Nominated Employee Representatives Rights. A Nominated Employee Representative will be allowed such reasonable time during working hours, as may be agreed between the parties to the Agreement: ▪ Discuss with the employees at the workplace at which they are a Nominated Employee Representative, matters relative to working conditions and other matters, with a view to avoiding industrial disputation or giving effect to the grievance procedure. ▪ Discuss with representative/s of the relevant parties to the Agreement the matters referred to above. ▪ Schedule a maximum of four [4] paid one [1] hour meetings per workplace per calendar year at a time to suit operational requirements to discuss matters directly relating to the employment relationship. Nominated Employee Representatives who do not have direct access to a land line will be provided with a mobile phone to maintain communications with employees and line management. Nominated Employee Representative will be released from normal duties to carry out paid meetings when required. Travel expenses or the provision of a vehicle may be provided to Nominated Employee Representatives to maintain contact with employees from time to time. Any approval will be subject to reasonable notice and any conditions or limitations as SPARQ Solutions may impose, this provision will not be unreasonably withheld. The parties agree that Nominated Employee Representatives may be required, from time to time, to be released from their normal duties to work as required, on work related projects or issues, or to carry out meetings with employees as requested by the Nominated Employee Representatives concerned subject to business operational requirements. Agreement for the Nominated Employee Representative/s involvement on such projects will not be unreasonably withheld. The parties will agree on the supervisory reporting process for the Nominated Employee Representative involvement prior to the start of any specific project. Nominated Employee Representatives, whilst working on such projects will: ▪ Work towards improving the industrial relationship to the mutual benefit of both SPARQ Solutions and employees in resolving issues of concern through the formal grievance process; and ▪ Keep both SPARQ Solutions and the relevant Nominated Employee Representatives abreast of the specific project, throughout its life.   • Termination of Employment Executive's employment hereunder may be terminated under the following circumstances:

  • Employment Company hereby employs Executive, and Executive hereby accepts such employment, upon the terms and conditions set forth herein.

  • Termination for Cause If Vendor fails to materially perform pursuant to the terms of this Agreement, TIPS shall provide written notice to Vendor specifying the default. If Vendor does not cure such default within thirty (30) days, TIPS may terminate this Agreement, in whole or in part, for cause. If TIPS terminates this Agreement for cause, and it is later determined that the termination for cause was wrongful, the termination shall automatically be converted to and treated as a termination for convenience.

  • Disability If, as a result of the Executive's incapacity due to physical or mental illness, the Executive shall have been absent from his duties with the Company on a full-time basis for six months and within 30 days after written notice of termination is thereafter given by the Company the Executive shall not have returned to the full-time performance of the Executive's duties, the Company may terminate this Agreement for "Disability."

  • Vacation During the Employment Period, the Executive shall be entitled to paid vacation in accordance with the most favorable plans, policies, programs and practices of the Company and its affiliated companies as in effect for the Executive at any time during the 120-day period immediately preceding the Effective Date or, if more favorable to the Executive, as in effect generally at any time thereafter with respect to other peer executives of the Company and its affiliated companies.

  • Sick Leave The employee is eligible for long term disability benefits if provided for in the Collective Agreement. An employee will not receive pay for the first two (2) weeks of any period of absence due to a legitimate illness. The employee may utilize the paid holiday bank as income replacement for absences due to illness, as described in Article (c) above. An employee who is eligible may apply for Employment Insurance for weeks three (3) through seventeen (17) for any absence due to a legitimate illness. The Home will provide the employee with Disability Income Protection as per Article 14.01 (c) for weeks eighteen (18) through thirty (30) for any absence due to a legitimate illness. Employees may be required to provide medical proof of illness for any absence of a scheduled shift, which is neither vacation nor an approved leave of absence.

  • Base Salary During the Employment Term, the Company shall pay Executive a base salary at the annual rate of $ , payable in regular installments in accordance with the Company’s usual payment practices. Executive shall be entitled to such increases in Executive’s base salary, if any, as may be determined from time to time in the sole discretion of the Board. Executive’s annual rate of base salary, as in effect from time to time, is hereinafter referred to as the “Base Salary.”

  • Salary No salary will be paid to a Member for the performance of his or her duties under this Agreement unless the salary has been approved in writing by a Majority of the Members.

  • Benefits 17.01 The Employer agrees, during the term of the Collective Agreement, to contribute towards the premium coverage of participating eligible employees in the active employ of the Employer under the insurance plans set out below subject to their respective terms and conditions including any enrolment requirements:

  • Scope of Services The specific scope of work for each job shall be determined in advance and in writing between TIPS Member, Member’s design professionals and Vendor. It is permitted for the TIPS Member to provide a general scope description, but the awarded vendor should provide a written scope of work, and if applicable, according to the TIPS Member’s design Professional as part of the proposal. Once the scope of the job is agreed to, the TIPS Member will issue a PO and/or an Agreement or Contract with the Job Order Contract Proposal referenced or as an attachment along with bond and any other special provisions agreed by the TIPS Member. If special terms and conditions other than those covered within this solicitation and awarded Agreements are required, they will be attached to the PO and/or an Agreement or Contract and shall take precedence over those in this base TIPS Vendor Agreement.
