MUTUAL ASSENT. 4.1 For your benefit and protection, you should take sufficient time to read this Agreement, as well as any additional documents, information and/or other legal notices and statements (forming part of the Agreement or otherwise) contained in our Online Trading Facility or available upon request, completely and carefully before (a) opening an Account, accessing, and/or (b) using our Online Trading Facility, and/or (c) placing any Order or Transaction with us, and you should contact us to ask for further information or seek independent professional advice if necessary. 4.2 You must read, agree with and accept all of the terms and conditions contained in this Agreement and in any additional documents, information and/or other legal notices and statements (forming part of the Agreement or otherwise) contained in our Online Trading Facility or available upon request, without modifications, before you may become our customer. 4.3 IF YOU HAVE OBJECTIONS TO ANY OF THIS AGREEMENT AND/OR ANY ADDITIONAL DOCUMENTS, INFORMATION AND/OR OTHER LEGAL NOTICES AND STATEMENTS (FORMING PART OF THE AGREEMENT OR OTHERWISE) CONTAINED IN OUR ONLINE TRADING FACILITY OR AVAILABLE UPON REQUEST, OR ANY PART THEREOF, AND/OR IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT AND/OR ANY ADDITIONAL DOCUMENTS, INFORMATION AND/OR OTHER LEGAL NOTICES AND STATEMENTS (FORMING PART OF THE AGREEMENT OR OTHERWISE) CONTAINED IN OUR ONLINE TRADING FACILITY OR AVAILABLE UPON REQUEST, OR ANY PART THEREOF, DO NOT ACCESS AND/OR USE OUR ONLINE TRADING FACILITY IN ANY WAY, AND INFORM US IN WRITING IMMEDIATELY. 4.4 Your access and use of our Online Trading Facility constitutes your acceptance of this Agreement and of any additional documents, information and/or other legal notices and statements (forming part of the Agreement or otherwise) contained in our Online Trading Facility or available upon request. MUTUAL ASSENT. 7. 1. Each Party represents that it has the right, power, legal capacity and authority to enter into and perform its obligations under this Agreement, and all agreements to which the Party is or will be a party that are required to be executed pursuant to this Agreement. All services performed by PPMT will meet and/or exceed Federal, State, and Local regulatory standards. 3. All services performed by PPMT will follow the County's policies and practices where appropriate. 4. PPMT will follow the Facility drug formulary and comply with the Montana Nurse Practice Act and Board of Pharmacy regulations. 5. All new admissions/screening charts will be reviewed and signed by a physician or PA/NP within 72 hours of intake. Provision that those which require emergency assessment will be reviewed more quickly (i.e. alcohol withdrawal). 6. PPMT services will align with the most widely-accepted, evidenced-based medical interventions as the standards of care evolve for the treatment of alcohol, opiate or benzodiazepine withdrawal.  Health Services Administrator (HSA)/Registered Nurse (RN) - 1.0 FTE  Advanced Practice Clinician (APC) - Nurse Practitioner or Physician Assistant - 16 hours weekly onsite (0.40 FTE) and on call 24/7. PPMT will evaluate within six (6) months the need for a provider three (3) days a week, twenty-four (24) hours weekly. The cost of the additional hours will be absorbed by PPMT with no change to the terms of the agreement.  Psychiatric Nurse Practitioner (or equivalent) for 4 hours per week. PPMT may use telemedicine technology, in concert with County designated mental health partner staff, to diagnose and prescribe psychotropic medications  Nursing Clinical staff - 6.5 FTE  Administrative Office Manager - 1.0 FTE  Onsite nursing care will be available 24 hours per day, 7 days per week  Complete criminal background checks are conducted on selected job applicants; in addition, all new staff members will be required to orient to the Facility’s safety and security protocols.  PPMT account management team (Diagram 2 - below) an...

  • Mutual Aid When rendering mutual aid or assistance as authorized in H&SC Sections 13050 and 13054, STATE may, at the request of LOCAL AGENCY, demand payment of charges and seek reimbursement of LOCAL AGENCY costs for personnel, equipment and operating expenses as funded herein, under authority given by H&SC Sections 13051 and 13054. STATE, in seeking said reimbursement pursuant to such request of LOCAL AGENCY, shall represent LOCAL AGENCY by following the procedures set forth in H&SC Section 13052. Any recovery of LOCAL AGENCY costs, less expenses, shall be paid or credited to LOCAL AGENCY, as directed by LOCAL AGENCY. In all such instances, STATE shall give timely notice of the possible application of H&SC Sections 13051 and 13054 to the officer designated by LOCAL AGENCY.
