Mold/Mildew. Buyer(s) acknowledges and agrees that Contractor will not be liable for any actual, special, incidental, or consequential damages based on any legal theory whatsoever, including, but not limited to, strict liability, breach of express or implied warranty, negligence or any other legal theory with respect to the presence and/or existence of molds, mildew, and/or microscopic spores unless caused by the sole negligence or willful misconduct of Contractor. Buyer(s), on behalf of itself and its family members, tenants, invitees and licensees, hereby releases Contractor and Contractor’s officers, directors, partners, members, successors and assigns from and against any and all claims, actions, damages, causes of action, liabilities and expenses (including without limitation, attorneys’ fees and costs of enforcing this indemnity) for property damage, injury, or death resulting from exposure to mold, mildew, and/or microscopic spores and from any loss of resale value due to the presence and/or existence of mold, mildew, and/or microscopic spores, provided however, that in no event is Buyer(s) releasing Contractor from property damage which results from the presence and/or existence of mold, mildew, and/or microscopic spores which is caused by the sole negligence or willful misconduct of Contractor.
Mold/Mildew. RESIDENT is hereby notified that mold can grow if Apartments are not properly ventilated or maintained. If moisture is allowed to accumulate in Apartments, it can cause mildew and mold to grow. RESIDENT agrees to maintain the premises in a manner that prevents the occurrence of an infestation of mold or mildew in the premises. RESIDENT agrees to uphold this responsibility by:
a. Keeping the apartment free from dirt and debris, including cleaning all toilets, sinks, countertops, showers, bathtubs and tile or linoleum floors with a household cleanser at least every other week,
b. Immediately reporting to UNIVERSITY and Heritage Property Management any water intrusion, such as plumbing leaks, drips or “sweating pipes,”
c. Notifying UNIVERSITY and Heritage Property Management of overflows from bathroom, kitchen or laundry facilities,
d. Reporting to UNIVERSITY and Heritage Property Management any significant mold growth on surfaces inside Apartments,
e. Using bathroom fans while showering or bathing and reporting to UNIVERSITY and Heritage Property Management any non-working fan,
f. Using exhaust fans when cooking, dishwashing or cleaning,
g. Using reasonable care to close all windows and other openings into the Apartment to prevent outdoor water from coming into the Apartment,
h. Cleaning and drying any visible moisture on windows, walls, and other surfaces, including personal property as soon as reasonably possible (note: mold can grow on damp surfaces within 24 to 48 hours), i. And notifying UNIVERSITY and Heritage Property Management of any problem with the air conditioning, heating system, and water heater that you discover.
Mold/Mildew. Tenant acknowledges that the premises is located in Florida, which has a climate conducive to the growth of mold and mildew, and that it is necessary to provide proper ventilation and de-humidification of the premises to retard or prevent the growth of mold and mildew. Tenant agrees to be responsible for proper ventilation and dehumidifying the premises and the contents to retard and prevent mold and mildew and that the Manager/Landlord shall not be responsible for damage from mold or mildew to the premises or the personal property of the Tenants. Mold/Mildew. Mildew is a growth produced by molds which are simple plants belonging to the group known as fungi. Although molds are generally harmless and always present in the air, those that cause mildew only need moisture and a certain temperature to grow. Molds that cause mildew flourish in areas that are damp, warm, dimly lighted, or where air is not circulated such as basement apartments, bathrooms, laundry rooms, and closets. Prevention is the best mildew policy. If things are kept clean, well ventilated, and dry, your chances of having mildew are greatly lessened. In warm humid weather, it’s essential that you run the air-conditioning and dehumidifier (if provided) at all times to reduce the humidity in the apartment. Opening the doors and windows in pleasant weather, opening the blinds and letting sunlight into your room, and operating the ceiling fans on a regular basis helps to circulate air. It also helps to reduce mildew growth if you run the bathroom exhaust fans when you shower to remove as much moisture as possible; then, leave the fan on for a while and leave the bathroom door open after you finish bathing so that the room airs out. Mold/Mildew. Landlord endeavors to maintain the highest quality living environment for the Tenant. Except as may be noted at the time of Tenant’s move in inspection, Tenant agrees that the Premises is being delivered free of know damp or wet building materials (“mold”) or mildew. Tenant acknowledges and agrees that (i) mold can grow if the Premises is not property maintained; (ii) moisture may accumulate inside the Premises if it is not regularly aired out; (iii) if moisture is allowed to accumulate, it can lead to the growth of mold; and (iv) mold may grown even in a small amount of moisture. Tenant acknowledges and agrees to maintain the Premises in a manner that prevents the occurrence of, and infestation of mold or mildew in the Premises. Tenant agrees to uphold this responsibility in part by complying with the list of responsibilities listed below. By signing this Lease, Tenant represents and agrees that Landlord has provided Tenant with such information and that Tenant’s agreement to do so is part of Tenant’s material consideration in Landlord’s agreement to rent the Premises to Tenant. Accordingly, Tenant agrees to the following responsibilities:
a. Maintain the Premises free of dirt, debris and moisture that can harbor mold;
b. Clean any mildew or mold that appears with an appropriate cleaner designed to kill mold;
c. Clean and dry any visible moisture on windows, walls and other surfaces, including personal property as quickly as possible; (Note: Mold can grow on damp surfaces within 24 - 48 hours.)
d. Use reasonable care to close all windows and other openings in the Premises to prevent water from entering the Premises;
e. Regularly allow air to circulate in the living areas and unit. Use exhaust fans, if any, in the bathroom(s) and kitchen while using those facilities and notify Landlord of any inoperative exhaust fans;
f. Immediately notify Landlord of any water intrusion, including but not limited to, roof or plumbing leaks, drips or “sweating pipes”;
g. Immediately notify Landlord of overflows from bathroom, kitchen or laundry facilities;
h. Immediately notify Landlord of any significant mold growth on surfaces in the Premises;
i. Allow Landlord to enter the Premises to make inspections regarding mold and ventilation;
j. Tenant agrees to indemnify and hold harmless the Landlord from any actions, claims, losses, damages, and expenses, including, but not limited to, attorney’s fees that the Landlord may sustain or incur as a result of the negligence of the ...
Mold/Mildew. Buyer is hereby advised that tropical climates with warm temperatures, high humidity and frequent precipitation are conducive to the propagation of mold, mildew, fungus and other types of bacterial growths. Though the buildings and other improvements that are a part of Honua Kai may be cleaned to satisfactory appearance, Seller cannot guarantee that mold, mildew, fungus and other types of bacterial growths can be completely eliminated. The buildings may have had incidences of leaking and water exposure which may have resulted in the introduction of mold, mildew, fungus and other types of bacterial growths. Buyer should be aware that, as with all properties, the buildings may have hidden, enclosed and unreachable areas where growths can occur and cannot be detected and that there may in the future be mold and mildew growth in Honua Kai if the Association and occupants of the units do not properly maintain Honua Kai. If Buyer or any person who will visit the Property has respiratory, skin or other health ailments or conditions that can be affected by mold, mildew, fungus or other types of bacterial growths they should seek professional advice before completing this purchase. Neither the Seller nor its agents associated with Luana have the requisite knowledge to provide advice as to the presence of mold, mildew, fungus and other types of bacterial growth in Honua Kai, or the likelihood of conditions conducive to propagation of mold, mildew, fungus and other type of bacterial growths in Honua Kai or as to the effect the aforementioned conditions can have with respect to their health, welfare and continued enjoyment of the Property. Individuals who may be capable of providing such advice are professional home inspectors, medical professionals, scientific research professionals, certified industrial hygienists or other environmental specialists and/or others who have requisite knowledge in matters of detection and lab analysis services. Buyer shall have seven (7) days from the Acceptance Date to perform or engage a professional consultant to perform a risk assessment or inspection in the Unit and Honua Kai, at Buyer’s option and expense, for the presence of mold, mildew, fungus or other types of bacterial growths in the Unit and Honua Kai. Mold/Mildew. Tenants will use reasonable efforts to maintain the Property in such a condition as to prevent the accumulation of moisture and the growth of mold, and to notify the Owner in writing promptly of any moisture accumulation that occurs or any visible evidence of mold. Please pay special attention to the condition and cleanlin ess before moving into the apartment. You will notice there is no grease nor soils on the kitchen cabinets, stove, walls, stove hood (fan) floor, or window blinds. There are no broken parts on any appliances. When a tenant moves these items must be as clean as when the tenant moves in. The bathtub, bathroom sink, bathtub walls and toilet are clean and free from mildew and mold. When a tenant moves the fixtures must be cleaned and essentially in the same condition as when Tenant moved in. Mold/Mildew. Tenant acknowledges receipt of the Mold/Mildew Addendum along with a copy of the Resident Responsibility Guide that includes a tip sheet for the prevention of mold growth in the Premises.
Mold/Mildew. Mold and mildew are naturally occurring substances and it is possible to appear or grow on Occupant’s stored property. Owner does not represent that the Space is humidity controlled and does not warrant or represent that a minimum or maximum humidity will be maintained at any time during the term. Occupant understands that there is a risk of the growth of mold and/or mildew on Occupant’s stored property in any Space. Owner does not warrant the Space to be water-tight or dry. Occupant is solely responsible for preventing mold and/or mildew on Occupant’s stored property in the Space. Occupant hereby releases Owner from any liability for mold and/or mildew on Occupant’s stored property from whatever source and no matter how it occurs. Occupant shall take whatever steps necessary to protect against and prevent mold in their stored property. Occupant understands that any personal property brought into the Space that is damp or wet will likely grow mold and/or mildew. Occupant shall periodically inspect the Space and the personal property stored in the Space and take any and all actions necessary to protect Occupant’s stored property from mold and/or mildew.
