 72 hour period. If designated wetlands are located on the property that area will remain untouched and natural.
