Negotiation Services a. Engineer shall analyze preliminary title reports for each Parcel to determine potential title problems, propose and inform Owner of methods to cure title deficiencies. This includes analysis of access easements.
b. Engineer shall analyze appraisal and appraisal review reports and confirm the Owner’s approved value prior to making offer for such Parcel.
c. Engineer shall prepare and send the letter transmitting the Landowners’ Xxxx of Rights by Certified Mail-Return Receipt Requested (CMRRR) and any other method authorized by law and the Owner.
d. Engineer shall prepare all documents required or requested by Owner on applicable forms approved by Owner (i.e. the initial offer letter, memorandum of agreement, instruments of conveyance).
e. The written offer, appraisal report and required brochures must be sent by Engineer to each property owner or the property owner’s designated representative through CMRRR, and Engineer shall maintain follow-up contacts and secure the necessary instruments upon acceptance of the offer for the closing. Engineer shall retain copies of the unsigned CMRRR receipt and the appraisal as support for billing purposes.
f. Engineer shall respond to property owner inquiries verbally and in writing within two (2) business days.
g. Engineer shall prepare a separate negotiator contact report for each Parcel, per contact.
h. All original Project and Parcel file documents must be kept in Owner’s office. All original documents generated or received by Engineer must be delivered to Owner’s office. Copies or working file documents may be kept by Engineer.
i. Engineer shall transmit to Owner any written counter offer from property owners including supporting documentation and provide recommendation.
j. Engineer shall prepare final offer letters and mail the documents of conveyance by CMRRR.
k. Engineer shall issue the survey of each such Parcel to the property owner.
l. Engineer shall secure a Right of Entry or Possession and Use Agreement when possible.
Negotiation Services. 5.2.1.1 The Network will negotiate rebates, discounts and benefits from suppliers and will always share these rebates, discounts and benefits with the Members.
Negotiation Services. ($5,000 per each)

c. Prepare the initial offer letter, instruments of conveyance, and any other documents required or requested by the CITY on CITY-approved forms.
d. Send the initial offer, appraisal, and required brochures to each property owner or the property owner's designated representative through CMRRR. Maintain follow- up contacts and secure the necessary instruments upon acceptance of the offer for the closing.
e. Make four (4) diligent attempts to contact each property owner, after which the property owner will be considered non-responsive, and negotiations will be considered exhausted.
f. Prepare and maintain a negotiator's report for each parcel.
g. Receive any counteroffers from the property owner. Evaluate all counters and submit to and discuss them with the CITY's Project Manager.
h. After the concurrence of the CITY Project Manager, prepare the final offer letter and mail conveyance documents by CMRRR.
i. If a settlement cannot be reached or title can’t be cleared, a file suitable for Eminent Domain proceedings will be provided to the Client.
Negotiation Services. Secure rights of entry from designated property owners for the purpose of gaining access for surveying, appraising, field inspection of right of way and other purposes as may be determined.
Negotiation Services. To make sure that the mapping between data models is done automatically, mappings need to be established. Also the effect for the security policies has to be evaluated. This process is called negotiation and the Negotiation Services component provides the necessary business logic to establish these relations. The negotiation services consist of a simple negotiation service and an application that houses the business logic needed to map different concepts to each other.

This includes analysis of access easements. • Analyze Tarrant County Appraisal District information and confirm the City’s approved value prior to making offer for each parcel. Provider shall attempt to obtain the easements through donation prior to discussing approved monetary offer with landowners. • Prepare and send the letter transmitting the Landowners’ Bill of Rights by Certified Mail Return Receipt Requested (CMRRR). • Prepare the initial offer letter, memorandum of agreement, instruments of conveyance, and any other documents required or requested by the City. • Any prepared forms will be submitted to the City for approval. • The written offer and required brochures must be sent to each property owner or the property owner’s designated representative through Certified Mail Return Receipt Requested (CMRRR). Maintain follow-up contacts and secure the necessary instruments upon acceptance of the offer for the closing. Retain copies of the unsigned CMRRR as support for billing purposes. • Make at least four (4) diligent attempts to negotiate with each property owner after which negotiations will be considered exhausted. • Prepare a separate negotiator report for each parcel. • Copies of working and final file documents may be kept by the Provider (TNP). Parcel files of original documentation related to the purchase of the real property or property interests will be maintained. • Receive any counteroffers from the property owner. Evaluate all counters and submit and discuss them with the City’s Project Manager. • After concurrence of City Project Manager, prepare final offer letter, and mail the documents of conveyance by Certified Mail Return Receipt Requested (CMRRR). • Appear and provide Expert Witness testimony as a Provider when requested. • Issue Property Owner’s Survey to the property owner. • Securing a Right of Entry or Possession and Use Agreement is part of general Negotiation Services.
Negotiation Services. This service would include preparation of proposals, meetings with the Board of Education and Administration, and acting as chief negotiator at all negotiation sessions and, if necessary, mediation and fact finding. Billed at the hourly rate of $225.00 for services performed by attorneys and at the hourly rate of $125.00 for services performed by paralegals.
Negotiation Services. [NOTE TO VENDORS: This Section 3.5 will be removed from the Contract if Vendor does not propose negotiation services in Section V, Response 12 of the Attachment J, Water Mitigation Estimate Review Program Services Questionnaire.] As requested by Citizens, Vendor will negotiate directly with the third party vendor who submitted the Third Party Estimate, (the “Subject Service Provider”). Vendor will undertake to reach agreement with the Subject Service Provider as to the total fees payable with respect to the Third Party Estimate, (“Negotiation Services”). If Vendor and the Subject Service Provider reach an agreement as to the total fees payable under the Third Party Estimate, then the Vendor must deliver to Citizens the Subject Services Provider’s written confirmation of the agreement, (“Provider Confirmation”). Upon receipt of the Provider Confirmation, Citizens will compensate Vendor based upon the difference in cost between (i) the sum total fee of the Third Party Estimate and (ii) the sum total fee as agreed to pursuant to the Provider Confirmation, (the “Negotiated Savings”). More specifically, Citizens will compensate Vendor the percentage of Negotiated Savings provided in Section 8 below. Citizens may request Negotiation Services at the time of Assignment of the Assessment and Report. All Negotiation Services must be performed by a Staff Reviewer with an active adjusting license as defined by the State of Florida Department of Financial Services. Vendor agrees to maintain contact with the assigned Citizens’ adjuster throughout Vendor’s negotiation with the Subject Service Provider. Vendor will notify Citizens within one (1) business day of any substantial developments in the negotiation process, such as but not limited to, the reaching of an impasse or the reaching of agreement. If the Third Party Estimate is in excess of $10,000, then the assigned Citizens adjuster must provide the Vendor prior written approval of negotiation offers and strategies. If the Third Party Estimate is under $10,000, then Vendor may negotiate and obtain Provider Confirmation without advanced approval from Citizens. The Negotiation Services Fee is payable if and only if Citizens receives the Provider Confirmation.

Maintain follow-up contacts and secure the instruments necessary to secure the land rights needed for the contemplated facilities. • If monetary compensation is to be offered to property owner(s) in connection with this Projects, said compensation will be approved in writing by the CLIENT prior to said offer being presented to the property owner(s). • Respond to property owner inquiries verbally and in writing, and in person as necessary. • Maintain parcel files of original documentation related to the property interest acquire. • Transmit to CLIENT any written counteroffer from property owners including supporting documentation, along with a response recommendation. • Record all instruments securing property rights with the County Clerk in the jurisdiction in which the subject property is located.
Negotiation Services. Provide Negotiation Services to acquire the right-of-way in general accordance with the January 2018 INDOT Real Estate Division Manual and in accordance with the requirements of the City of West Lafayette. The OWNER will provide review and approval by legal counsel of the Conveyance Documents prepared by the CONSULTANT.
