Grievance Procedures and Due Process. In the event the Resident is suspended or terminated for any reason, or for non-promotion of a resident to the next level of training or other actions that could significantly threaten a resident's intended career development or if any dispute arises concerning Resident's eligibility to receive a Certificate of Completion of Graduate Medical Education (hereinafter "Certificate"), the Resident may exercise any and all due process rights in accordance with the GMEC Resident Grievance Policy and Procedure established by the GMEC and the CONSORTIUM Administration. THE GMEC RESIDENT GRIEVANCE POLICY AND PROCEDURE MUST BE UTILIZED IF THE RESIDENT WISHES TO CHALLENGE THE DECISION REGARDING SUSPENSION, TERMINATION OR ELIGIBILITY TO RECEIVE THE CERTIFICATE, AND IS A PRE-CONDITION TO SEEKING JUDICIAL RELIEF. The GMEC Resident Grievance Policy and Procedure GMEC-20 is available on the LLUH One Portal. Additional copies may be obtained from the GME Office.

Grievance Procedures and Due Process. The Hospital shall ensure the fair and reasonable adjudication of Resident complaints and grievances related to the Resident’s work environment or issues related to the program or faculty. Detailed information regarding Grievance Procedures and Due Process is set forth in the CIR Contract and in the Graduate Medical Education Institutional Policies and Procedures.
Grievance Procedures and Due Process. Notwithstanding the foregoing, Medical Center shall not terminate this Agreement without first providing the Resident with written notice and an opportunity to discuss with the applicable Program Director and the Designated Institutional Official or other designee, any differences, grievance or dissatisfactions which may exist. If this Agreement is terminated in accordance with this Section XIII prior to its expiration date, or if Medical Center provides the Resident with a notice of non-renewal, the Resident shall be accorded due process as specified in Section XII (2).
Grievance Procedures and Due Process. NCH is committed to an educational environment in which residents may raise and resolve issues without fear of retaliation or intimidation. To this end, Residents are provided full protection against unfair treatment through a formal grievance procedure. Specific directions for filing a grievance are found in the Housestaff Manual and NCH Employee Handbook. Residents are advised that defined time intervals apply to most grievances and delay beyond these prescribed times may exclude the possibility of filing a grievance. NCH has established a grievance procedure for addressing residents’ concerns as is described in Housestaff Manual and Employee Handbook. The following three academic disciplinary actions are eligible for grievance/appeal as per the process delineated in the Academic and Grievance Policy found in the Housestaff Manual: (i) Extension of Training Period, (ii) Non-renewal of Contract, and (iii) Termination. The Academic Discipline Status of “Review”, “Warning”, and “probation” are not eligible for Grievance and Appeal Process.

Academic or other disciplinary actions taken against the Resident that could result in dismissal, non-renewal of the Resident’s agreement, non-promotion of the resident to the next level of training, or other actions that could significantly threaten a Resident’s intended career development must be addressed per Procedure GME 10. The Resident may adjudicate complaints related to non-adverse academic actions, related to the work environment, or issues related to the program faculty through Procedure GME11 (Nonacademic Grievance) or Policy HR09 (Employee Dispute Resolution Program) or both.

Grievance Procedures and Due Process. It is expected that RESIDENT who qualifies for a residency training program is able to progress satisfactorily through the program. However, when performance and/or progress is/are not satisfactory, actions of an adverse or disciplinary nature can be taken by the program. These actions, in addition to those previously identified in this AGREEMENT, include observation, probation, suspension, and dismissal. Each of these actions, as well as the policy and procedure that should be followed to grieve any adverse action, is described in detail in the Graduate Medical Education Institutional Handbook of Policies and Procedures. This Residency Training Agreement incorporates within it applicable St. Odrias Policies and Procedures (available upon request), and St. Odrias Housestaff Policies and Procedures (available upon request), including the Employee Assistance Program (which programs include counseling, employee assistance of house officers and family members, and substance abuse treatment assistance and/or diversion).
