MAINTENANCE OF RIGHTS AND BENEFITS. Except as modified herein, Employees shall retain all rights and benefits pertaining to their conditions of employment as contained in the departmental and Civil Service rules and regulations and Hawai`i Revised Statutes at the time of execution of this Agreement, but excluding matters which are not negotiable under Chapter 89, HRS.

MAINTENANCE OF RIGHTS AND BENEFITS. 1. Except as modified by the terms of this Agreement, Faculty Members1 shall retain all rights and benefits provided in the written rules, regulations, and policies formally adopted by the Board of Regents existing at the execution of this Agreement which pertain to wages, hours, and other terms and conditions of employment. The minutes of the Board of Regents shall constitute the basis of the applicable rule, regulation, or policy.
MAINTENANCE OF RIGHTS AND BENEFITS. Past practices involving GE rights and benefits, defined as terms and conditions of employment, which are in effect at the time this Agreement is signed and which are terms or conditions of employment shall be maintained in those departments or comparable employing units where such past practices have been uniformly applied over a reasonable period of time, except where such practices have been addressed or limited by this Agreement. In addition, nothing in this Article shall preclude GE participation in departmental affairs relating to instruction in accordance with the University’s governance structure.
MAINTENANCE OF RIGHTS AND BENEFITS. A. Nurses on leave of absence with pay shall continue to receive full benefits provided by the Newark Public Schools as stated in this Agreement.
MAINTENANCE OF RIGHTS AND BENEFITS. Paraprofessionals who are on leave under this contract shall be entitled, upon their return, to all rights and benefits to which the employee was entitled at the commencement of such leave.

All fringe benefits to which a teacher was entitled at the time his leave of absence commenced, including unused accumulated sick leave, will be restored to him/her upon return, and he/she will be assigned to the same or a substantially equivalent position. It is understood that return from any leave provided for in this Article is subject to the layoff and recall provisions of this Agreement.

No employee shall, as a result of the establishment of a level of rights or benefits in this Agreement, suffer a loss or diminution of any such rights or benefits for which the employee is otherwise eligible.
