D. Daleville Community Schools PL-199 Agreement
1. The terms of the PL-199 Agreement (Appendix D) refer to sections and articles from the 2008-2009 Master Contract between the Daleville Federation of Teachers, Local 3475, American Federation of Teachers and the Board of School Trustees, Daleville Community Schools. Some of those sections and articles no longer appear in the 2015-2016 Master Contract; however, the agreement remains in effect.
1. Factor 1- Teacher Evaluation: $27,333.35 (79.69% of available money)
a. Teacher evaluation shall be defined as a rating of Effective or Highly Effective.
b. Available money in Factor 1 will be distributed to eligible teachers as a $500.00 increase added to the 2023-2024 base salary.
2. Factor 2- Experience: $5,466.67 (15.94% of available money)
a. Experience shall be defined as a teacher returning to Daleville Community Schools for an additional year of teaching experience.
b. A teacher must have 120 days of service to count as a year of experience (TRF requirement).
c. Money available for experience shall be distributed equally among eligible teachers.
3. Factor 3: Education - Possession of a Content Area Master’s Degree: $1,500.00 (4.37% of available money)
a. Any teacher that earned a master’s degree in a content area as defined by 511 IAC 10.1-1-1 (9) and between July 1, 2023 and June 30, 2024 shall receive $1,500.00 added to their base salary.
Miscellaneous Contract Provisions. 1. The term “teacher” and “teaching assistant” as used in this Agreement shall pertain only to those certificated professional personnel in the bargaining unit serving in those respective job titles and does not include a ten-month or twelve-month school nurse.
2. If an agreement or contract between the Board and an individual bargaining unit member, heretofore executed, contains any provisions inconsistent with this agreement, then this agreement, throughout its duration, shall be controlling. Any agreement or contract between the Board and an individual bargaining unit member hereafter executed shall be expressly made subject to and consistent with the terms of this Agreement.
3. If any provision of this Agreement or any application thereof to any employee or group of employees shall be found to be held to be contrary to law or any rule or regulation having the effect of law by a decision of the tribunal or competent jurisdiction or shall have the effect of loss to the district of funds otherwise available under state or federal law then such provision or application thereof shall be null and void, but all other provisions or applications will continue in full force and effect. At the option of either party, negotiations shall be immediately undertaken with respect to a substitute for such provision or application becoming null and void..
4. In the event that there shall be a conflict of intent or purpose between the terms of this Agreement and any rules, regulations, or policies of the Board, then the terms of this Agreement shall control.
5. It is recognized that at times during the term of this Agreement it would be desirable to have an exchange of opinions and information concerning items which have not been negotiated. To this end, the parties agree:
a. That the Board Clerk shall furnish the Association President with a copy of all notices of and agenda of general and special meetings, Board minutes, and all other items distributed to Board members, excepting those of a confidential nature.
b. That the Board and Association shall communicate such opinions and information, including any requests for meetings by mutual agree- ment, through the Superintendent and as promptly as practicable.
c. That the MTA shall furnish the Board of Education and Superinten- dent with a copy of all items of general distribution, excepting those of a confidential nature.

Time is of the essence in the performance of this Assignment. This Assignment is the entire agreement of the parties relating to the assignment of the Agreement by Current Tenant to New Tenant. The parties agree to execute such other documents as reasonably necessary to carry out the purpose of this Assignment. This Assignment may be executed in multiple counterparts which will be construed together as a single document. Facsimile signatures to this Assignment will be binding on the parties when executed copies are distributed via telefax transmission, provided the parties agree to provide executed originals for each party as soon as practical.

1. Upon request of either party, representatives of the Board and the Association's bargaining committee will meet for the purpose of reviewing the administration of the Agreement, and to resolve problems that may arise. These meetings are not intended to bypass the grievance procedure, nor to re-negotiate the Agreement.
2. Should such a meeting result in a mutually acceptable amendment of the Agreement then the amendment shall be subject to ratification by the Board and the Association
