Obligations of Independent Contractor. It shall be the obligation and liability of Independent Contractor to pay the following items and perform in the following manner:
A. Independent Contractor shall be liable for and pay for all obligations incurred, including, but is not limited to, telephone usage and equipment, bank debits for returned checks, delivery of clients' tickets, advertising and promotion of Independent Contractor's business, salaries or wages of employees of Independent Contractor, annual premium for Professional Travel Liability Insurance ("Errors & Omissions" insurance) as determined by the issuing company, and other costs and expenses as they may occur, and that are related to the STARS Program for the benefit of the STARS participants.
B. Independent Contractor agrees to be responsible for all of his/her own Federal Income and social Security taxes. As such, ITH will not withhold Federal Withholding Tax (FWT) nor withhold Social Security Tax (FICA) from gross amounts paid to Independent Contractor as commission earned. ITH will submit to the Internal Revenue Service a 1099 form on behalf of Independent Contractor at the end of the fiscal taxable year. Medical Insurance, as well as other ITH employee benefits, will not be provided by ITH for Independent Contractor.
C. Independent Contractor shall account for and deliver to ITH all payments accepted by Independent Contractor for all airlines tickets and/or other travel accommodations and shall provide ITH with all accounting for any accommodations produced through commercial charge or deferred payment account. Independent Contractor is responsible for collection of his/her accounts’ receivable (including insufficient funds customer checks), and accounts receivable should be paid at same time as issuance of tickets or other travel documents. Independent Contractor is personally liable for any accounts not paid including clients' credit card charge-backs from either the card issuing company or the validating airline. Independent Contractor agrees to adhere strictly to the ticketing and payment instructions of ARC as set out in the ARC Industry Agents Handbook for all such sales (whether on a cash, charge or credit card basis) made on airline ticket stock and processed through the ARC Area Settlement Plan, as well as any other travel supplier, ITH and IATAN requirements.

Obligations of Independent Contractor. For business generated by the INDEPENDENT CONTRACTOR, the INDEPENDENT CONTRACTOR will be responsible for any nonpayment of invoices. Any AGENCY invoice for travel not paid within 5 days of the due date will be charged to the INDEPENDENT CONTRACTOR or cancelled by the AGENCY. Uncollected funds due to bounced checks or fraud will be charged to the INDEPENDENT CONTRACTOR. In addition to the amount of the dishonored check, the INDEPENDENT CONTRACTOR will pay to AGENCY and additional $50.00 per check to cover bank and other related charges. The INDEPENDENT CONTRACTOR will not, at any time, either personally or through others, solicit or divert, or attempt to solicit or divert, clients, customers, sales or business form AGENCY to, or for, any other travel agency, or anyone, either during the term of this Agreement, or, following the termination of this agreement, for a period of five (5) years. This does not include accounts brought to the AGENCY by the INDEPENDENT CONTRACTOR. The AGENCY will not directly solicit customers of the INDEPENDENT CONTRACTOR five

The Independent Contractor will not, at any time, either himself/herself or through others, solicit or divert, or attempt to solicit or divert, clients, customers, sales or business from the Company to, or for, any other travel agency, or other entity or individual either during the term of this Agreement or following termination, for a period of 2 years. The Independent Contractor will not, at any time, either himself/herself, or through, or with the aid of an assistant of others, take, misappropriate, or misuse any client list, name, file, book, record or account or other confidential customer data used at or in the Company business. These items are and shall remain the property of the Company.
Obligations of Independent Contractor. The Independent Contractor as a condition of employment agrees to do and to maintain the following:
a. To supervise the engagement, employment and work being done for a feasibility study, appraisal, work being done by architectural, drafting, design, engineering, both structural and civil, plan check, permiting to provide such building permits as may be required from governmental authority, a feasibility study, appraisal necessary to obtain a construction loan, environmental impact study, if required, such other studies as may be required by local governmental authority such as, but not limited to, traffic studies, noise pollution, soil studies, environmental site assessment studies and the engagement of a general contractor and subcontractors as may be necessary and appropriate to a speedy conclusion of the project; and
b. To follow up and process any necessary changes and or required plans that may be requested to speedily and satisfactorily complete the project and to continue to provide such services until such time as the project has been completed. Additionally, the Independent Contractor shall be reimbursed for all expenses made by him on behalf of the Company, said reimbursement to be made no later than 7 days after the presentation of an invoice for the said expenses, which said invoice shall contain copies of all invoices for actual expenses incurred from third parties.
Obligations of Independent Contractor. The Independent Contractor will not, at any time, either himself/herself or through others, solicit or divert, or attempt to solicit or divert, clients, customers, sales or business from the Travel Agency to, or for, any other travel agency, or other entity or individual either during the term of this Agreement or following termination, for a period of years within the following counties: Sacramento, El Dorado, Amador, Placer, Xxxxxx, Alameda or San Xxxxxxx. The Independent Contractor will not, at any time, either himself/herself, or through, or with the aid of an assistant of others, take, misappropriate, or misuse any client list, name, file, book, record or account or other confidential customer data used at or in the Travel Agency’s business. These items are and shall remain the property of the Travel Agency.
Obligations of Independent Contractor. The Independent Contractor will not, at any time, either himself/herself or through others, solicit or divert, or attempt to solicit or divert, clients, customers, sales or business from Vilu Travel Designers to, or for, any other travel agency, or other entity or individual either during the term of this Agreement or following termination, for a period of 2 years. The Independent Contractor will not, at any time, either himself/herself, or through, or with the aid of an assistant of others, take, misappropriate, or misuse any client list, name, file, book, record or account or other confidential customer data used at or in Vilu Travel Designers business. These items are and shall remain the property of the Vilu Travel Designers.
Obligations of Independent Contractor. Independent Contractor acknowledges and agrees that it alone is responsible for the following:
a. Collection, reporting and payment when due all wages and taxes, including without limitation, all federal, state and local taxes, social security, withholding and unemployment compensation taxes (if applicable) and any other taxes and license fees imposed;
b. Obtain and maintain during the term of this Agreement, General Liability Insurance of at least $ , and if applicable Workers/Unemployment Compensation Insurance for any of its employees; and
c. Comply at its expense with all federal, state and local safety, immigration, health and work laws, regulations, directives and rules.
Obligations of Independent Contractor. The Independent Contractor shall be responsible to the Travel Agency for payment in full of any travel services sold by the Independent Contractor. The Independent Contractor may not book any travel services for any clients introduced to IC by the Travel Agency with any other travel agency during and after the term of this Agreement. The Independent Contractor will not, at any time, either individually or through others, solicit or divert, or attempt to solicit or divert, clients, customers, sales or business from the Travel Agency to, or for, any other travel agency, or anyone, either during the term of this Agreement. The parties acknowledge that all clients introduced to Travel Agency by the independent contractor are and shall remain the property of the Independent Contractor. In no instance can the Travel Agency sell, give or disclose names of the IC clients to anyone except for the booking tour or cruise company through whom the IC arranged the trip. All clients introduced to the IC by the Travel Agency shall remain the property of the Travel Agency and the IC shall not contact those clients after the relationship with the Travel Agency has ended. The foregoing notwithstanding, if the Travel Agency is contacted directly by one of IC’s clients for the purpose of having the Travel Agency plan their travel then Travel Agency may consider that client a client of the Travel Agency. The Independent Contractor will not, at any time, either individually or through or with the aid or assistance of other, take, misappropriate, or misuse any client list, name, file, book, record of account, or other confidential customer data used at or in the Travel Agency business. The Independent Contractor shall never transfer any reservation record of the Travel Agency to any other travel agency, except with the Travel Agency’s written permission or instructions. These items are and shall remain in the property of the Travel Agency. Deadlines, changes, cancellations: All suppliers have cancellation, deadlines and change policies. IT IS THE IC’s RESPONSIBILITY TO MAKE SURE THAT YOU AND YOUR CLIENTS ARE AWARE OF SUPPLIER REFUND PENALTIES AND DEADLINES, if any. You give us the authority and the right to use any means to collect any and all penalties and cancellation fees incurred by you with the suppliers and not promptly settled. ADDITIONAL CHARGES TO IC. Obligations of Independent Contractor. Compensation. Independent Contractor agrees to provide workers' compensation insurance for Independent Contractor's employees and agents, if any, and agrees to hold harmless and indemnify MC for any and all claims arising out of any injury, disability, or death of any of Independent Contractor's employees or agents.
Obligations of Independent Contractor.
