Overtime Exemption. The Employer and the Union agree, when the Employer offers part-time faculty members the opportunity to accept additional part-time auxiliary or term hours, merit considered, such assignments are exempt from overtime pay (as outlined in Article 15), provided they do not, in combination, exceed eight (8) direct instructional hours per day [as defined in Article 14.2(b)] and the program norms biweekly (see Appendix I). The Employer may decide to offer such assignments subject to the following considerations:
Overtime Exemption. The Parties agree that Commanders shall be considered overtime exempt managerial employees, and as such, shall be paid salary (calculated from an hourly rate based on the standard forty (40) hour workweek). Commanders shall not be entitled to overtime compensation under either the Fair Labor Standards Act or Washington Minimum Wage Act.

The Executive will be exempt from overtime entitlements as the scope of the Executive's duties and responsibilities will be supervisory or managerial in nature and/or by virtue of the Executive's profession. BONUS STANTEC may, in its sole discretion, pay the Executive a bonus from time to time. In determining whether or not to pay a bonus in respect of any year, STANTEC will consider, among other things, exceptional individual and corporate performance. Receipt of a bonus in any year shall not create an entitlement to a bonus in subsequent years. In the event that the employment of the Executive is terminated as a result of the operation of Sections 3.2(b), 3.3, 3.4, or 3.5, the Executive shall be entitled to a bonus equal to:
Overtime Exemption. The parties acknowledge that the Crime Analyst and Senior Crime Analyst classifications are overtime exempt.

The Parties understand and agree that the overtime exemption provided for by the FLSA known as the 7(k) exemption is hereby adopted by the City and shall be used to determine an applicable work period for purposes of overtime under the FLSA for certain work groups. The City reserves the right to make an initial determination regarding whether an overtime exemption applies, based on its own evaluation, or based on a request for an evaluation from the Department of Labor (DOL).
Overtime Exemption. The provisions of this clause shall not apply to any Officer who is in receipt of a salary in excess of that provided for at Level 7 salary point 2 in clause 13.5.
Overtime Exemption. Malaspina University-College and the BCGEU agree, when the Employer offers part-time instructors the opportunity to accept additional part-time auxiliary or term hours, merit considered, such assignments are exempt from overtime pay (as outlined in Article 15), provided they do not, in combination, exceed 8 contact hours per day and 56 contact hours biweekly [as defined in Article 14.2(c)]. The Employer may decide to offer such assignments subject to the following considerations:
Overtime Exemption. The provisions of this clause do not apply to any employee who is in receipt of a salary provided for at and in excess of Level 7 step 1 in Schedule B of this Agreement to the extent that these employees will receive their additional hours worked as time in lieu at the ordinary time rate, that is an hour off for each hour of additional hours worked.
Overtime Exemption. Hours worked at an overtime payrate and/or any hours worked exceeding 40 per week are excluded from inclusion in PTO calculations for hourly workers and 12-Hour Per Diems.
