That ALAMEDA CTC ADMINISTERED FUNDS obligated by this AGREEMENT may be shifted between the phases of the PROJECT or between activities in the same phase of the PROJECT, so long as each of the following occurs: 1) PROJECT SPONSOR submits a written amendment request that provides revised and updated Appendix A: Project Control Information forms documenting the requested funding obligation shift and demonstrating to ALAMEDA CTC’s satisfaction that the phase or activity from which the funds were shifted remains fully funded, and 2) the parties execute an amendment to this AGREEMENT incorporating the revised and updated Appendix A forms as described above, which amendment shall be approved by ALAMEDA CTC pursuant to applicable ALAMEDA CTC policies.

The Marina grants to the Owner a slip (as designated on the chart kept in the office at Tarrytown) for the Owner’s vessel having an OVERALL LENGTH of feet and having a BEAM of feet, having AIR CONDITIONERS on Board and requiring AMPS of electric service, for the season of 2009 at the applicable rates as set forth in the attached 2009 rate schedule.

MUTUALLY AGREED AS FOLLOWS. The organization and visitors shall faithfully comply with and keep and observe the rules and regulations set forth below or to be made in the future. The Student Union will be responsible for providing the occupying organization with office space, electricity, HVAC, housekeeping and maintenance services. The space shall be used and occupied by the organization as and for office purposes, only during normal operating hours, except the Media Center. No sleeping is allowed. The organization shall take good care of the premises, fixtures, and furnishings, and shall return the premises and fixtures in as good condition as reasonable use will permit. Any damages to the building, fixtures, or furnishings, caused by the organization shall be repaired by the Student Union at the expense of the organization. The organization shall not make any alterations, additions or improvements to the premises without written approval from the Director of the Student Union. All permanent alterations or improvements upon the premises made by either party shall become the property of the Student Union. College representatives shall have the right to enter the office space without prior notice for the purpose of: fire, safety, and health inspections, responding to clear indications of immediate danger to life, safety, health or property, maintaining the conditions of the facilities and furnishings. If possible and feasible, students or organization advisor will be present during these entries. The entries shall not be obstructed or used for any other purposes than ingress and egress. The windows, glass doors, and any lights or skylights that reflect or admit light into the building shall not be covered. The organization shall not xxxx, paint, drill into, or, in any way, deface the walls, ceiling, partitions, floors, or woodwork, without the written approval of the Director of the Student Union. Prohibited items in the Student Union include, but are not limited to: Firearms, bb guns, knives, or any type of weapon. Candles and incense. Such position shall include those duties of a non-instructional nature as are customarily incident thereto. The right is reserved to the District to make such changes in the Teacher's assignment as unforeseen conditions may require for the best interests of the school system, except that in no event shall the Teacher be assigned to a position for which he/she is not qualified or certified by the State Department of Education to occupy. The salary quoted herein is the entire compensation of the Teacher for all services to be performed under this agreement. 4) The employment of the Teacher hereunder shall not be valid unless the Teacher holds at the beginning of the school year an appropriate credential issued by the NH State Department of Education for the position for which he/she has been employed.
