Leave Share Policy. The leave share program allows employees to donate sick leave to an employee who suffers from, or has relatives or household members suffering from, any extraordinary or severe illness, injury, impairment, or physical or mental condition which prevents the individual from working. Leave sharing may also be used for pregnancy, child-bonding, adoption, or for a newly placed xxxxxx child. An employee is eligible to receive donated leave if: 1. The employee suffers from, or has a relative or household member suffering from, an extraordinary or severe illness, injury, impairment, or physical or mental condition which has caused, or is likely to cause, the employee to: a. Go on leave - without pay status; or b. Terminate their employment. 2. The employee’s absence and the use of shared leave are justified. 3. The employee has depleted, or will shortly deplete, their sick leave reserves. 4. The employee has abided by the rules regarding sick leave use. 5. The employee is ineligible to receive Workers’ Compensation benefits. 6. The employee has provided the District from a licensed physician or health practitioner, documentation of the severe or extraordinary nature of the condition and the expected duration of absence due to the condition. 7. The employee has requested donated leave in writing. 8. An employee may receive a maximum number of sick leave shared days equal to the length of the employee’s work year. An employee may donate leave as follows: 1. The employee who has an accrued sick leave balance of more than twenty- two (22) days may request that Payroll transfer a specified amount of sick leave to another employee authorized to receive such leave. 2. The employee may not request a transfer that would result in an accrued sick leave balance of fewer than twenty-two (22) days. General Conditions to Donate Leave: 1. All donated shared leave must be given voluntarily. An employee shall not be coerced, threatened, intimidated or financially induced into donating share leave. 2. The number of leave days transferred shall not exceed the amount authorized by the donating employee. Leave Transference Process: 1. The value of sick leave transferred shall be based upon the leave value of the employee receiving the leave. That is, one (1) day donated may be more or less than one (1) day of value to the recipient. 2. Payroll Office in the order received.   • Leave Sharing The SPS agrees to maintain a leave sharing plan that conforms to law. Shared leave will be used only for the purpose of maintaining salary and insurance benefits. The length of time a position is held for the employee’s return will not be extended by the use of shared leave.

  • Sick Leave Buyback The Board agrees to buy sick leave days back from those teachers who have more than one hundred (100) accumulated sick leave days at the end of a school year. The value of each unused day will be determined based on the formula in Section A above. The total amount calculated will be deposited into the teacher’s Section 401(a) account. If a teacher has in excess of 6 personal days, the days will be transferred to the total sick day accumulation for this calculation. The number of days will be figured using the above chart in this section.

  • Sick Leave Sharing The Board shall administer a sick leave sharing program accessible to teachers who exhaust or will likely exhaust all their accumulated leave, and have used statutory additional sick leave (20 days) less the cost of the substitute.   • Leave Time During the Employment Period, Employee shall be entitled to paid vacation and leave days each calendar year in accordance with the leave policies established by Employer from time to time. Any leave time not used during each fiscal year of Employer may be carried over into the next year to the extent permitted by Employer policy.

  • Sick Leave Buy Back To encourage and reward employees who maintain good job attendance, the parties agree to the following incentive award: Employees who utilize two (2) sick leave days or less each assigned school calendar year and year-round employees who utilize three (3) sick leave days or less during each assigned school calendar year - upon request – shall receive payment for up to eight (8) days of sick leave, provided the employee worked the full assigned calendar year.* The following procedures apply to the payment of sick leave under this section.

  • Family Sick Leave An employee may use sick leave credits for family illness or injury only if the employee must provide direct care to an immediate family member. For purposes of family sick leave, “immediate family member” will mean the employee’s parent, spouse, or child, including step-child and xxxxxx child.

  • Sick Leave Separation Cash Out At the time of retirement from state service or at death, an eligible employee or the employee’s estate will receive cash for their compensable sick leave balance on a one (1) hour for four (4) hours basis. For the purposes of this Section, retirement will not include “vested out of service” employees who leave funds on deposit with the retirement system.

  • Shareholder Rights With respect to the foreign securities held pursuant to this Section 4, the Custodian will use reasonable commercial efforts to facilitate the exercise of voting and other shareholder rights, subject always to the laws, regulations and practical constraints that may exist in the country where such securities are issued. The Fund acknowledges that local conditions, including lack of regulation, onerous procedural obligations, lack of notice and other factors may have the effect of severely limiting the ability of the Fund to exercise shareholder rights.
