It shall not be a violation of this Agreement and it shall not be a cause for discharge or disciplinary action in the event an employee refuses to cross a legal picket line.

LOCKOUTS PICKET LINES. There shall be no strikes or lockouts during the life of this agreement. Employees covered by this agreement shall not be disciplined for refusal to cross legally established picket lines for the purpose of performing work normally performed by members of the Union setting up the picket line. An employee who is unable to report for work because of a reasonable apprehension of personal injury resulting from picket line activity shall suffer no loss in pay, provided that the employee contacts University Safety and follows reasonable instructions received from that office.

During the probationary period the employee may be discharged or disciplined without recourse to the grievance procedure. The Company may not discharge such employee for the purpose of forcing an additional probationary period. Upon completion of the forty-five (45) calendar days, the employee shall either be discharged or placed on the regular seniority list as the date of the commencement of his probationary period.
